CHAPTER 8

COMMERCIAL ZONES

10-8A-1: PURPOSE:

The purpose of this zone is to provide areas for community retail and service activities in locations to conveniently serve the residents. (Ord. 01-04, 1-7-2002; amd. 2003 Code)

10-8A-2: PERMITTED USES:

Uses permitted in this zone are:
Altering and repair of wearing apparel.
Art needlework shop.
Art shop.
Artists' supplies.
Athletic goods store.
Babysitters' agency
Bakery in which manufacture is limited to goods retailed on the premises only.
Barber shop.
Beauty parlor.
Bicycle shop.
Book store.
Camera and photo supplies.
Candy store.
Catering establishment.
Confectionery, cafe or refreshment stand.
Dairy products store.
Dramatics school.
Frozen food lockers.
Fruit and vegetable stand.
Fruit juice store
Gift shop
Greenhouse.
Grocery.
Hardware store.
Hobby supply store.
Ice cream shop.
Ice store or vending station.
Locksmith, commercial.
Newsstand notions.
Office, business or professional.
Paint and wallpaper store.
Photo studio.
Photographer or sale of photographic supplies.
Plant materials.
Popcorn or nut shop.
Post office.
Private schools.
Radio and television sales and repair.
Shoe repair shop.
Sidewalk cafe.
Stationery and greeting card sales.
Studios for professional work or teaching any form of fine arts.
Toy store.
Variety store, limited to selling only items which may be sold by any other use by right in this article.
Accessory uses and buildings, customarily incidental to and subordinate to the above uses and devoted exclusively to the main permitted use of the premises.
Similar businesses to the above, judged by the planning commission to be in harmony with the character and intent of this zone. (Ord. 01-04, 1-7-2002; amd. 2003 Code)

10-8A-3: CONDITIONAL USES:

Uses in this zone requiring a conditional use permit are:
Automobile service station, including the repairing, painting or upholstering of motor vehicles.
Buildings covering more than sixty percent (60%) of the area of the lot.
Coal and fuel sales office.
Garden supplies store.
Kindergarten or nursery school.
Manufacture of goods to be sold at retail on the premises, provided such manufacture is conducted within a completely enclosed building and is clearly incidental to the operation in connection with a use permitted in this article.
Parking lot; public building and services; public utility stations.
Public utilities.
Rear yard accessory buildings covering more than twenty five percent (25%) of the rear yard.

10-8A-4: SPECIAL PROVISIONS:

The above specified stores, shops or business shall be retail establishments only and shall be permitted only under the following conditions:
   A.   Such business shall be conducted wholly within an enclosed building except for parking of automobiles and service to persons in automobiles.
   B.   All products, whether primary or incidental, shall be sold at retail on the premises.
   C.   No entertainment, except music, shall be permitted on cafes, confectioneries or refreshment stands.
   D.   All uses shall be free from objections because of odor, dust, smoke, noise or vibration, or other causes. (Ord. 01-04, 1-7-2002)

10-8A-5: HEIGHT REGULATIONS:

No building or structure shall be erected to a height greater than two and one-half (21/2) stories or thirty five feet (35'). (Ord. 01-04, 1-7-2002)
