ARTICLE III

OFFICIAL MAP

Sec. 121-90.- Intent.

It is the intent of the village board to establish an updated official map for the purpose of serving and promoting the public health, safety, convenience, economy, orderliness and general welfare of the community, to further the orderly layout and use of plan, to stabilize the location of real property boundary lines, to insure proper legal descriptions and proper monumenting of land, to facilitate adequate provision for transportation, parks, playgrounds, and stormwater drainage, and to facilitate the further subdivision of larger tracts into smaller parcels of land.

Sec. 121-91. - Authority.

This article is enacted under the authority granted by Wis. Stats. § 62.23(6).

Sec. 121-92. - Updated official map.

The maps designated as the "Official Map of the Village of Brown Deer" illustrate the required rights-of-way of future streets. The illustrated right-of-way dimensions for A-Minor Residential, B-Collector Residential and C-Manufacturing are suggested standards only. The specific right-of-way dimensions for the aforementioned streets are flexible. The appropriate right-of-way width for each new village street must be determined by village staff and approved by the village board in the form of a certified survey map, plat or some other legal document.

Sec. 121-93. - Changes and additions.

The village board may change or add to the updated official map so as to establish the exterior lines of, widen, narrow, extend, or close any platted, existing, proposed or planned streets, highways, parkways, parks or playgrounds.

Sec. 121-94. - Certified copy of map.

There shall be a certified copy of the updated official map described in section 121-92. The certified copy shall be kept in the office of the village clerk, and shall be available for inspection by any interested person during regular office hours. The certified copy shall bear on its face a certification that it is a true copy of the updated official map described in and accompanying the ordinance from which this article is derived and shall show the date of adoption of the ordinance from which this article is derived and shall be signed by the village president and countersigned by the village clerk. Thereafter, no change or addition to such updated official map shall become effective until it shall have been indicated by the appropriate notation of the aforesaid certified copy of the updated official map and a certificate placed thereon or attached thereto bearing the number and date of adoption of the amending ordinance. The certificate shall be signed by the village president and countersigned by the village clerk.

Sec. 121-95. - Map to be filed with register of deeds.

The village clerk shall be responsible immediately upon adoption of the updated official map with the county register of deeds.

Sec. 121-96. - Civil damages.

No damages shall be allowed for taking by any government agency, for street, highway and parkway purposes, any building erected in violation of this article.

No. 15-04, § I, adopted Mar. 2, 2015 repealed former § 121-96, entitled "Enforcement," which derived from: Prior Code, § 22-1-1.11; and § 22-1-1.11 of an ordinance adopted Sept. 20, 1954. Ord. No. 15-04 further amended the Code by renumbering § 121-97 as § 121-196, as set out herein.
