ARTICLE I

General Provisions

§ 88-1 Purpose.

Whereas the Village Board of the Village of Brownville deems it necessary to the promotion of health, safety and the general welfare of Brownville to regulate and restrict the height, number of stories and size of buildings and other structures; the percentage of lot that may be occupied; the size of yards, courts and other open spaces; the density of population; and the location and use of buildings, structures and land for trade, industry, residence or other purposes; the following districts and regulations are hereby established. The intent of this chapter is to promote and guide development in an orderly and efficient manner. This will reduce land use conflicts, promote traffic safety, enhance and protect the historical and recreational attributes of the Village, retain and improve land values, encourage quality development, ensure wise use of utilities and promote the general health and welfare of Village residents. This chapter is designed to protect existing development while providing some control of growth so that future development will not be a detriment to the Village and its residents.

§ 88-2 Provisions applying in all districts.

No building, structure or land shall hereafter be used or occupied, and no building or structure or part thereof shall hereafter be erected, constructed, reconstructed, moved or structurally altered unless in conformity with all of the regulations herein specified for the district in which it is located.
No building or other structure shall hereafter be erected or altered to exceed the height; to accommodate or house any other use; to occupy a lot of lesser area; or to have narrower or smaller rear yards, front yards, side yards or other open spaces than is herein specified for the district in which such building or other structure is located.
No part of a yard or open space or off-street parking or loading space required about or in connection with any building or structure for the purpose of complying with this chapter shall be included as part of a yard, open space or off-street parking or loading space similarly required for another building or structure.
No yard or lot or provision for off-street parking space existing at the time of enactment of this chapter shall be reduced in size or area below the minimum requirements set forth herein. Yards or lots created after the effective date of this chapter shall meet at least the minimum requirements established in this chapter.
Within each district, the regulations established by this chapter shall be minimum regulations and shall apply uniformly to each class or kind of structure or land.
