ARTICLE IV

- HEIGHT, PLACEMENT, SIZE AND PARKING AREA REGULATIONS

Sec. 58-148. - Established.

(a)

No building, structure or premises shall be used, nor erected, altered or enlarged, except under the conditions, limitations and regulations contained in Table I, Schedule of Building Height and Placement, Lot Size, and Parking Space Regulations, inclusive of footnotes, which follows:

1 A building line set by ordinance, or by the existence of multiple buildings on one side of a street for a block, shall set the minimum setback; and, through lots shall have front yard setback facing both streets.

2 Regular side yard/side yard adjacent to a side street (i.e., corner lot).

3 Minimum area requirements do not apply to lots which were approved and recorded prior to the adoption of the ordinance from which this chapter is derived.

4 A minimum of 2,500 square feet shall be provided for each family unit per floor level.

5 Places of public assembly shall provide one off-street parking space per each five seats. Businesses shall provide off-street facilities for loading and unloading goods and merchandise, within the building or adjacent to a public alley, and to accommodate the reasonably estimated parking needs of customers during normal peak business hours.

6 If a building is set back one foot from all lines per each two feet above 75 feet, maximum height shall be 95 feet; and, a building adjacent to residential use districts shall be set back one foot from all lines per each one foot of height above 40 feet.

7 If part of the frontage on one side of a street for a block is in another district, the more restricted district regulations shall apply.

8 Residential only; no restrictions on commercial building lot areas.

Sec. 58-149. - Information required.

All requests for building permits shall contain sufficient information to verify compliance with such conditions, limitations and regulations. Information shall also be provided for those areas or items for which such limitations, conditions and regulations are presently not set out or established.
