CHAPTER 6

AGRICULTURAL ZONE A-10

10-6-1: PURPOSE:

The purpose of this zone is to preserve appropriate areas of the town for permanent agricultural use. Uses normally and necessarily related to agriculture are permitted, and uses inimical to the continuance of agricultural activity are not allowed. (Ord. 01-04, 1-7-2002; amd. 2003 Code)

10-6-2: PERMITTED USES:

Uses permitted in this zone are:
Accessory buildings and uses.
Agriculture.
Home occupation.
Household pets.
Livestock, poultry.
Single-family dwellings. (Ord. 01-04, 1-7-2002; amd. 2003 Code)

10-6-3: CONDITIONAL USES:

Uses in this zone requiring a conditional use permit are:
Airports.
Buildings covering more than sixty percent (60%) of the area of the lot.
Cemeteries.
Church.
Concentrated animal operations.
Country clubs.
Fur farm, livestock feed yard, corral, silage pit, chicken coop.
Public riding stables.
Public school.
Public utilities.
Rear yard accessory buildings covering more than twenty five percent (25%) of the rear yard.
Stands for sale of produce grown on the premises.
Single-family dwelling, subject to the following conditions in addition to any others that may be imposed by the planning commission:
   A.   The allowed dwelling shall be maintained or constructed on a separately described lot with a minimum area of one acre, which shall be part of a larger parcel of real property of not less than ten (10) acres.
   B.   All other requirements of this title and this chapter shall be complied with.
   C.   The separately described lot shall have frontage on an existing street with access to an adequate water line, with the adequacy of any water line to be determined by the planning commission with the approval of the town council, and the decision of the town council shall be final.
   D.   The entire parcel of not less than ten (10) acres, which includes the separately described parcel referred to above, shall be subject to an agricultural land parcel declaration of covenants, conditions and restrictions, which shall be executed by the owner(s) of said parcel(s) and recorded, together with a copy of the conditional use permit, with the County Recorder. The forms for both documents shall be provided by the Town.
   E.   No more than one (1) single-family dwelling per ten (10) acres shall be allowed.
Other uses similar to the above, judged by the Planning Commission to be in harmony with the character and intent of this zone. (Ord. 01-04, 1-7-2002; amd. 2003 Code)

10-6-4: HEIGHT REGULATIONS:

The maximum height of each structure shall be established by the Planning Commission, but in no case shall a structure be allowed to exceed thirty five feet (35') in height. (Ord. 01-04, 1-7-2002)

10-6-6: MODIFYING REGULATIONS:

   A.   Side Yards: Main buildings, other than dwellings, shall have a minimum side yard of twenty feet (20'), and the total of the two (2) side yards shall be forty feet (40'). Private garages and other accessory buildings located at least ten feet (10') behind the main building may have a side yard of one foot (1'), provided the slope of the roof is not toward the property line. If the slope of the roof is toward the property line, the side yard has to be five feet (5') from the roof overhang.
   B.   Setback To Adjacent Streets: All structures will have a setback of thirty feet (30') on all adjacent streets.
   C.   Rear Yards: Private garages and accessory buildings located at least ten feet (10') behind the main building may have a rear yard of five feet (5'); provided, that on corner lots rearing on the side yard of another lot, the minimum rear yard for all buildings shall be ten feet (10').    D.   Distance Between Buildings: No building, structure, or enclosure housing animals or fowl shall be constructed closer to a dwelling on an adjacent lot less than sixty feet (60'). (Ord. 17-08, 6-6-2017)
