Definitions. When used in this chapter, unless otherwise expressly stated, the following words and terms shall have the meanings indicated:
A building, the use of which is customarily incidental to that of a dwelling and which is located on the same lot as that occupied by the main building.
A use customarily incidental and subordinate to the principle use and conducted on the same lot therewith.
Any person, establishment or business involved in the viewing or dissemination of material distinguished or characterized by an emphasis on matter depicting, describing or relating to a specific sexual activity or anatomical area.
The raising and production (for compensation) of crops, livestock, poultry, dairy products, fish or other wildlife, trees, maple syrup products and other similar pursuits; tree growing and harvesting, animal husbandry, horticultural operations, forestry operations; and the sale, at wholesale or retail, of farm products upon the premises where the same are grown or produced shall be considered agricultural operations.
To change or rearrange any exterior structural part of the existing facilities of a building or structure by enlarging the building or structure, whether by extending any side or increasing the height thereof, or to move the same from one location or position to another. It shall not be considered an alteration if there is no expansion of exterior dimensions. For instance, replacement of windows, doors, siding, roofing, etc., as well as interior alterations, shall not be considered an alteration for the purposes of this chapter.
Less than the completely and opaquely covered genitals, pubic region or female breasts below a point immediately above the top of the areola.
Human male genitals in a discernibly turgid state, even if completely covered.
A system of electrical conductors that transmit or receive radio frequency waves. Such waves shall include, but not be limited to, radio navigation, radio, television, and microwave communications.
Any lot or building or portion thereof used or occupied for the sale or supply of gasoline or motor vehicle fuels, oils or lubricants, or for the polishing, greasing, washing or servicing of motor vehicles.
A building wherein four or more unrelated persons reside.
Any structure having a roof supported by columns or by walls which is used or occupied for the shelter, housing or enclosure of animals, persons or property. The term, unless specified, includes both principle and accessory buildings.
The total area, taken on a horizontal plane at main grade level, consumed by the principle building and all accessory buildings, excluding chimneys, uncovered porches, patios, terraces, steps and open areaways.
The line that is formed by the face of the building or structure, or the attached part of the building or structure, nearest the lot line. This shall include measurement from such structures as uncovered porches, patios, terraces, open areaways, roof overhangs, cornices, eaves and other similar protrusions.
A structure with accommodations for living and sleeping designed for seasonal occupancy. The term does not include trailer camps.
Any lot or area used or occupied by one or more tents, recreation trailers or vehicles which are used for part time living or sleeping purposes for commercial purposes. Generally determined to be used by transients on a vacation trip.
A building to house a club or social organization not conducted for profit and which is not an adjunct to or operated by or in connection with a public tavern, cafe or other public place.
A building, structure or use operated for the benefit of the general well-being and enjoyment of the public. The use shall include but not be limited to fire stations, libraries and community-owned buildings.
The manufacture, bulk storage or handling of explosives, illuminating gases, lethal or toxic chemicals or other explosive, combustible, inflammable, lethal or toxic substances in such quantities or in such manner as may or does endanger the public safety. The term does not include the operation of a retail gasoline station.
The transfer of possession, custody, control or ownership of or the exhibition or presentation of any performance to a customer, member of the public or business invitee, of any material distinguished or characterized by an emphasis on matter depicting, describing or relating to specific sexual activities or anatomical areas.
A building or portion thereof, used or occupied as living quarters for one or more families. The term does not include tourist accommodations, trailers or mobile homes.
A detached building designated for or occupied exclusively by one family and containing not more than one dwelling unit.
A detached building where not more than two individual families live, or where two dwelling units, with separate cooking, sanitary, living and sleeping facilities, exist.
A building or group of buildings sited on a single lot consisting of three or more dwelling units. The term shall include garden apartments, townhouses, apartment houses and condominiums.
Any building or portion thereof providing complete living facilities for one family.
A restaurant, tavern or combination thereof that provides the public with food and/or drink for profit.
To erect, construct, build, re-erect, reconstruct, rebuild or excavate for a building or structure.
Erection, construction, alteration, operation or maintenance by municipal agencies or public utilities of telephone dial equipment centers, electrical or gas substations, water treatment or storage facilities, pumping stations and similar facilities.
One or more persons who live together in one dwelling unit and maintain a common household, which may consist of a single person or of two or more persons, whether or not related by blood, marriage or adoption, and may also include domestic servants and gratuitous guests.
The total horizontal area of all floors of a building excepting the basement and attic thereof measured along the faces of the interior walls.
The vertical distance measured from the average elevation of the main grade at the front of the building to the highest point of the roof.
Any accessory use of a service character customarily conducted within a dwelling by the resident thereof which is clearly secondary to the use of the dwelling for living purposes and does not substantially change the character thereof or have an exterior evidence of such use, other than an approved advertising sign and parking requirements associated therewith.
Any hospital, sanatorium or other institution used or occupied for the care of persons mentally or physically ill, incapacitated or disabled. The term includes nursing and convalescent homes.
Any of a group of uses directed at the manufacture, fabrication, assembly, treatment or preparation of materials that produces a product or service, and shall include but not be limited to paper mills and sewage plants. The term does not include light industrial uses.
A structure used for the harboring of more than three dogs that are more than four months old.
Any of a group of uses involved in the wholesale or retail sale of automobiles, farm equipment, heavy construction equipment and the like. These uses are characterized by large indoor or outdoor showrooms or display areas.
A facility which manufactures a product for wholesale or retail sale and does not employ over 50 people. The industry does not produce high volumes of polluting wastes and is compatible with other uses of the Business (B) District.
A parcel of land used or occupied, or capable of being used or occupied, by a building or structure and the accessory buildings, structures or uses customarily incidental to it, including such yards as are required by this chapter.
The mean horizontal distance between the front and rear lot lines, measured in the general direction of the side lot lines.
Any line dividing one lot from another or from the street or waterway; on a street, public or private, the right-of-way boundary line.
The lot line adjoining any existing street or highway right-of-way line or the waterfront property line. If the lot adjoins two or more streets or highways, it should be deemed to have a "front lot line" respectively on each.
The lot line opposite and most distant from the front lot line.
Any lot line other than the front or rear lot lines.
The horizontal distance between the side lot lines measured at the required setback lines.
A parcel of land at the junction of and fronting on two or more intersecting streets.
Establishments engaged in the mechanical or chemical transformation of materials or substances into new products.
A portable dwelling unit with or without its own mode of power, equipped with a rigid frame that enables attachment of wheels for transport. A "mobile home" shall be composed of at least 1,000 square feet and shall be designed to be capable of use as a year-round dwelling unit. The term does not include modular homes, camping trailers or recreation vehicles.
Any lot on which five or more mobile homes are located regardless of whether or not a charge is made for such accommodations.
A dwelling unit constructed off-site, consisting of one or more segments, and equipped, or used, for year-round purposes and designed to be transported on its own wheels, with or without a permanent foundation, cellar, skirting and with or without a pitched roof.
A building, or a group of buildings, whether detached or in connected units, used as individual sleeping or living quarters with direct outside access and related office, with or without restaurant facilities, designed primarily for transient automobile travelers, and provided with accessory off-street parking facilities.
Any motor vehicle which is unregistered or incapable of motion under its own power for a period of six successive months or longer.
Any use which is noxious, offensive or injurious by reason of the emission of dust, smoke, refuse matter, odor, gas, fumes, noise or vibration.
A dwelling where persons are lodged and furnished with meals and nursing care for commercial purposes. This shall not include homes for mentally handicapped, drug or alcohol rehabilitation patients, etc.
A space for parking off the public streets and places in the Village.
An off-street space available for the parking of one motor vehicle and having an area of not less than 200 square feet exclusive of passageways and accesses thereto, and having direct access to a street or highway.
Any use permitted under the provisions for the district in which the land, building or structure is located.
The Planning Board of the Village of Brownville.
A building in which is conducted the main or principal use of the lot on which such building is located.
The main or principal purpose for which any land, building or structure is used or occupied.
A building that contains space and facilities for any of a range of recreational pursuits that is run for commercial gain. The term includes bowling alleys, racquet clubs, health spas and the like.
A municipally owned and operated swimming pool, tennis court, athletic field or similar facility for use by the public.
A lot or land or part thereof used for the purpose of extracting stone, sand, gravel, topsoil or other mineral resources, for sale, as a commercial operation, and exclusive of the process of grading a lot preparatory to the construction of a building.
The yard between the rear building line and the rear lot line and extending the full width of the lot.
For part time living purposes only, shall include motor homes, truck campers and camping trailers less than 48 feet in length.
A commercial establishment that prepares and serves food to the public where a minimum of 50% of the total dollar sales is food service.
A building wherein three or fewer unrelated persons reside.
Any place for outdoor storage or deposit, whether in connection with a business or not, of:
Wastepaper, rags, scrap metal, waste building materials, appliances and farm equipment no longer intended for use which cover over 1,000 square feet of area or the aggregate weight of which is over 3,000 pounds and which are visible from any public highway; or
Two or more inoperative motor vehicles, whether for the purpose of resale of used parts, for the purpose of reclaiming for use some or all of the materials, such as metal, glass or fabric, or for the purpose of disposing of the materials.
Human genitals in a state of sexual stimulation or arousal.
Acts of human masturbation, sexual intercourse or sodomy.
Fondling or other erotic touching of human genitals, pubic region, buttocks or female breasts.
A group of commercial establishments, three or more, built on a site that is planned, developed, owned and managed as an operating unit relating in location, size, and type of shops to the trade area that the unit serves; it provides on-site parking in definite relationship to the type and total size of the stores.
A business that is intended to sell and trade retail goods or products to residents in the immediate community. Such enterprises shall include grocery stores, small implement dealers and similar operations. It shall not include industrial or manufacturing operations.
A business that is intended to provide services to residents in the immediate community. Such businesses shall include beauty shops and barbershops, shoe repair and other similar operations. It shall not include any industrial or manufacturing operations.
The edge of pavement of the street or highway involved.
Anything constructed or erected, the use of which requires location on the ground or attachment to something having location on the ground. The term includes dwelling units, buildings, swimming pools, platforms, stadiums, towers, billboards and signs, but is not intended to include conventional sidewalks, driveways, curbs, fences, chimneys, hedges or walls.
A structure on which transmitting and/or receiving antenna(s) is(are) located.
Any permanent building or part thereof, which is used or occupied for the overnight accommodation of transient guests and for which compensation is given. The term includes rental cottages, tourist cabins and camps, motor courts, motels and trailer camps.
Any structure that is quite high, compared to its lateral dimensions and usually constructed for a singular or specific purpose (i.e., radio tower).

The specific purpose for which any land, building or structure is used, designed, arranged, intended or occupied.
A grant of relief from the requirements of this chapter.
A facility of wood, stone or other materials or combination thereof intended for defense, security, screening, partitioning or enclosure; or for the retention of earth, stone, fill or other materials as in the case of retaining walls or bulkheads. A fence shall be considered a "wall."
Any refuse, rubbish, waste matter, litter, garbage, decomposable or organic matter, putrescible matter, carcass, sewage, excrement, sludge, hazardous liquids or substances (as per the New York State
Environmental Conservation Law), ashes, tin cans, crates, boxes or other substances or material offensive to the public or detrimental to its untreated nature.
That property which abuts a waterway or water body.
Along the front yards of waterfront property, the waterfront property line shall be determined as the high-water level elevation.
Generally determined to mean that unoccupied open space (from the ground upward) between the building line and the nearest lot line or road line. A yard may also be established by measuring the required yard distance away from the building line. This approach shall be utilized, for instance, when there is more than one principle structure permitted on the lot.
The yard between the building line and the front lot line and extending the full width of the lot. For the purpose of this chapter, the front yard of waterfront property shall be the yard between the front building line and the waterfront property line.
The yard between the rear building line and the rear lot line and extending the full width of the lot. For the purpose of this chapter, the rear yard of waterfront property shall be the yard between the rear building line and the road line.
An unoccupied space extending from the front yard to the rear yard between the required side setback line and the nearest side lot line.
A permit issued under the regulations of this chapter allowing a new use or construction/placement of a building or structure.
