CHAPTER 5

RESIDENCE DISTRICTS

10-5A-1: PERMITTED USES:

The following uses are permitted:
Accessory uses, including off-street parking facilities in accordance with the provisions of Chapter 10 of this Title.
Churches and rectories.
Community residences, providing a sponsoring agency shall have obtained an administrative occupancy permit from the City Building Commissioner prior to such residence being established. No dwelling unit shall be occupied as a community residence until a certificate of occupancy has been issued by the Building Commissioner. No certificate of occupancy shall be issued for a community residence unless: a) the community residence is located at least one thousand feet (1,000') from any existing community residence, as measured from lot line to lot line; and b) the applicant demonstrates that it has either obtained or is eligible for State or local licensing or certification to operate the proposed community residence, or that the proposed community residence is licensed or certified or eligible for licensing or certification. The Building Commissioner may revoke a certificate of occupancy for a community residence if its license or certification, or operator's license or certification to operate the community residence, is revoked. A certificate of occupancy is not transferable to another operator or another location.
Disk antennas, as defined in Section 10-1-3 of this Title and subject to the provisions of Section 10-2-14 of this Title.
Home occupations.
One-family detached dwellings and permitted accessory uses.
Parks, forest preserves and recreational areas, when publicly owned and operated.
Schools (public, denominational, private, elementary and high), including playgrounds and athletic fields auxiliary thereto.
Signs, subject to the provisions of Title 8, Chapter 5 of this Code.
Temporary buildings for construction purposes for a period not to exceed the completion date of such construction.
Temporary real estate office in conjunction with a new housing development limited to the selling or renting of new units in such development and in no case to be operated for more than six (6) months following completion of construction of said housing development. 10-5A-2: SPECIAL USES:

The following uses may be allowed by special use permit in accordance with the provisions of Chapter 12 of this Title:
Community residences which fail to meet all requirements for an administrative occupancy permit, excluding community residences denied a required State or local license.
Dish antennas, not exceeding twenty feet (20') in height, located in a rear yard and in compliance with all rear yard setback requirements.
Golf courses, regulation size, but not including "Par 3" golf courses, commercially operated driving ranges or miniature golf courses.
Off-street open parking area, provided there is a need for this facility in the interest of public necessity and convenience and that no appropriate site is available in nearby business or manufacturing districts.
Planned development, under single ownership or control, in which incidental business or recreational facilities for the convenience of the occupants may be furnished, provided the property proposed for development shall have a gross area of at least four (4) acres. For such developments, the City Council may vary the regulations herein, provided such variations are consistent with the general purpose and intent of the ordinance and will result in better site planning and thus be of greater benefit both to the occupants of the development and to the community.
Principal offices of professional persons for the practice of medicine, dentistry, law, architecture and engineering, CPA; provided that each such office is situated in the same dwelling unit as the home of the occupant, with not more than two (2) persons other than members of the occupant's immediate family being employed, and provided further that the residential character of the exterior of the dwelling is maintained.
Public parking area when located and developed as required under chapter 10 of this title.
Public utilities service uses.

10-5A-3: OFF STREET PARKING AND LOADING:

Automobile parking facilities shall be provided as required or permitted in chapter 10 of this title. (Ord. 80-2-0, 12-1979)

10-5A-4: LOT AREA REQUIREMENTS:

   A.   Every one-family detached dwelling hereafter erected shall be located on a lot having an area of not less than twenty thousand (20,000) square feet, and a width at the established building line of not less than one hundred feet (100').
   B.   All nonresidential principal uses of buildings as permitted herein shall be located on a tract of land having an area of not less than twenty thousand (20,000) square feet with a minimum width of one hundred feet (100') at the building line.
   C.   Minimum lot sizes for special uses shall be prescribed and conditions stipulated at the time a special use permit is authorized, but in no case shall any such lot have an area of less than twenty thousand (20,000) square feet and a width at the building line of one hundred feet (100'). 10-5A-5: YARD AREAS:

No building shall be erected or enlarged unless the following yards are provided and maintained in connection with such building, structure or enlargement: (Ord. 80-2-0, 12-1979)
   A.   Front Yard Setback: The front yard setback for all noncorner lots in the R-1 Residential Zoning Districts shall be thirty feet (30'). (Ord. 17-26-0, 8-23-2017)
   B.   Side Yards: A side yard on each side of the principal building of not less than ten feet (10').
   C.   Rear Yard: A rear yard of not less than fifty feet (50'). (Ord. 13-60-0, 12-11-2013)
   D.   Corner Lot Front Yard Setbacks: The front yard setback for all corner lots in the R-1 Residential Zoning Districts shall be thirty feet (30') for each front yard setback. (Ord. 17-26-0, 8-23-2017)

10-5A-6: STRUCTURE REQUIREMENTS:

   A.   Maximum Floor Area Ratio: The maximum floor area ratio shall not exceed 0.3, except that the maximum floor ratio for single-family residences with an attached garage shall not exceed 0.35. (Ord. 97-28-0, 11-12-1997)
   B.   Dwelling Standards: Every one-story dwelling hereafter erected in any R-1 One-Family Residence District shall have a total ground floor area of not less than one thousand two hundred (1,200) square feet, measured from the outside of the exterior walls, including utility rooms but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes. Every dwelling of more than one story hereafter erected in any R-1 One-Family Residence District shall have a total floor area, measured from the outside of the exterior walls, of not less than one thousand five hundred (1,500) square feet, including utility rooms but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes, except that enclosed space intended for habitable rooms which are to be completed within a reasonable time may be considered in computing such floor areas.    C.   Height Limitation: No structure within an R-1 One-Family Residence District shall exceed thirty five feet (35') in height, including mechanical equipment, from grade; this height limitation is not intended to, and shall not, authorize an increase in permitted height of structures specifically limited to a lesser height. 10-5B-1: PERMITTED USES:

Any use permitted in the R-1 one-family residence district, section 10-5A-1 of this chapter. (Ord. 80-2-0, 12-1979)

10-5B-2: SPECIAL USES:

Any use which may be allowed as a special use in the R-1 one- family residence district, in accordance with the provisions of chapter 12 of this title. (Ord. 80-2-0, 12-1979)

10-5B-3: OFF-STREET PARKING AND LOADING:

10-5B-4: LOT AREA REQUIREMENTS:

   A.   Every one-family detached dwelling hereafter erected shall be located on a site having an area of not less than ten thousand (10,000) square feet, and a width at the established building line of not less than seventy five feet (75'). (Ord. 89-17-0, 5-10-1989)
   B.   All nonresidential principal uses as permitted in this district shall be located on a tract of land having an area of not less than ten thousand (10,000) square feet with a minimum width of seventy five feet (75') at the building line.
   C.   Minimum lot sizes for special uses shall be prescribed and conditions stipulated at the time a special use permit is authorized, but in no case shall any such lot have an area of less than ten thousand (10,000) square feet. (Ord. 80-2-0, 12-1979)

10-5B-5: YARD AREAS:

No building shall be erected or enlarged unless the following yards are provided and maintained: (Ord. 80-2-0, 12-1979)
   A.   Front Yard: A front yard of not less than thirty feet (30'). (Ord. 01-06-0, 3-14-2001)
   B.   Side Yards: A side yard on each side of the principal building of not less than five feet (5') and a combined total of not less than fifteen feet (15'), except where a side yard adjoins a street, the minimum width shall be not less than ten feet (10') on the street side.
   C.   Rear Yard: A rear yard of not less than thirty feet (30'). (Ord. 80-2-0, 12-1979)
   D.   Corner Lots: Each side of a corner lot facing upon a street shall comply with the front yard setback requirements applicable to other residential lots, similarly zoned, facing upon the same street. (Ord. 86-1-0, 1-22-1986)

10-5B-6: STRUCTURE REQUIREMENTS:

10-5C-3: OFF STREET PARKING AND LOADING:

10-5C-4: LOT AREA REQUIREMENTS:

   A.   Every one-family detached dwelling hereafter erected shall be located on a site having an area of not less than seven thousand five hundred (7,500) square feet, and a width at the established building line of sixty five feet (65'). (Ord. 89-13-0, 4-26-1989)
   B.   All nonresidential principal uses as permitted in this district shall be located on a tract of land having an area of not less than ten thousand (10,000) square feet with a minimum width of seventy five feet (75') at the building line.
   C.   Minimum lot sizes for special uses shall be prescribed and conditions stipulated at the time a special use permit is authorized, but in no case shall any such lot have an area of less than ten thousand (10,000) square feet. (Ord. 80-2-0, 12-1979)

10-5C-5: YARD AREAS:

The same regulations shall apply in the R-3 district as permitted or required in the R-2 district, except that an accessory building may be located not closer than three feet (3') to the side lot line of a side yard; and, except that the corner lot restrictions contained in subsection 10-5B-5D of this chapter shall not apply to any corner lot located within an R-3 district having sixty five feet (65') or less frontage along each street which it faces. 10-5C-6: STRUCTURE REQUIREMENTS:

   A.   Maximum Floor Area Ratio: The maximum floor area ratio shall not exceed 0.3, except that the maximum floor ratio for single-family residences with an attached garage shall not exceed 0.35.
      1.   Exception: For lots of seven thousand five hundred (7,500) square feet or less, then the maximum floor area ratio shall not exceed 0.40, except that the maximum floor ratio for single-family residences with an attached garage shall not exceed 0.45.
   B.   Dwelling Standards: Every one-story dwelling hereafter erected in any R-3 one-family residence district shall have a total ground floor area of not less than one thousand two hundred (1,200) square feet, measured from the outside of the exterior walls, including utility rooms but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes. Every dwelling of more than one story hereafter erected in any R-3 one-family residence district shall have a total floor area, measured from the outside of the exterior walls, of not less than one thousand two hundred (1,200) square feet, including utility rooms but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes, except that enclosed space intended for habitable rooms which are to be completed within a reasonable time may be considered in computing such floor areas.
   C.   Determining Maximum Floor Area: The total maximum floor area permitted by the maximum floor area ratio set forth in subsection A of this section shall be the sum of the gross horizontal areas of the floor or floors of such building, measured from the exterior faces of exterior walls or from the centerline of party walls separating two (2) buildings. In particular the floor area shall include:
      1.   Basement space if at least one-half (1/2) of the basement story height is above the established curb or ground level;
      2.   Elevator shafts and stairwells at each floor;
      3.   Floor space used for mechanical equipment where the structural headroom exceeds seven and one-half feet (71/2'); except equipment, open or enclosed, located on the roof, i.e., bulkheads, water tanks and cooling towers;
      4.   Attic floor space where the structural headroom exceeds seven and one-half feet (71/2') and the attic is accessible by a permanent stairway;
      5.   Interior balconies and mezzanines;
      6.   Enclosed porches, but not terraces and breezeways.
   D.   Height Limitation: No structure within an R-3 one-family residence district shall exceed thirty feet (30') in height, including mechanical equipment, from grade; this height limitation is not intended to, and shall not, authorize an increase in permitted height of structures specifically limited to a lesser height. 10-5D-1: PERMITTED USES:

The following uses are permitted:
Any use permitted in the R-1 one-family residence district.
Two-family dwellings. (Ord. 80-2-0, 12-1979)

10-5D-2: SPECIAL USES:

Any use which may be allowed as a special use in the R-1 one- family residence district, in accordance with the provisions of chapter 12 of this title. (Ord. 80-2-0, 12-1979)

10-5D-3: TRANSITIONAL USES:

Any of the following transitional uses may be permitted on a zoning lot located in the R-4 two-family residence district, where the side of such zoning lot abuts upon the side or rear of a zoning lot in a business or manufacturing district or is separated only by an alley, provided such transitional use does not extend more than one hundred feet (100') from the boundary of a business or manufacturing district which it adjoins, and provided the location and proposed development are first approved by the plan commission:
Multiple-family dwellings with the same lot requirements as in the R-5 general residence district.
Principal offices of professional persons for the practice of medicine, dentistry, physical therapy, law, architecture and engineering, provided that each such office is situated in the same dwelling unit as the home of the occupant, with not more than two (2) persons other than members of the occupant's immediate family being employed; and provided further that the residential character of the exterior of the dwelling is maintained. 10-5D-4: OFF-STREET PARKING AND LOADING:

Automobile parking facilities shall be provided as required or permitted in chapter 10 of this title. (Ord. 80-2-0, 12-1979)

10-5D-5: LOT AREA REQUIREMENTS:

   A.   Every one-family detached dwelling hereafter erected shall be located on a lot having an area of not less than seven thousand five hundred (7,500) square feet, and a width at the established building line of not less than sixty five feet (65'). (Ord. 80-2-0, 12-1979; amd. Ord. 89-32-0, 7-26-1989)
   B.   Every two-family dwelling hereafter erected within an R-4 zoning district shall be on a zoning lot having a minimum area of not less than seven thousand five hundred (7,500) square feet, and a minimum width of not less than sixty five feet (65') at the building line; provided, that where a lot has less width than required but was recorded as a lot of record prior to July 11, 1960, such lot may be occupied by a two-family dwelling provided it has not been reclassified as R-4 subsequent to the effective date of this amendatory subsection, and provided further that the lot area shall be not less than six thousand (6,000) square feet.    C.   All nonresidential principal uses as permitted in this district shall be located on a tract of land having an area of not less than ten thousand (10,000) square feet with a minimum width of seventy five feet (75') at the building line.
   D.   Minimum lot sizes for special uses shall be prescribed and conditions stipulated at the time a special use permit is authorized, but in no case shall any such lot have an area of less than ten thousand (10,000) square feet in area. (Ord. 80-2-0, 12-1979)

10-5D-6: YARD AREAS:

No building shall be erected or enlarged unless the following yards are provided and maintained: (Ord. 80-2-0, 12-1979)
   A.   Front Yard: A front yard of not less than twenty five feet (25'). (Ord. 01-06-0, 3-14-2001)
   B.   Side Yards: A side yard on each side of the zoning lot of not less than ten percent (10%) of the width of the lot, except where a side yard adjoins a street, the minimum width shall be not less than ten feet (10') on the street side and a total minimum width of fifteen feet (15').
   C.   Rear Yard: A rear yard of not less than thirty feet (30'). (Ord. 80-2-0, 12-1979)
   D.   Corner Lots: Each side of a corner lot facing upon a street shall comply with the front yard setback requirements applicable to other residential lots, similarly zoned, facing upon the same street. (Ord. 86-1-0, 1-22-1986)

10-5D-7: STRUCTURE REQUIREMENTS:

   A.   Maximum Floor Area Ratio: The maximum floor area ratio shall not exceed 0.3. (Ord. 95-12-0, 4-11-1995)
   B.   Dwelling Standards:
      1.   One-family dwellings erected in any R-4 two-family residence district shall conform to the same floor areas as required for one-family dwellings in the R-3 one-family residence district.
      2.   Two-family dwelling structures shall have a total floor area of not less than seven hundred twenty (720) square feet for each dwelling unit, measured from the outside walls, including utility rooms but excluding all other areas not used for living or sleeping purposes.    C.   Determining Maximum Floor Area: The total maximum floor area permitted by the maximum floor area ratio set forth in subsection A of this section shall be the sum of the gross horizontal areas of the floor or floors of such building, measured from the exterior faces of exterior walls or from the center line of party walls separating two (2) buildings. In particular the floor area shall include:
      1.   Basement space if at least one-half (1/2) of the basement story height is above the established curb or ground level;
      2.   Elevator shafts and stairwells at each floor;
      3.   Floor space used for mechanical equipment where the structural headroom exceeds seven and one-half feet (71/2'); except equipment, open or enclosed, located on the roof, i.e., bulkheads, water tanks and cooling towers;
      4.   Attic floor space where the structural headroom exceeds seven and one-half feet (71/2').

10-5E-1: PERMITTED USES:

The following uses are permitted:
Any use permitted in the R-4 two-family residence district. The uses permitted in each of the following subclassifications:
R-5A: One-family row dwellings (party wall), on a parcel of land of less than five (5) acres and one-family detached dwellings in accordance with the requirements set forth in this article.
R-5B: Townhouses on a parcel of land of less than five (5) acres, in accordance with the requirements of this article.
R-5C: Apartments on a parcel of land of less than five (5) acres, in accordance with the requirements set forth in this article.
R-5D: Condominiums on a parcel of land of less than five (5) acres, in accordance with the requirements of this article. (Ord. 95-25-0, 7-12-1995)

10-5E-2: SPECIAL USES:

The following uses may be allowed by special use permit in accordance with the provisions of chapter 12 of this title:
Any of the uses which may be allowed as a special use in the R-1 one-family residence district.
Convalescent and rest homes.
Planned developments for multiple-family and row dwellings on a parcel of five (5) acres or larger. (Ord. 84-18-0, 6-13-1984)

10-5E-3: OFF STREET PARKING AND LOADING:

Automobile parking facilities shall be provided as required or permitted in chapter 10 of this title. (Ord. 80-2-0, 12-1979)

10-5E-4: LOT AREA REQUIREMENTS:

   A.   Every one-family detached dwelling hereafter erected shall be located on a lot having an area of not less than seven thousand five hundred (7,500) square feet, and a width at the established building line of not less than sixty five feet (65').
   B.   All two-family dwellings hereafter erected or structurally altered shall be located on a lot having an area of not less than seven thousand five hundred (7,500) square feet, and a width at the established building line of not less than sixty five feet (65').
   C.   All structures or buildings containing three (3) or more dwelling units shall be located on a lot which provides minimum lot area per dwelling unit as follows:

provided, however, that in no event shall the minimum lot area be less than seven thousand five hundred (7,500) square feet.
   D.   All nonresidential principal uses permitted in this district shall be located on a lot having an area of not less than ten thousand (10,000) square feet and with a minimum width of not less than seventy five feet (75') at the building line.
   E.   Minimum lot sizes for special uses shall be prescribed at the time a special use permit is authorized, but in no case shall any such lot be less than ten thousand (10,000) square feet in area. (Ord. 08-36-0, 7-23-2008)

10-5E-5: YARD AREAS:

No building shall be erected or enlarged unless the following yards are provided and maintained: (Ord. 84-18-0, 6-13-1984)
   A.   Front Yard: On every zoning lot a front yard shall be provided of not less than twenty five feet (25'). For buildings exceeding twenty five feet (25') in height, the minimum front yard shall be increased by one foot (1') for each two feet (2') or fraction thereof by which the building height exceeds twenty five feet (25'), but in no case shall a front yard of more than forty feet (40') be required.
Required front yards shall be unobstructed from ground level to the sky, except as otherwise provided in section 10-2-4 of this title. (Ord. 01-06-0, 3-14-2001)
   B.   Side Yards: Side yards shall be provided as follows:
      1.   For one-family detached dwellings, the same regulations shall apply as in the R-3 one-family residence district.
      2.   For two-family dwellings, the same regulations shall apply as in the R-4 two-family residence district.
      3.   For multiple-family dwellings, the side yard on each side of the main building shall be a minimum of ten feet (10') in width plus an additional two feet (2') in width for each additional story above two (2) stories in height. On corner lots there shall be maintained a side yard of not less than fifteen feet (15') on the side adjacent to the street which intersects the street upon which the building maintains frontage, and in the case of a reversed corner lot, there shall be maintained a setback from the side street of not less than fifty percent (50%) of the front yard required on the lots in the rear of such corner lots, but such setback need not exceed fifteen feet (15'). No accessory building on said reversed corner lot shall project beyond the front yard required on the adjacent lot to the rear, nor be located nearer than five feet (5') to the side lot line of said adjacent lots.
      4.   On a lot improved with a nonresidential building, there shall be a side yard of not less than twelve feet (12') on each side of the main structure and a combined total of side yards of not less than thirty feet (30').
   C.   Rear Yard: There shall be a rear yard of not less than twenty five feet (25'). (Ord. 80-2-0, 12-1979)
   D.   Corner Lots: Each side of a corner lot facing upon a street shall comply with the front yard setback requirements applicable to other residential lots, similarly zoned, facing upon the same street. (Ord. 86-1-0, 1-22-1986)

10-5E-6: STRUCTURE REQUIREMENTS:

   A.   Maximum Floor Area Ratio:
      1.   For structures regulated by the adopted international residential code, the maximum floor area ratio shall not exceed 0.3, except that the maximum floor ratio for residences with an attached garage shall not exceed 0.35.
      2.   For multiple-family dwelling structures regulated by the adopted international building code, the floor area ratio shall not exceed 0.6, and not more than thirty percent (30%) of the zoning lot shall be covered by a building or buildings.
   B.   Dwelling Standards:
      1.   One-family dwellings erected in any R-5 general residence district shall conform to the same floor areas as required or permitted in the R-3 one-family residence district.
      2.   Two-family dwelling structures erected in any R-5 residence district shall conform to the same floor areas as required or permitted in the R-4 two-family residence district.
      3.   Each dwelling unit in residential and mixed use structures regulated by the adopted international building code, multiple-family dwelling structures (3 or more dwelling units) shall have a floor area of not less than six hundred (600) square feet.
   C.   Height Limitation: No structure within an R-5 general residence district shall exceed thirty five feet (35') in height, including mechanical equipment, from grade; this height limitation is not intended to, and shall not, authorize an increase in permitted height of structures specifically limited to a lesser height. 10-5F-1: PURPOSE:

The purpose of the R-7 rural residential zone district is to provide for primarily one-family residences while preserving the rural character of the district. The standards in this district are intended to assure that permitted uses peacefully coexist in a low density setting and recognizes that the district is not suitable for traditional residential development as a result of utility system limitations, street capacity or topography. 10-5F-2: PERMITTED USES:

Accessory buildings.
Home occupations.
Public and/or nonprofit parks.
Public buildings including firehouses.
Single-family residences. (Ord. 04-24-0, 5-26-2004; amd. Ord. 22-30-O, 7-13-2022)

10-5F-3: SPECIAL USES:

Golf courses.
Horse boarding or riding schools.
Noncommercial keeping of livestock. The raising or keeping of domesticated animals (other than household pets) for recreational use.
All buildings used to house noncommercial livestock shall be prohibited from placement in the front yard, unless it is at least one hundred feet (100') from the closest property line. All outdoor pasture/recreation areas shall be enclosed with fencing to prevent the escape of the animals. All animal wastes shall be properly stored and disposed of, so as not to be objectionable at the site's property line. All animals, their housing, and their outdoor pasture/recreation areas shall be properly maintained so as not to become a nuisance to adjoining properties. Any changes in structures or number or type of animals shall require immediate notification to the zoning officer.

10-5F-4: OFF STREET PARKING REGULATIONS:

Chapter 10 of this title and its provisions shall be the applicable code for off street parking in the R-7 zoning district subject to the following:
Subsection 10-10-3G2 of this title regulating the surfaces for off street parking will also permit surfacing of driveways, private roadways and walkways with concrete, crushed stone, flagstone, brick or asphalt. (Ord. 04-24-0, 5-26-2004)

10-5F-5: LOT AREA REQUIREMENTS:

   A.   Every one-family detached dwelling hereinafter erected shall be located on a lot having an area of not less than one acre (43,560 square feet) and a width at the established building line of not less than one hundred feet (100').
   B.   Minimum lot sizes for special uses shall be prescribed and conditions stipulated at the time a special use permit is authorized, but in no case shall any lot have an area of less than one acre in area. (Ord. 04-24-0, 5-26-2004)

10-5F-6: YARD AREAS:

No building shall be erected or enlarged unless the following yards are provided and maintained:
   A.   Front Yard: A front yard of not less than thirty feet (30').
   B.   Side Yards: A side yard on each side of the zoning lot of not less than fifteen feet (15').
   C.   Rear Yard: A rear yard of not less than fifty feet (50').
   D.   Corner Lots: Each side of a corner lot facing a street shall comply with the front yard setback requirement. (Ord. 04-24-0, 5-26-2004)

10-5F-7: STRUCTURE REQUIREMENTS:

   A.   Maximum Floor Area Ratio: The maximum floor area ratio shall not exceed 0.3, except that the maximum floor area ratio for single-family residences with an attached garage shall not exceed 0.35.
   B.   Height Limitation: No structure within an R-7 rural residential district shall exceed thirty five feet (35') in height, including mechanical equipment, from grade; this height limitation is not intended to, and shall not, authorize an increase in permitted height of structures specifically limited to a lesser height. 10-5F-8: ACCESSORY BUILDINGS:

The provisions of section 10-2-9, "Accessory Buildings", of this title shall apply. (Ord. 07-02-0, 1-10-2007)

10-5F-9: CONTINUANCE OF USE:

   A.   Any lawfully established use of a building or land as of January 1, 2004, that does not conform to the use regulations for the R-7 zoning, shall be deemed to be a legal nonconforming use and may be continued in accordance with chapter 3 of this title as long as the original owner on the date herein resides on the premises.
