ARTICLE V

- SATELLITE DISH ANTENNA

Sec. 62-506. - Generally.

All installations of satellite antenna (television receiving only antennas (TVRO-S) shall be considered extraordinary structures and may be only installed upon obtaining a permit as provided by this Code, and a building permit prior to commencing installation.

Sec. 62-516. - Issuance criteria, residential zoning districts.

No permit or building permit shall be granted for a satellite antenna in any residential zoning district unless:

(1)

The applicant demonstrates that the intended use is authorized under applicable federal law.

(2)

The smallest practical size shall be used for any such dish. Such dish shall not be of a size greater than eight feet in its maximum diameter. No installation shall exceed a height of any existing structure on the building or surrounding buildings, provided that the overall height of the satellite antenna does not exceed 35 feet in height from the ground to the top of the antenna.

(3)

The construction and installation of satellite antenna shall strictly conform to all village ordinances.

(4)

Not more than one such satellite antenna may be installed on any one zoning lot.

(5)

In every case, the installation shall be located on the allowable building area for the principal building. The location shall not be in any required yard setback areas, unless the enforcement provides an acceptable location if otherwise in conformity with all other provisions of this chapter. In such case, a variation is required and the applicable provisions of this chapter governing variations shall be met.

(6)

All installations shall exhibit architectural quality, coloration to blend with surroundings and structural integrity. Experimental or temporary installations, inferior materials and questionable stability are not permitted. In every case, the entire installation shall be compatible with the character of the surrounding area and have no adverse impact upon the property, the neighborhood or the general public. Permanent foundations shall be adequate for anticipated wind loads. Electrical connections shall be low voltage direct or pulsed current, except where the device connected is underwriters laboratory approved, in which case alternating current will be allowed to code requirements. Consideration shall be given to protection of children as in the case of an attractive nuisance.

Sec. 62-517. - Issuance criteria, nonresidential zoning districts.

No permit or building permit shall be granted for a satellite antenna in any residential zoning district unless:

(1)

The applicant demonstrates that the intended use is authorized under applicable federal law.

(2)

The smallest practical size shall be used for any dish. Such dish shall be of a size no greater than 11 feet in its maximum directions. Any such dish to be mounted on a roof shall be accompanied by a sealed statement provided by a licensed professional engineer or architect stating that the roof will have the structural capacity to maintain the proposed installation. No installation shall exceed the height of any existing structure on the building or surrounding buildings, provided that the overall height of the satellite antenna does not exceed 45 feet from ground to the top of the antenna.

(3)

The construction and installation of satellite antenna shall strictly conform to all village ordinances.

(4)

Not more than one such satellite antenna may be installed on any one zoning lot.

(5)

Where nonresidential property abuts residential property, compliance with section 62-516(5) must be met.

(6)

All installations shall exhibit architectural quality, coloration to blend with surroundings and structural integrity. Experimental or temporary installations, inferior materials and questionable stability are not permitted. In every case, the entire installation shall be compatible with the character of the surrounding area and have no adverse impact upon the property, the neighborhood or the general public. Consideration shall be given to protection of children in the case of an attractive nuisance.

Sec. 62-518. - Procedure.

An application for a permit for the installation of a satellite antenna (TRVO) shall be obtained from the zoning enforcement administrator.

Sec. 62-519. - Application.

In all requests for permits, the application shall include all items generally required for actions sought for building and in addition, the following:

(1)

Plot plan showing proposed location and dish protection at extremes of the satellite band to be viewed. This requirement shall be satisfied by drawing radial lines from a point of the dish to each radial at a distance scaled to the distance between the rim of the dish to the pivot point. Each perpendicular line shall be scaled to the diameter of the dish to show its maximum protection on the plan at the extremes of its satellite scan. Compass directions will be adequate for this requirement.

(2)

Plans and specifications for the installation, including elevations, dish configuration, mount and foundation.

(3)

Location of principal structures on lots abutting the property or immediately across an alley from the property.
