- SPECIFIC DISTRICT REGULATIONS
1.1. General description.
This district shall provide an area for agricultural and horticultural uses. The rural nature and low density of population in this district requires only that uses essential to agricultural and horticulture have a reasonable setback of buildings from dedicated streets and/or highways. It is the purpose of this district to encourage and protect such uses from urbanization until such is warranted and the appropriate change in district classification is made.
1.2. Uses permitted.

1.3. Area and setback regulations.
Yards:
Front: Setback a minimum of twenty-five (25) feet;
Rear: Setback a minimum of twenty-five (25) feet;
Side: Setback a minimum of ten (10) feet, provided that any permitted pen or building in which livestock is kept shall be located not less than one hundred (100) feet from any lot line.
Lot area: Each one-family dwelling in the A-1 District, together with its accessory buildings, hereafter erected, shall be located on a parcel having an area of not less than three (3) acres, which track shall have access to a dedicated public street or highway. However, nothing in this ordinance shall prevent the erection of one (1) one-family dwelling, or the use of the land for agricultural purposes on any tract of three (3) acres or less, which was in existence on the date of passage of this ordinance, provided that all buildings erected on such lots shall meet all of the other requirements of this or any other applicable ordinances.

[2.1. General description.]
This is the most restrictive residential district. The principal use of land is for single-family dwellings and with special permission, related recreational, religious and educational facilities normally required to provide the basic elements of a balanced and attractive residential area. These areas are intended to be defined and protected from the encroachment of uses not performing a function appropriate to the residential environment. Internal stability, attractiveness, order and efficiency are encouraged by providing for adequate light, air and open space for dwellings and related facilities, and through consideration of the proper functional relationships of each element.
2.2. Uses permitted.

2.3. Area and setback regulations.
Yards:
Front: Setback a minimum of not less than twenty-five (25) feet;
Rear: Setback a minimum depth of not less than twenty-five (25) per cent of the depth of the lot, provided such yard need not exceed twenty-five (25) feet;
Side: On interior lots of seventy-five (75) feet or less in width, at the building line, there shall be a side yard on each side of a building having a width of not less than five (5) feet. For lots of more than seventy-five (75) feet in width, either of the side yards may be five (5) feet, and the sum of the side yards shall be twenty (20) per cent of the lot width, but need not exceed twenty (20) feet in width.
On corner lots, the side yard regulation shall be the same as for interior lots except in the case of reversed frontage where the corner lot rears on the side of a lot facing the other intersecting street, in which case there shall be a side yard on the corner lot of not less than fifty (50) per cent of the front required on the lot abutting the rear of the corner lot or separated only by an alley. No accessory buildings on a said corner lot shall project beyond the front yard line of the lots in the rear, nor shall a building be erected, reconstructed, altered or enlarged closer than five (5) feet to the line of the abutting lot to the rear.
No residential or accessory structure or garage shall be erected less than twelve and one-half (12-½) feet from the property line abutting a railroad right-of-way line, and a six-foot high protective fence must be constructed and maintained along this line. Said fence must be a physical fence.
Lot width: A minimum of fifty (50) feet at building setback line.
Lot area: A minimum of six thousand five hundred (6,500) square feet. For lots not served by public sanitary sewer or a central sewage disposal system, the minimum lot size shall be determined by the state board of health, the air and water pollution control commission and the city engineer. The builder shall furnish a certificate from the state board of health which sets out the minimum size of each such residential lot.
Height regulations: Refer to IRC or IBC.
Accessory structures: Not to exceed one (1) story in height or be located not less than sixty (60) feet from the front lot line, nor less than the distance required for the main building from any side lot line. The area of accessory buildings shall not exceed fifty (50) per cent of the area of the main building. An accessory structure may be constructed as a part of the main building, in which case the regulations controlling the main building shall apply. Accessory structure includes space satellite antennas.
2.4. Permitted use for zero-lot line dwellings.
Front yard: Setback a minimum of not less than twenty (20) feet from street right-of-way line, regardless of whether this front setback is part of an individual lot or part of the common open space.
Rear yard: Setback a minimum depth of not less than fifteen (15) per cent of the depth of the lot, provided such yard is no less than fifteen (15) feet with a minimum clearance of thirty (30) feet between buildings.
Side yard: Setback shall be no minimum on one (1) side and minimum of ten (10) feet on the opposite side, except that on a corner lot the minimum setback shall be no less than fifteen (15) feet on the street side.
Lot width: A minimum of forty (40) feet for zero lot line dwellings.
Lot area: A minimum lot area of four thousand (4,000) square feet. For lots not served by public sanitary sewer or a central sewer disposal system, the minimum lot size shall be determined by the state board of health, the air and water pollution control commission and the city engineer. The builder shall furnish a certificate of approval to the building inspection office, which sets out the minimum size of each lot.

Where zero-lot line dwelling units are designed to face upon an open space or common access court, rather than upon a street, this open court shall be a minimum of forty (40) feet in width, and said court shall not include vehicular drives or parking areas.
Zero-lot line dwellings shall be constructed against the lot line on one (1) side of a single-family residential lot which is proposed to be portioned land into individual lots, which shall be individually owned. No windows, doors, or other openings shall be permitted on the zero lot line setback side.
The division or re-division of land into two (2) or more lots, tracts, sites, or parcels for the purpose of transfer of ownership or for development shall constitute preliminary layout submission as per the land division ordinance.

3.2. Permitted uses. Any use permitted in the R-1 Residential District, but subject to the requirements thereof.

Side: Same as R-1;
Zero lot line: In zero lot line lots there shall be no minimum on one (1) side and ten (10) feet on the opposite side. However, in no case shall a zero lot line dwelling be built closer than ten (10) feet to the lot line of a lot which is zoned as R-1, Residential.
Lot width:
Single-family: Same as R-1;
Two-family: A minimum of sixty-five (65) feet at the front building setback line;
Zero lot line: A minimum of forty (40) feet at the front building setback line.
Lot area:
Single-family: A minimum of five thousand (5,000) square feet;
Two-family: A minimum of four thousand (4,000) square feet per family;
Zero lot line: A minimum of four thousand (4,000) square feet per family.
For lots not served by a public sanitary sewer or a central sewerage disposal system, the minimum lot size shall be determined by the State Board of Health, the Air and Water Pollution Control Commission and the city engineer. The builder shall furnish a certificate from the State Board of Health which sets out the minimum size of each such residential lot.

4.1. General description.
This is a residential district to provide for medium to moderately high population density. The principal use of land may range from two-family dwelling units to multifamily and garden apartment uses. Certain uses which are more compatible functionally with intensive residential uses than with commercial uses are permitted.
4.2. Permitted uses. Any use permitted in the R-2 Residential District, but subject to the requirements thereof.

4.3. Area and setback regulations.
Yards:
Front: Same as R-1;
Rear: Same as R-1;
Side: Same as R-1;
Multifamily: Same as R-1; however, an additional two (2) feet for each side yard shall be required for each story above the first story.
Lot width:
Two-family: A minimum of sixty-five (65) feet at the building setback line;
Zero lot line: A minimum of forty (40) feet at the building setback line;
Three-family: Same as two-family;
Four-family: Same as two-family;
Townhouses: Twenty-four (24) feet minimum;
Multifamily: A minimum of one hundred (100) feet at the building setback line.
Lot area:
Two-family: A minimum of four thousand (4,000) square feet per family;
Three-family: Same as two-family;
Four-family: Same as two-family;
Townhouses: A minimum of three thousand (3,000) square feet per family;
Multifamily: A minimum of two thousand five hundred (2,500) square feet per family.
Height regulations: Refer to IRC or IBC.
4.4. Regulations for townhouses and zero lot line dwellings which are a part of a tract development.
(1)
Minimum size of tract: One and one-half (1.5) acres and possessing maintained common open space.
(2)
Maximum density: Twenty-one (21) dwelling units per gross acre.
(3)
Minimum lot area: Two thousand (2,000) square feet for townhouses and two thousand four hundred (2,400) square feet for zero lot line dwellings.
(4)
Minimum lot width: Twenty (20) feet for townhouses and thirty (30) feet for zero lot line dwellings.
(5)
Minimum front setback: Ten (10) feet from street right-of-way line, regardless of whether this front setback is part of an individual lot or part of the common open space.
(6)
Minimum side setback: None for townhouses, except that on corner lots the minimum side setback of the corner side of townhouses and zero lot line lots or dwellings shall be ten (10) feet from the street right-of-way line. In zero lot line lots there shall be no minimum on one (1) side and ten (10) feet on the opposite side.
(7)
Minimum rear yard depth: None, except that there shall be a minimum clearance of twenty (20) feet between buildings except as otherwise provided for by section 4.4(11) herein.
(8)
Maximum height: Thirty-five (35) feet or two and one-half (2.5) stories.
(9)
Maximum lot coverage: Seventy-five (75) per cent of the lot area.
(10)
A maximum of eight (8) living units shall be allowed in each row of townhouses. When an end unit of a row of townhouses does not side on a street, an open space or court of at least twenty (20) feet in width shall be provided between it and the adjacent row of townhouses. However, where two (2) rows of townhouses, which together contain less than eight (8) living units, are immediately adjacent to each other, this open space between the ends of the two buildings may be reduced to a minimum of fifteen (15) feet.
(11)
Where townhouse lots and dwelling units are designed to face upon an open space or common access court rather than upon a street, this open court shall be a minimum of forty (40) feet in width and said court shall not include vehicular drives or parking areas.
(12)
Townhouses shall be constructed up to the side lot lines without side yards, and no windows, doors or other openings shall be installed in any common wall between units. However, where a two-story adjoins a single-story townhouse, windows may be installed in the second story wall of the two-story townhouse.
(13)
Zero lot line dwellings shall be constructed against the lot line on one (1) side of a lot, and no windows, doors or other openings shall be permitted on this side. Where adjacent zero lot line dwellings are not constructed against a common lot line, the builder or developer must provide for a perpetual wall maintenance easement of five (5) feet in width along the adjacent lot and parallel with such wall.

All tract development shall require planning commission approval.

5.3. Area and setback regulations.

Front: Multifamily: Same as R-1;
Rear: Multifamily: Same as R-1;
Side: Multifamily: Same as R-1; however, an additional four (4) feet for each side yard shall be required for each story above the third story.
Lot width:
Multifamily: A minimum of one hundred (100) feet at the building setback line.
Lot area:
Multifamily: A minimum of one thousand (1,000) square feet per family.

6.1. General description.
This is a residential district to provide for high population density. The principal use of the land in this district is for mobile homes. Certain uses which are more compatible functionally with intensive residential uses than with commercial uses are permitted.
6.2. Permitted uses. Any use permitted in the R-4 Residential District, but subject to the requirements thereof.

6.3. Area and setback regulations.
Yards:
Front: Mobile home: Same as R-1;
Rear: Mobile home: There shall be a rear yard of not less than ten (10) feet;
Side: Mobile home: A minimum of seven and one-half (7½) feet on each side.
Lot width:
Mobile home: A minimum of forty (40) feet at the building setback line.
Lot area:
Mobile home: A minimum of four thousand (4,000) square feet per family.
Height regulations: Refer to IRC or IBC.
Mobile home: Same as R-1.
All area and setback regulations provided for multifamily in paragraph 5.3 of R-4 are applicable to mobile home units.
6.4. Special provisions required for mobile homes on separate lots.
(1)
Mobile homes may be permitted on separate lots, in the R-5 District only, with planning commission approval, only if the following conditions exist:
a.
The lot is not suitable for development of a single-family house because the lot is substandard in size; or
b.
The mobile home will replace an existing house on the lot which is dilapidated, as determined by the housing inspector; or
c.
The lot has been designated an eyesore or a nuisance by the housing inspector.
(2)
Mobile homes shall be set on permanent weatherproof runners with appropriate tie-down hooks.
(3)
Mobile homes shall be connected to all utilities as required by applicable city ordinances.
(4)
Mobile homes shall be equipped with foundation skirt and permanent steps fastened to the ground.
(5)
Subject to all of the provisions of the Mobile Home Ordinances of the City of Columbus, Mississippi (See Chapter 18-1/2 of this Code), said Mobile Home Ordinance having been enacted on the 12th day of June, 1973.
6.5. Special provisions required for mobile home parks.
(1)
No mobile home park shall be permitted unless and until a detailed site plan, setting out dimensions and locations of all elements required under this section of this ordinance, has been submitted to the planning commission for review and recommendation and approved by the city council.
(2)
Mobile home parks shall not exceed a density of eight (8) mobile home units per gross acre within the mobile home park.
(3)
Mobile home parks shall provide a buffer strip of at least fifteen (15) feet in depth along all lot lines, including side and rear.
(4)
Buffers shall be unoccupied except for landscaping, drainage or utility facilities, sign or entrance ornamentation.
(5)
A minimum of five (5) per cent of the gross land area of the mobile home park shall be required for recreation area.
(6)
All mobile home lots shall abut upon a hard-surfaced, all-weather driveway of not less than twenty (20) feet in width, which shall have unobstructed access to a public street.
(7)
All streets, roadways and driveways within the park shall be paved with an all-weather surface of asphalt or concrete and shall meet generally accepted construction standards. They shall be appropriately lighted at night.
(8)
No mobile home park shall contain less than sixteen (16) stands.
(9)
Each mobile home stand shall be provided with permanent all-weather runners, patio parking area and utilities, as recommended by the Mobile Home Manufacturers Association.
(10)
Every mobile home stand shall provide a storage structure of at least one hundred (100) cubic feet. However, such structure shall not exceed three hundred (300) cubic feet.
(11)
There shall be no identification or advertising sign, other than one (1) unanimated identification sign not to exceed sixteen (16) square feet.
(12)
Subject to all of the provisions of the Mobile Home Ordinance of the City of Columbus (See Chapter 18-1/2 of this Code), said Mobile Home Ordinance having been enacted on the 12th day of June, 1973.
6.6 Permitted uses after planning commission review and recommendation and also approval by the City Council.
(1)
Recreation vehicle (RV) parks. (Site plan for park must be provided.)

7.1. General description.
The purpose of this commercial district is to provide retail stores and personal services for the convenience of the people in adjacent residential areas.
7.2. Permitted uses. Any use permitted in the R-3 Residential District, provided however, that no residential use is allowed when that use faces or abuts an industrial district or use.

7.3. Area and setback regulations.
Yards:
Front: A minimum of thirty-five (35) feet;
Rear: No rear yard shall be required except in instances where a commercial use abuts a residential district, in which case a rear yard of not less than thirty-five (35) feet shall be provided. Such space will be screened from the abutting residential district by concealing walls or by concealing fences or by other concealing screening not less than six (6) feet in height;
Side: No side yards are required except in instances where a commercial use abuts a residential district, in which case a minimum side yard of twenty-five (25) feet shall be provided, as measured from the side lot line to the nearest building or structure on the side adjacent to the residential district. Such space shall be screened from the abutting residential district by concealing walls or by concealing fences or by other concealing screening not less than six (6) feet in height.
Lot width: A minimum of one hundred (100) feet at the building setback line.

8.1. General description.
The purpose of this district is to provide relatively quiet, attractive and spacious areas for the development of non-retail restricted commercial uses that do not generate substantial volumes of vehicular traffic. This district is intended to encourage high quality office park type development in a protected environment and also may serve as a buffer between residential uses and C-1, C-2 or C-3 Commercial Districts.
8.2. Uses permitted.

Any type of professional occupation as defined in this ordinance and any other office type activity in which there is kept no stock in trade or merchandise for sale (excluding prescription drugs sold and administered by a physician) and which offers only a service to the general public, excluding animal clinic.
8.3. [Screening.]
All uses which abut residential uses shall be screened by concealing walls or concealing fences or other concealing screening not less than six (6) feet in height.

9.1. General description.
This commercial district is intended for the conduct of personal and business services and retail business of the community. Traffic generated by these uses will be primarily passenger vehicles and only those trucks and commercial vehicles required for stocking and delivery of retail goods.

9.3. Area and setback regulations.

Front: No front yard shall be required, except where the frontage on one (1) side of a street between two intersecting streets is partly in the C-2 Commercial District and partly in a residential district, the front yard regulations of the residential district shall apply;

Side: Same as C-1 Neighborhood Commercial District.

10.1. General description.
This commercial district is intended for the conduct of personal business services for the motoring public.
10.2. Uses permitted.

11.1. General description.
This commercial district is intended for occupations and businesses that need commercial zoning but do not require highway frontage in order to operate successfully.

12.1. General description.
The owner, or owners, of any contiguous and compact tract of land shall submit to the planning commission a petition for the rezoning and subsequent exclusive use and development of all such tracts of land as a Planned Industrial Park District. The petition submitted shall be referred to the planning commission for study, hearing and report as provided by law.
In a Planned Industrial Park District, no building, structure, land or premises shall be used, and no building or structure shall be hereafter erected, constructed, reconstructed or altered until such use, erection, construction, reconstruction or alteration shall have been specifically authorized by the governing authority, after study and recommendation by the planning commission.
12.2. Uses permitted.

12.3. Special requirements.
The planning commission shall satisfy themselves that certain conditions are met before recommending approval of any use in a Planned Industrial Park District. Pursuant to this section, the applicant shall be required to furnish:
(1)
Overall development plan;
(2)
Data describing all processes and equipment involved in the proposed use;
(3)
Plans showing location and design of structures, delivery points, loading and storage areas, walls, fences, screen planting, signs, lighting devices and pedestrian walks;
(4)
Plans illustrating adequate off-street parking, according to standards established by the then-pertaining zoning ordinance;
(5)
Traffic routing system, so designed as to minimize nuisance effects due to the generation of traffic to and from the use;
(6)
Comprehensive landscaping plan;
(7)
Any other information the planning commission may need to adequately consider the effect the proposed uses may have upon the cost of providing adequate services to the area.
The planning commission shall further satisfy themselves that the uses proposed for any Planned Industrial Park District shall be compatible with the adjacent and nearby uses of land and are consistent with the intent and purposes of this ordinance, to promote the public health, safety, morals or general welfare.

13.1. General description.
This industrial district is intended primarily for production and assembly plants that are conducted so the noise, odor, dust and glare of each operation is properly controlled; and for adult arcades, adult bookstores, adult entertainment establishments, adult motels and adult motion picture theaters for the protection and promotion of the health, safety and general welfare of the city and its citizens.
13.2. Uses permitted.

13.3. Area and setback regulations.
Yards:
Front: A minimum of forty (40) feet to the building setback line;
Rear: Where a building is to be serviced from the rear, there shall be provided an alleyway, service court, rear yard or combination thereof, of not less than fifty (50) feet, except in instances where this district use abuts a residential district, such space shall be screened from the abutting residential district by concealing walls or by concealing fences or by other concealing screening, not less than six (6) feet in height.
Side: The side yard building setback line on each side of the lot shall be not less than twenty-five (25) feet, as measured from the side lot line to the nearest building or structure, except in instances where this district use abuts a residential district, in which case a minimum side yard of sixty (60) feet shall be provided on the side adjacent to the residential district, such space shall be screened from the abutting residential district by concealing walls or by concealing fences or by other concealing screening, not less than six (6) feet in height.
Lot width: None required.
Height regulations: Refer to IRC or IBC.
13.4. Adult entertainment establishments.
(a)
No adult arcade, adult bookstore, adult cabaret, adult motion picture theater, adult motel, adult video store, or any other adult entertainment establishment as defined in Appendix A, Article II, Section 2 of the Code of Ordinances shall be located within one thousand five hundred (1,500) feet of any other such use, or located within one thousand five hundred (1,500) feet of any residence or residentially zoned property, dwelling, church, synagogue, regular place of worship, school, park, day care center, days care home, nursing home, or playground.
(b)
For the purposes of this ordinance, measurement shall be made in a straight line, without regard to intervening structures or objects, from the nearest portion of the building or structure use as a part of the premises where an adult entertainment business is conducted, to the nearest property line of the premises of a church, synagogue, regular place of worship, school, or to the nearest boundary of an affected park, day care center, day care home, playground, residence, residential district, or residential lot.
(c)
For the purposes of subsection (b) of this section, the distance between any two (2) adult entertainment business uses shall be measured in a straight line, without regard to intervening structures or objects, from the closest exterior wall of the structure in which each business is located.
(d)
An adult entertainment business may not be operated in the same building, structure, or portion thereof, containing another adult entertainment business.
(e)
Adult entertainment businesses are only permitted in the light industrial zone.
(f)
Regulation of obscenity subject to state law. Notwithstanding any language or definition used herein, this ordinance does not permit any acts, display or distribution of materials which violate the obscenity statutes or any other laws of the State of Mississippi.
(g)
Application. All other provisions, conditions and requirements of the Columbus Municipal Code shall apply to the adult entertainment businesses.
(h)
Ratification. The remainder of the Columbus Municipal Code is hereby ratified and shall remain in full force and effect. This amendatory ordinance shall become effective on the day following the adoption thereof. The city clerk shall cause this amendatory ordinance to be published in a newspaper of general circulation as provided by law.
13.5. Prohibited uses.
No night clubs, bars or brown bag establishments are permitted in the I-2 light industrial district.

14.1. General description.
This industrial district is intended to provide for heavy industrial uses.

Front: A minimum of fifty (50) feet at the building setback line;

15.1. Permitted uses chart symbols.

Uses Allowed by Right. Uses in the Chart identified by "R" in any column are permitted by right in that particular district, subject to the conditions specified in the "Uses and Conditions" column or elsewhere in this Ordinance.
b.
Uses Requiring Planning Approval. Uses in the Chart identified by "P" in any column are permitted in that particular district upon approval of their location and site plan by the Planning Commission and City Council as being appropriate with regard to transportation and access, water supply, waste disposal, fire and undue traffic congestion, or, creating a traffic hazard; and as being in harmony with the orderly and appropriate development of the district in which the use is located.

Uses Not Permitted. Uses in the Chart identified by "-" are not permitted in that particular district.
(3)
Uses Not Listed. In any case where a requested use is not specifically listed in the chart, the Inspection Department Director, or, his agent shall refer the item to the Planning Commission and City Council as a Planning Appeal approval for determination.
(4)
Compliance With District Requirements. Any use permitted in any district whether by Right "R", or, with Permitted Use Approval "P", or, with conditions specified, must comply with the requirements of the district in which it is located, unless it is approved as a Planned Unit Development (PUD) with modifications as required by the Planning Commission, or unless variance from such requirements is specifically requested and approved by the Zoning Board of Adjustments.

- SPECIFIC DISTRICT REGULATIONS
1.1. General description.
This district shall provide an area for agricultural and horticultural uses. The rural nature and low density of population in this district requires only that uses essential to agricultural and horticulture have a reasonable setback of buildings from dedicated streets and/or highways. It is the purpose of this district to encourage and protect such uses from urbanization until such is warranted and the appropriate change in district classification is made.
1.2. Uses permitted.
See Chart of Uses Permitted in Section 15.
1.3. Area and setback regulations.
Yards:
Front: Setback a minimum of twenty-five (25) feet;
Rear: Setback a minimum of twenty-five (25) feet;
Side: Setback a minimum of ten (10) feet, provided that any permitted pen or building in which livestock is kept shall be located not less than one hundred (100) feet from any lot line.
Lot area: Each one-family dwelling in the A-1 District, together with its accessory buildings, hereafter erected, shall be located on a parcel having an area of not less than three (3) acres, which track shall have access to a dedicated public street or highway. However, nothing in this ordinance shall prevent the erection of one (1) one-family dwelling, or the use of the land for agricultural purposes on any tract of three (3) acres or less, which was in existence on the date of passage of this ordinance, provided that all buildings erected on such lots shall meet all of the other requirements of this or any other applicable ordinances.

[2.1. General description.]
This is the most restrictive residential district. The principal use of land is for single-family dwellings and with special permission, related recreational, religious and educational facilities normally required to provide the basic elements of a balanced and attractive residential area. These areas are intended to be defined and protected from the encroachment of uses not performing a function appropriate to the residential environment. Internal stability, attractiveness, order and efficiency are encouraged by providing for adequate light, air and open space for dwellings and related facilities, and through consideration of the proper functional relationships of each element.
2.2. Uses permitted.
See Chart of Uses Permitted in Section 15.
2.3. Area and setback regulations.
Yards:
Front: Setback a minimum of not less than twenty-five (25) feet;
Rear: Setback a minimum depth of not less than twenty-five (25) per cent of the depth of the lot, provided such yard need not exceed twenty-five (25) feet;
Side: On interior lots of seventy-five (75) feet or less in width, at the building line, there shall be a side yard on each side of a building having a width of not less than five (5) feet. For lots of more than seventy-five (75) feet in width, either of the side yards may be five (5) feet, and the sum of the side yards shall be twenty (20) per cent of the lot width, but need not exceed twenty (20) feet in width.
On corner lots, the side yard regulation shall be the same as for interior lots except in the case of reversed frontage where the corner lot rears on the side of a lot facing the other intersecting street, in which case there shall be a side yard on the corner lot of not less than fifty (50) per cent of the front required on the lot abutting the rear of the corner lot or separated only by an alley. No accessory buildings on a said corner lot shall project beyond the front yard line of the lots in the rear, nor shall a building be erected, reconstructed, altered or enlarged closer than five (5) feet to the line of the abutting lot to the rear.
No residential or accessory structure or garage shall be erected less than twelve and one-half (12-½) feet from the property line abutting a railroad right-of-way line, and a six-foot high protective fence must be constructed and maintained along this line. Said fence must be a physical fence.
Lot width: A minimum of fifty (50) feet at building setback line.
Lot area: A minimum of six thousand five hundred (6,500) square feet. For lots not served by public sanitary sewer or a central sewage disposal system, the minimum lot size shall be determined by the state board of health, the air and water pollution control commission and the city engineer. The builder shall furnish a certificate from the state board of health which sets out the minimum size of each such residential lot.
Height regulations: Refer to IRC or IBC.
Accessory structures: Not to exceed one (1) story in height or be located not less than sixty (60) feet from the front lot line, nor less than the distance required for the main building from any side lot line. The area of accessory buildings shall not exceed fifty (50) per cent of the area of the main building. An accessory structure may be constructed as a part of the main building, in which case the regulations controlling the main building shall apply. Accessory structure includes space satellite antennas.
2.4. Permitted use for zero-lot line dwellings.
Front yard: Setback a minimum of not less than twenty (20) feet from street right-of-way line, regardless of whether this front setback is part of an individual lot or part of the common open space.
Rear yard: Setback a minimum depth of not less than fifteen (15) per cent of the depth of the lot, provided such yard is no less than fifteen (15) feet with a minimum clearance of thirty (30) feet between buildings.
Side yard: Setback shall be no minimum on one (1) side and minimum of ten (10) feet on the opposite side, except that on a corner lot the minimum setback shall be no less than fifteen (15) feet on the street side.
Lot width: A minimum of forty (40) feet for zero lot line dwellings.
Lot area: A minimum lot area of four thousand (4,000) square feet. For lots not served by public sanitary sewer or a central sewer disposal system, the minimum lot size shall be determined by the state board of health, the air and water pollution control commission and the city engineer. The builder shall furnish a certificate of approval to the building inspection office, which sets out the minimum size of each lot.

Where zero-lot line dwelling units are designed to face upon an open space or common access court, rather than upon a street, this open court shall be a minimum of forty (40) feet in width, and said court shall not include vehicular drives or parking areas.
Zero-lot line dwellings shall be constructed against the lot line on one (1) side of a single-family residential lot which is proposed to be portioned land into individual lots, which shall be individually owned. No windows, doors, or other openings shall be permitted on the zero lot line setback side.
The division or re-division of land into two (2) or more lots, tracts, sites, or parcels for the purpose of transfer of ownership or for development shall constitute preliminary layout submission as per the land division ordinance.

3.2. Permitted uses. Any use permitted in the R-1 Residential District, but subject to the requirements thereof.

Zero lot line: In zero lot line lots there shall be no minimum on one (1) side and ten (10) feet on the opposite side. However, in no case shall a zero lot line dwelling be built closer than ten (10) feet to the lot line of a lot which is zoned as R-1, Residential.

Single-family: Same as R-1;
Two-family: A minimum of sixty-five (65) feet at the front building setback line;
Zero lot line: A minimum of forty (40) feet at the front building setback line.
Lot area:
Single-family: A minimum of five thousand (5,000) square feet;

4.1. General description.
This is a residential district to provide for medium to moderately high population density. The principal use of land may range from two-family dwelling units to multifamily and garden apartment uses. Certain uses which are more compatible functionally with intensive residential uses than with commercial uses are permitted.

4.4. Regulations for townhouses and zero lot line dwellings which are a part of a tract development.
(1)
Minimum size of tract: One and one-half (1.5) acres and possessing maintained common open space.
(2)
Maximum density: Twenty-one (21) dwelling units per gross acre.
(3)
Minimum lot area: Two thousand (2,000) square feet for townhouses and two thousand four hundred (2,400) square feet for zero lot line dwellings.
(4)
Minimum lot width: Twenty (20) feet for townhouses and thirty (30) feet for zero lot line dwellings.
(5)
Minimum front setback: Ten (10) feet from street right-of-way line, regardless of whether this front setback is part of an individual lot or part of the common open space.
(6)
Minimum side setback: None for townhouses, except that on corner lots the minimum side setback of the corner side of townhouses and zero lot line lots or dwellings shall be ten (10) feet from the street right-of-way line. In zero lot line lots there shall be no minimum on one (1) side and ten (10) feet on the opposite side.
(7)
Minimum rear yard depth: None, except that there shall be a minimum clearance of twenty (20) feet between buildings except as otherwise provided for by section 4.4(11) herein.
(8)
Maximum height: Thirty-five (35) feet or two and one-half (2.5) stories.
(9)
Maximum lot coverage: Seventy-five (75) per cent of the lot area.
(10)
A maximum of eight (8) living units shall be allowed in each row of townhouses. When an end unit of a row of townhouses does not side on a street, an open space or court of at least twenty (20) feet in width shall be provided between it and the adjacent row of townhouses. However, where two (2) rows of townhouses, which together contain less than eight (8) living units, are immediately adjacent to each other, this open space between the ends of the two buildings may be reduced to a minimum of fifteen (15) feet.
(11)
Where townhouse lots and dwelling units are designed to face upon an open space or common access court rather than upon a street, this open court shall be a minimum of forty (40) feet in width and said court shall not include vehicular drives or parking areas.
(12)
Townhouses shall be constructed up to the side lot lines without side yards, and no windows, doors or other openings shall be installed in any common wall between units. However, where a two-story adjoins a single-story townhouse, windows may be installed in the second story wall of the two-story townhouse.
(13)
Zero lot line dwellings shall be constructed against the lot line on one (1) side of a lot, and no windows, doors or other openings shall be permitted on this side. Where adjacent zero lot line dwellings are not constructed against a common lot line, the builder or developer must provide for a perpetual wall maintenance easement of five (5) feet in width along the adjacent lot and parallel with such wall.

All tract development shall require planning commission approval.

5.1. General description.
This is a residential district to provide for high population density. The principal use of land may range from two-family dwelling units to multifamily uses. Certain uses which are more compatible functionally with intensive residential uses than with commercial uses are permitted.
5.2. Permitted uses. Any use permitted in the R-3 Residential District, but subject to the requirements thereof.

6.1. General description.
This is a residential district to provide for high population density. The principal use of the land in this district is for mobile homes. Certain uses which are more compatible functionally with intensive residential uses than with commercial uses are permitted.
6.2. Permitted uses. Any use permitted in the R-4 Residential District, but subject to the requirements thereof.

6.3. Area and setback regulations.
Yards:
Front: Mobile home: Same as R-1;
Rear: Mobile home: There shall be a rear yard of not less than ten (10) feet;
Side: Mobile home: A minimum of seven and one-half (7½) feet on each side.
Lot width:
Mobile home: A minimum of forty (40) feet at the building setback line.
Lot area:
Mobile home: A minimum of four thousand (4,000) square feet per family.
Height regulations: Refer to IRC or IBC.
Mobile home: Same as R-1.
All area and setback regulations provided for multifamily in paragraph 5.3 of R-4 are applicable to mobile home units.
6.4. Special provisions required for mobile homes on separate lots.
(1)
Mobile homes may be permitted on separate lots, in the R-5 District only, with planning commission approval, only if the following conditions exist:
a.
The lot is not suitable for development of a single-family house because the lot is substandard in size; or
b.
The mobile home will replace an existing house on the lot which is dilapidated, as determined by the housing inspector; or
c.
The lot has been designated an eyesore or a nuisance by the housing inspector.
(2)
Mobile homes shall be set on permanent weatherproof runners with appropriate tie-down hooks.
(3)
Mobile homes shall be connected to all utilities as required by applicable city ordinances.
(4)
Mobile homes shall be equipped with foundation skirt and permanent steps fastened to the ground.
(5)
Subject to all of the provisions of the Mobile Home Ordinances of the City of Columbus, Mississippi (See Chapter 18-1/2 of this Code), said Mobile Home Ordinance having been enacted on the 12th day of June, 1973.
6.5. Special provisions required for mobile home parks.
(1)
No mobile home park shall be permitted unless and until a detailed site plan, setting out dimensions and locations of all elements required under this section of this ordinance, has been submitted to the planning commission for review and recommendation and approved by the city council.
(2)
Mobile home parks shall not exceed a density of eight (8) mobile home units per gross acre within the mobile home park.
(3)
Mobile home parks shall provide a buffer strip of at least fifteen (15) feet in depth along all lot lines, including side and rear.
(4)
Buffers shall be unoccupied except for landscaping, drainage or utility facilities, sign or entrance ornamentation.
(5)
A minimum of five (5) per cent of the gross land area of the mobile home park shall be required for recreation area.
(6)
All mobile home lots shall abut upon a hard-surfaced, all-weather driveway of not less than twenty (20) feet in width, which shall have unobstructed access to a public street.
(7)
All streets, roadways and driveways within the park shall be paved with an all-weather surface of asphalt or concrete and shall meet generally accepted construction standards. They shall be appropriately lighted at night.
(8)
No mobile home park shall contain less than sixteen (16) stands.
(9)
Each mobile home stand shall be provided with permanent all-weather runners, patio parking area and utilities, as recommended by the Mobile Home Manufacturers Association.
(10)
Every mobile home stand shall provide a storage structure of at least one hundred (100) cubic feet. However, such structure shall not exceed three hundred (300) cubic feet.
(11)
There shall be no identification or advertising sign, other than one (1) unanimated identification sign not to exceed sixteen (16) square feet.
(12)
Subject to all of the provisions of the Mobile Home Ordinance of the City of Columbus (See Chapter 18-1/2 of this Code), said Mobile Home Ordinance having been enacted on the 12th day of June, 1973.
6.6 Permitted uses after planning commission review and recommendation and also approval by the City Council.
(1)
Recreation vehicle (RV) parks. (Site plan for park must be provided.)

7.1. General description.
The purpose of this commercial district is to provide retail stores and personal services for the convenience of the people in adjacent residential areas.
7.2. Permitted uses. Any use permitted in the R-3 Residential District, provided however, that no residential use is allowed when that use faces or abuts an industrial district or use.

7.3. Area and setback regulations.
Yards:
Front: A minimum of thirty-five (35) feet;
Rear: No rear yard shall be required except in instances where a commercial use abuts a residential district, in which case a rear yard of not less than thirty-five (35) feet shall be provided. Such space will be screened from the abutting residential district by concealing walls or by concealing fences or by other concealing screening not less than six (6) feet in height;
Side: No side yards are required except in instances where a commercial use abuts a residential district, in which case a minimum side yard of twenty-five (25) feet shall be provided, as measured from the side lot line to the nearest building or structure on the side adjacent to the residential district. Such space shall be screened from the abutting residential district by concealing walls or by concealing fences or by other concealing screening not less than six (6) feet in height.
Lot width: A minimum of one hundred (100) feet at the building setback line.

8.1. General description.
The purpose of this district is to provide relatively quiet, attractive and spacious areas for the development of non-retail restricted commercial uses that do not generate substantial volumes of vehicular traffic. This district is intended to encourage high quality office park type development in a protected environment and also may serve as a buffer between residential uses and C-1, C-2 or C-3 Commercial Districts.
8.2. Uses permitted.

Any type of professional occupation as defined in this ordinance and any other office type activity in which there is kept no stock in trade or merchandise for sale (excluding prescription drugs sold and administered by a physician) and which offers only a service to the general public, excluding animal clinic.
8.3. [Screening.]
All uses which abut residential uses shall be screened by concealing walls or concealing fences or other concealing screening not less than six (6) feet in height.

11.1. General description.
This commercial district is intended for occupations and businesses that need commercial zoning but do not require highway frontage in order to operate successfully.

12.1. General description.
The owner, or owners, of any contiguous and compact tract of land shall submit to the planning commission a petition for the rezoning and subsequent exclusive use and development of all such tracts of land as a Planned Industrial Park District. The petition submitted shall be referred to the planning commission for study, hearing and report as provided by law.
In a Planned Industrial Park District, no building, structure, land or premises shall be used, and no building or structure shall be hereafter erected, constructed, reconstructed or altered until such use, erection, construction, reconstruction or alteration shall have been specifically authorized by the governing authority, after study and recommendation by the planning commission.
12.2. Uses permitted.
See Chart of Uses Permitted in Section 15.
12.3. Special requirements.
The planning commission shall satisfy themselves that certain conditions are met before recommending approval of any use in a Planned Industrial Park District. Pursuant to this section, the applicant shall be required to furnish:
(1)
Overall development plan;
(2)
Data describing all processes and equipment involved in the proposed use;
(3)
Plans showing location and design of structures, delivery points, loading and storage areas, walls, fences, screen planting, signs, lighting devices and pedestrian walks;
(4)
Plans illustrating adequate off-street parking, according to standards established by the then-pertaining zoning ordinance;
(5)
Traffic routing system, so designed as to minimize nuisance effects due to the generation of traffic to and from the use;
(6)
Comprehensive landscaping plan;
(7)
Any other information the planning commission may need to adequately consider the effect the proposed uses may have upon the cost of providing adequate services to the area.
The planning commission shall further satisfy themselves that the uses proposed for any Planned Industrial Park District shall be compatible with the adjacent and nearby uses of land and are consistent with the intent and purposes of this ordinance, to promote the public health, safety, morals or general welfare.

13.1. General description.
This industrial district is intended primarily for production and assembly plants that are conducted so the noise, odor, dust and glare of each operation is properly controlled; and for adult arcades, adult bookstores, adult entertainment establishments, adult motels and adult motion picture theaters for the protection and promotion of the health, safety and general welfare of the city and its citizens.
13.2. Uses permitted.

13.3. Area and setback regulations.
Yards:
Front: A minimum of forty (40) feet to the building setback line;
Rear: Where a building is to be serviced from the rear, there shall be provided an alleyway, service court, rear yard or combination thereof, of not less than fifty (50) feet, except in instances where this district use abuts a residential district, such space shall be screened from the abutting residential district by concealing walls or by concealing fences or by other concealing screening, not less than six (6) feet in height.
Side: The side yard building setback line on each side of the lot shall be not less than twenty-five (25) feet, as measured from the side lot line to the nearest building or structure, except in instances where this district use abuts a residential district, in which case a minimum side yard of sixty (60) feet shall be provided on the side adjacent to the residential district, such space shall be screened from the abutting residential district by concealing walls or by concealing fences or by other concealing screening, not less than six (6) feet in height.
Lot width: None required.
Height regulations: Refer to IRC or IBC.
13.4. Adult entertainment establishments.
(a)
No adult arcade, adult bookstore, adult cabaret, adult motion picture theater, adult motel, adult video store, or any other adult entertainment establishment as defined in Appendix A, Article II, Section 2 of the Code of Ordinances shall be located within one thousand five hundred (1,500) feet of any other such use, or located within one thousand five hundred (1,500) feet of any residence or residentially zoned property, dwelling, church, synagogue, regular place of worship, school, park, day care center, days care home, nursing home, or playground.
(b)
For the purposes of this ordinance, measurement shall be made in a straight line, without regard to intervening structures or objects, from the nearest portion of the building or structure use as a part of the premises where an adult entertainment business is conducted, to the nearest property line of the premises of a church, synagogue, regular place of worship, school, or to the nearest boundary of an affected park, day care center, day care home, playground, residence, residential district, or residential lot.
(c)
For the purposes of subsection (b) of this section, the distance between any two (2) adult entertainment business uses shall be measured in a straight line, without regard to intervening structures or objects, from the closest exterior wall of the structure in which each business is located.
(d)
An adult entertainment business may not be operated in the same building, structure, or portion thereof, containing another adult entertainment business.
(e)
Adult entertainment businesses are only permitted in the light industrial zone.
(f)
Regulation of obscenity subject to state law. Notwithstanding any language or definition used herein, this ordinance does not permit any acts, display or distribution of materials which violate the obscenity statutes or any other laws of the State of Mississippi.
(g)
Application. All other provisions, conditions and requirements of the Columbus Municipal Code shall apply to the adult entertainment businesses.
(h)
Ratification. The remainder of the Columbus Municipal Code is hereby ratified and shall remain in full force and effect. This amendatory ordinance shall become effective on the day following the adoption thereof. The city clerk shall cause this amendatory ordinance to be published in a newspaper of general circulation as provided by law.
13.5. Prohibited uses.
No night clubs, bars or brown bag establishments are permitted in the I-2 light industrial district.

14.1. General description.
This industrial district is intended to provide for heavy industrial uses.
14.2. Uses permitted.
