ARTICLE XII

FLOODPLAIN REGULATIONS

Sec. 62-954.- Adopted by reference.

(a)

The village has adopted extensive regulations dealing with the preservation, permitted relocation and maintenance of floodplains. Because of the length of these regulations, the village board has determined that the regulatory provisions would not be included within this Code.

(b)

The floodplain regulations of the village are heretofore found in Ordinance No. 1979-19.

(c)

In that ordinance, the regulations regarding floodplains are set out, a permit procedure is established and penalties are enacted for the punishment of violations of the terms of the ordinance.

(d)

On February 12, 1990, a comprehensive amendment of such floodplain ordinance has been adopted by the village board. On November 25, 1991, the comprehensive amendment of February 12, 1990, was amended in its entirety and is reflected in Ordinance 91-40.

(e)

On June 8, 1992, section 1003.3 was amended to allow for the construction of tool sheds and garages upon existing platted lots under certain circumstances and according to certain restrictions.

(f)

On October 11, 1993, section 200.0 was amended to make specific reference to 24 ILCS 24/1-2-1, 11-12-12, 11-30-8 and 11-30-2 granting municipal police power control; and section 601.0 was amended to indicate floodplain maps prepared by the state department of water resources.
