CHAPTER 13

ADMINISTRATION

10-13-1: BUILDING PERMITS:

   (A)   No nonagricultural building or structure shall be erected, added to or structurally altered until a permit has been issued by the Code Enforcement Officer. Except upon a written order of the Board of Appeals, no such building permit shall be issued for any building where the construction, addition or alteration or use thereof would be in violation of any of the provisions of this title. No agriculture building or structure exceeding five hundred dollars ($500.00) in cost shall be erected, added to or structurally altered until a permit has been issued by the Code Enforcement Officer without charge. Such permit shall be issued upon compliance by the applicant with the building setback line. A building permit shall also be required for any swimming pool constructed or erected in the city with a volume exceeding five hundred (500) gallons.
   (B)   There shall be submitted with all applications for building permits of nonagricultural buildings or structures, two (2) copies of a layout or plot plan drawn to scale showing actual dimensions of the lot to be built upon, the exact size and location on the lot of the building and accessory buildings to be erected and such other information as may be necessary to determine and provide for the enforcement of this title.
   (C)   One copy of such layout or plot plan shall be returned when approved by the Code Enforcement Officer, together with such permit to the applicant. (Ord. 69-23, 4-6-1970; amd. Ord. 2019-8, 11-12-2019)

10-13-2: CERTIFICATES OF OCCUPANCY:

   (A)   Subsequent to the effective date hereof, no change in the use or occupancy of land, nor any change of use or occupancy in an existing nonagricultural building shall be made, nor shall any new nonagricultural building be occupied for any purpose until a certificate of occupancy has been issued by the Code Enforcement Officer. Every certificate of occupancy shall state that the new occupancy complies with all provisions of this title.
   (B)   No permit for excavation for, or the erection, construction or alteration of any nonagricultural building shall be issued before the application has been made and approved for a certificate of occupancy, but no occupancy permit shall be issued until the erection, construction or alteration has been completed, inspected and approved by the Code Enforcement Officer and no nonagricultural building or structure shall be occupied until the certificate and permit are issued.
   (C)   A record of all certificates of occupancy shall be kept on file in the Office of the Code Enforcement Officer and copies shall be furnished on request to any person having a proprietary or tenancy interest in the land or in a building affected by such certificate of occupancy.
   (D)   A certificate of occupancy shall be required for all nonconforming uses of nonagricultural land or buildings existing after the passage hereof, or any amendment thereto. Application for such certificate of occupancy for nonconforming uses shall be filed with the Code Enforcement Officer by the owner or occupant of the land or building occupied by such nonconforming use within one year from the effective date of this title, or amendments thereto. It shall be the duty of the Code Enforcement Officer to issue a certificate of occupancy for nonconforming uses.
   (E)   No nonconforming use shall be renewed, or changed, without a certificate of occupancy having first been issued by the Code Enforcement Officer. (Ord. 69-23, 4-6-1970)

10-13-3: DUTIES OF CODE ENFORCEMENT OFFICER:

The Code Enforcement Officer of the City, or other officials that have been or shall be duly appointed by the City Council, shall enforce this title and, in addition thereto and in furtherance of said authority, shall:
   (A)   Issue all certificates of occupancy and make and maintain records thereof.
   (B)   Conduct inspections of buildings, structures and uses of land, to determine compliance with the terms of this title.
   (C)   Maintain permanent and current records of this title, including, but not limited to, all maps, amendments and special uses, variations, appeals and applications therefor.
   (D)   Receive, file and forward to the Board of Appeals all applications for appeals, variations and other matters on which the Board of Appeals is required to decide under this title.
   (E)   Provide such clerical and technical assistance as may be required by the Board of Appeals in the exercise of its duties. (Ord. 69-23, 4-6-1970)
