CHAPTER 3

PLANNING COMMISSION

10-3-1: CREATED; COMPENSATION:

There is created a planning commission to be composed of four (4) members. Members of the planning commission shall serve without compensation, except for reasonable expenses incurred in performing their duties as members of the commission. A member of the town council will be appointed as chairperson and as an active member of the planning commission. Additional members may be appointed to the planning commission on a temporary basis as determined by the town council. (Ord. 01-04, 1-7-2002; amd. Ord. 21-03, 3-2-2021)

10-3-2: MEMBERS; TERMS; REMOVAL; VACANCIES:

The terms of the planning commission shall be staggered. Each member of the planning commission shall serve for a term of four (4) years and until their successor is appointed; provided, that the term of the first members shall be such that the term(s) of one member(s) shall expire each year. Terms of members of the planning commission shall begin on or before the first Monday in January of each year. The town council may remove any member of the planning commission for cause after review. Vacancies shall be promptly filled in the same manner as the original appointment for the remainder of the unexpired term. (Ord. 01-04, 1-7-2002; amd. Ord. 21-03, 3-2-2021)

10-3-3: QUALIFICATIONS OF MEMBERS:

Members of the planning commission shall, at the time of appointment and throughout their term of service, reside within the corporate limits of the town. Members shall be appointed by the mayor with the advice and consent of the town council and shall be selected without regard to political consideration and solely upon their qualifications for the position. Members may serve multiple terms. (Ord. 01-04, 1-7-2002; amd. Ord. 21-03, 3-2-2021)

10-3-4: OFFICERS:

The chairperson shall select a vice chair from members of the planning commission. The members of the planning commission adopt rules and regulations for their organization and for the transaction of business and the conduct of their proceedings. (Ord. 01-04, 1-7-2002; amd. Ord. 21-03, 3-2-2021)

10-3-5: MEETINGS:

The members of the planning commission shall meet at least once each month at a regular time as determined by the commission. The chairperson or a quorum of the commission may call additional meetings as conditions require or as the commission may determine.
   A.   In the intervening time between the meetings the chairperson will have the responsibility of approving non-contested permit applications after review with the vice chair and communicating decisions to other commission members.
   B.   In the event the chairperson or vice chair deems the permit requires commission review or discussion, notification will be provided to the chair who will schedule a commission meeting or add the permit review to the next scheduled meeting if the scheduled meeting will take place within fourteen (14) days. Any request for a subdivision will be brought before the planning commission at the next regularly scheduled meeting. (Ord. 01-04, 1-7-2002; amd. Ord. 21-03, 3-2-2021)

10-3-6: QUORUM:

Three (3) members of the planning commission shall constitute a quorum. (Ord. 01-04, 1-7-2002; amd. Ord. 21-03, 3-2-2021)

10-3-7: POWERS AND DUTIES:

The planning and zoning commission is an advisory commission to the town council in all matters dealing with land use matters. The planning commission shall keep with the laws of the state of Utah. At a minimum, the planning and zoning commission shall:
   A.   Conduct regular, advertised meetings at least once each month and at such other times as the planning and zoning commission may determine to be necessary.
   B.   Prepare or review the general plan and recommend the general plan, and amendments of the general plan to the town council.
   C.   Prepare or review and recommend land use, development and management ordinances, zoning maps, and amendments thereto to the town council.
   D.   Review, gather data, and recommend approval or denial of subdivision applications to the town council.
   E.   Review, gather data, and recommend changes to the annexation policy plan.
   F.   Review, gather data, compare with the intentions of the general plan, and recommend approval or denial of requests to rezone land within the boundary of the town to the town council. (Ord. 01-04, 1-7-2002; amd. Ord. 21-03, 3-2-2021)

10-3-8: VOTING:

A minimum of three (3) "yes" votes shall be required for the planning commission to take any action. The chairperson will have no voting rights except in the event of a tie; then the chairperson will place the tie breaking vote. (Ord. 01-04, 1-7-2002; amd. Ord. 21-03, 3-2-2021)

10-3-9: REPORTS AND RECORDS:

Reports of official acts and recommendations of the planning commission shall be public and shall be made in writing by the town’s deputy clerk, who shall be an employee of the town. The report shall indicate the vote of the commission on each item brought before the body. Any member of the commission may also make a concurring or dissenting report or recommendation to the town council. (Ord. 01-04, 1-7-2002; amd. Ord. 21-03, 3-2-2021)
