A.
Membership. The planning board is created as provided in section 160D-301 of the General Statutes of North Carolina. The planning board shall be made up of a total of eight (8) members; seven (7) members shall be residents of the city and one (1) member shall be a resident of the extraterritorial jurisdiction and shall be appointed as provided in section 160D-307 of the General Statutes of North Carolina. The term of office of the members of the planning board shall be three (3) years and shall coincide with their appointed planning board terms. Vacancies shall be filled for the unexpired term only. All members shall have equal rights and privileges in all matters.
B.
Duties. A planning board is assigned the following powers and duties:
(1)
To prepare, review, maintain, monitor, and periodically update and recommend to the city council a comprehensive plan, and such other plans as deemed appropriate, and conduct ongoing related research, data collection, mapping, and analysis.
(2)
To facilitate and coordinate citizen engagement and participation in the planning process.
(3)
To develop and recommend policies, ordinances, development regulations, administrative procedures, and other means for carrying out plans in a coordinated and efficient manner.
(4)
To advise the city council concerning the implementation of plans, including, but not limited to, review and comment on all zoning, text, and map amendments as required by G.S. 160D-604.
(5)
To exercise any functions in the administration and enforcement of various means for carrying out plans that the governing board may direct.
(6)
To perform any other related duties that the governing board may direct.
C.
Organization. The board shall elect from among their membership who are residents of the city, the chairman and the vice-chairman who may be selected from the entire membership. Terms of the chairman and vice-chairman shall be for one (1) year and shall begin June 1 each year. The board shall adopt from time to time such rules and regulations as it may deem necessary to carry into effect the provisions of this section.

The term of office of the members of the board of adjustment shall be three (3) years and shall coincide with their appointed planning board terms. Vacancies shall be filled for the unexpired term only. All members shall have equal rights and privileges in all matters.
The board of adjustment shall have three (3) alternate members made up of the Conover Planning Board, whose terms shall be three (3) years and shall coincide with their appointed planning board terms.
B.
Duties. The board shall hear and decide all matters upon which it is required to pass under any statute or development regulation adopted under the Conover zoning ordinance which include relief from standards from ordinances that would result in an undue hardship and appeals of staff determinations. The board carries out its decision making authority following a quasi-judicial hearing format.
C.
Organization. The board shall elect from among their membership who are residents of the City of Conover, the chairman and vice-chairman. Terms of the chairman and vice-chairman shall be for one (1) year and shall begin June 1 each year. The board shall adopt from time to time such rules and regulations as it may deem necessary to carry into effect the provisions of this section.

Membership. The parks and recreation advisory board is created as provided in section 160D-306 of the General Statutes of North Carolina. The parks and recreation advisory board shall be made up of the same members as the planning board as outlined in section 40.2 above.
B.
Duties. A parks and recreation advisory board is assigned the following duties:
(1)
To prepare, review, maintain, monitor, and periodically update and recommend to the city council a parks and recreation master plan, and such other individual park and greenway plans as deemed appropriate for sites and parcels throughout the city.
(2)
To facilitate and coordinate citizen engagement and participation in the planning process surrounding parks.
C.
Organization. The board chair and vice chair positions shall be made up of the same members who are the chair and vice chair of the planning board.
