CHAPTER 12

9 COMMERCIAL DISTRICTS

12-9A-1 Description

The CN Neighborhood Commercial District is intended to accommodate commercial and service uses oriented primarily to serving the needs of persons who live or work in nearby areas. Certain related structures and uses required to serve the needs of such areas are permitted outright or are permissible as special exceptions, subject to restrictions and requirements intended to best fulfill the intent of this title.

12-9A-2 Permitted Principal Uses

  1. Adult daycare.
  2. Children's day nursery.
  3. Community services structures and uses, such as community service centers, libraries, fire stations and cultural or recreational uses.
  4. Lodges, denominational student centers, civic or fraternal uses, excluding residential uses.
  5. Parks, playgrounds, playfields, tennis courts and miniature golf.
  6. Personal service establishments limited to the following uses:
    1. Hair salons and barbershops.
    2. Laundering and dry cleaning (self-service).
    3. Pressing, alteration and garment repair; laundry and dry cleaning pick-up services (only).
    4. Shoe repair shops.
    5. Tailoring and dressmaking shops limited to not more than 3,000 square feet of floor area.
  7. Professional services establishments limited to the following:
    1. Art studios.
    2. Craft studios.
    3. Doctor and dentist offices.
    4. Establishments for the teaching of music, dancing or other performing arts.
    5. Interior design studios.
    6. Photography.
  8. Retail establishments limited to the following uses:
    1. Antique shops.
    2. Art galleries and sales.
    3. Arts and crafts supply stores.
    4. Book stores.
    5. Cigar and cigarette stores.
    6. Drugstores limited to 5,000 square feet of floor area.
    7. Florists.
    8. Garden and supply stores.
    9. Gift, novelty and souvenir stores.
    10. Hardware stores limited to 5,000 square feet of floor area.
    11. Liquor stores.
    12. Newspaper and magazine stores.
    13. Retail food stores limited to 10,000 square feet of floor area.
    14. Retail merchandise vending machine operations (not including motor fuel).
    15. Sporting goods and bicycle stores limited to 5,000 square feet of floor area.
    16. Stationery stores.
    17. Variety stores limited to 5,000 square feet of floor area.

12-9A-3 Permitted Accessory Uses And Structures

  1. Dwelling units in connection with permitted or permissible uses or structures, located on the same premises therewith, for occupancy only by owners or employees thereof.
  2. Signs, subject to the provisions of CCC 12-13.
  3. Other structures and uses which:
    1. Are customarily accessory and clearly incidental and subordinate to permitted principal uses and structures.
    2. Are located on the same lot as the permitted principal use or structure, or on a contiguous lot in the same ownership.
    3. Do not involve operations not in keeping with the character of the area.

12-9A-4 Uses Permitted By Special Exception

The following uses may be permitted as special exceptions by the Board of Adjustment in accordance with the provisions contained in CCC 12-3A:

  1. Commercial recreational and entertainment structures and uses such as theaters and bowling alleys, provided that such uses are housed in structures and are of such a size and situation that they are not likely to be incompatible with nearby residential zoning districts; and further provided, that the Board shall specifically determine that the characteristics of such establishments will be compatible with nearby zoning districts, and that appropriate conditions and safeguards as deemed necessary may be placed upon the characteristics of the operation of such establishments.
  2. Eating and drinking establishments, including drive-in eating and drinking establishments, provided that it shall be determined that the characteristics of such establishments will be compatible with nearby uses, and that appropriate conditions and safeguards as deemed necessary may be placed upon the characteristics of the operation of such establishments.
  3. Personal and professional service establishments not permitted outright.
  4. Retail establishments not exceeding 5,000 square feet of gross floor area, which are not permitted outright, but excluding establishments dealing in salvaged merchandise, automobile service stations, or establishments selling automobiles or automotive equipment and supplies.
  5. Stores and shops which are permitted outright in CCC 12-9A-2; except, that they exceed the maximum size requirement set for in that section, if the Board of Adjustment determines that the characteristics of such establishments will be compatible with nearby zoning districts, and that the Board may place appropriate conditions and safeguards as it deems necessary upon the characteristics of the operation or construction of such establishments to ensure the compatibility of these uses.
  6. Utility substations, provided that the Board of Adjustment shall impose appropriate conditions and safeguards regarding siting or characteristics of use potentially incompatible with nearby uses.

12-9A-5 Uses Permitted By Specific Use Permit

The following uses may be permitted as specific uses by the Planning Commission and City Council in accordance with the provisions contained in CCC 12-3D:

  1. Cemeteries.
  2. Churches and other places of worship, including educational buildings related thereto.
  3. Elementary, middle and high schools, business and vocational schools not involving operations of an industrial nature.
  4. Golf courses.
  5. Mini-storage.
  6. Private clubs.

12-9A-6 Minimum Yard Requirements

The minimum yard requirements for the CN Neighborhood Commercial District are as follows:

  1. Front yard. The depth of the required front yard shall be determined in the following manner: Measured from the centerline of the abutting street, add one-half of the right-of-way designated on the Coweta major street and highway plan or 25 feet if not designated on the street and highway plan, to a setback of 35 feet on arterial streets and 25 feet on nonarterial streets. When a lot has double frontage, the front yard requirements shall be provided on both streets.
  2. Side yards.
    1. On the side of an interior lot or the interior side of a lot which abuts a residential district, a side yard less than 20 feet shall be provided.
    2. On any corner lot, the depth of the required exterior side yard shall be determined in the following manner: Measured from the centerline of the abutting street, add one-half of the right-of-way designated in the Coweta major street and highway plan, or 25 feet if not designated on the street and highway plan, to a setback distance of 35 feet on arterial streets and 20 feet for nonarterial streets.
    3. In all other cases, no side yard is required if the buildings are built to the side lot line, otherwise at least three feet of side yard width shall be provided.
  3. Rear yard. For dwellings in the CN District, the rear yard requirements shall be the same as the RM-1 Multifamily Residential District. When the CN zoned property abuts residentially zoned property, or the properties are separated only therefrom by an alley or easement, there shall be a rear yard of not less than 15 feet, and if the building is to be serviced from the rear, then there shall be a rear yard requirement of 30 feet. Unattached buildings of accessory use shall be set back five feet from the utility easement or alley line, whichever is greater.

12-9A-7 Minimum Lot Width

No minimum required except as needed to meet other requirements of this title.

12-9A-8 Minimum Lot Area; Maximum Intensity Of Use

There is no minimum lot area, but the floor area ratio for any lot must not exceed 0.35.

12-9A-9 Maximum Height Of Structures

No building shall exceed 2 1/2 stories or 35 feet in height.

12-9B-1 Description

The CG General Commercial District is intended to accommodate a variety of general commercial and nonresidential uses characterized primarily by retail, office and service establishments and oriented primarily to major traffic arteries or extensive areas of predominantly commercial usage and characteristics. Certain related structures and uses are permitted outright or are permissible as a special exception, subject to the restrictions and requirements intended to best fulfill the intent of this title.

12-9B-2 Permitted Principal Uses

  1. Included uses.
    1. Adult daycare.
    2. Automotive and allied activities.
      1. Sales.
        1. Agricultural implement.
        2. Aircraft sales.
        3. Automobile sales, new and used.
        4. Boat sales.
        5. Camper sales.
        6. Manufactured home.
        7. Motorcycle sales.
        8. Recreational vehicle (RV) sales.
        9. Truck sales.
      2. Services.
        1. Auto wash.
        2. Automobile rental.
        3. Vehicle repair and service, wheel alignment and brake (except painting).
    3. Children's day nursery.
    4. Commercial parking lots and parking garages.
    5. Community services, cultural and recreational facilities.
      1. Description. Community services, cultural and recreational facilities which are needed in residential areas to serve the residents or need a residential environment, but which are or can be objectionable to nearby residential uses.
      2. Included uses.
        1. Civic centers.
        2. Community center.
        3. Fire stations.
        4. Hospital.
        5. Libraries.
        6. Parks, playgrounds and playfields.
        7. Police Department.
        8. Public tennis courts.
        9. Recreational facility.
    6. Convenience goods and services.
      1. Description. Retail trade and service establishments which are desirable conveniences in commercial districts. Is established to permit the location of convenience goods and services in certain environments in which commercial facilities of higher use intensity would be objectionable.
      2. Included uses.
        1. Retail trade establishments:
          1. Bakery.
          2. Candy and confection and/or nut store.
          3. Dairy store.
          4. Drugstore.
          5. Florist.
          6. Food.
          7. Food specialty store, grocery.
          8. Gift, novelty, souvenir shop.
          9. Health food store.
          10. Ice cream store.
          11. Liquor store.
          12. Meat market.
          13. Newsstand.
          14. Souvenir shop.
          15. Tobacco store.
        2. Service establishments:
          1. Barbershop.
          2. Hair salon.
          3. Courier.
          4. Dry cleaning and pick up.
          5. Florist.
          6. Laundry service and pick up.
          7. Tanning salon.
    7. Drive-in restaurants.
      1. Description. Eating establishments providing curb service or offering food or drink for on-premises consumption within parked motor vehicles or permitting the on-premises consumption of food or drink within a parked motor vehicle or outside the principal structure.
      2. Use conditions. The uses included, when located within this district and located on a lot which is abutting an R district, shall be screened from the abutting R district by the erection and maintenance of a screening wall or fence along the lot line or lines in common with the R district.
    8. Eating and drinking establishments, other than drive-ins.
      1. Description. Eating places offering on-premises consumption of food and drink within the principal structure and/or providing carry out service if no curb service is provided and if no in-car on-premises consumption is permitted. Use is established in recognition of the desirability of providing dining facilities in certain environments in which commercial facilities of a higher use intensity would be objectionable.
      2. Included uses.
        1. Cafe.
        2. Cafeteria.
        3. Coffee shop.
        4. Delicatessen.
        5. Restaurant, and other similar eating establishments. An accessory use bar which is customarily incidental and subordinate to a principal use restaurant is included in this use.
      3. Use conditions.
        1. The uses included, when located within this district and located on a lot which is abutting an R district, shall be screened from the abutting R district by the erection and maintenance of a screening wall or fence along the lot lines in common with the R district.
        2. The uses shall take place within a completely enclosed building; except outdoor customer seating is permitted, whether uncovered or covered by a tent or canopy, provided:
          1. The outdoor customer seating area shall abut the building wall of the business, but extend no closer to the street than the building setback requirements;
          2. The outdoor customer seating area shall not occupy or use required parking spaces and access aisles;
          3. The outdoor customer seating area exceeding ten percent of the indoor building floor area of the principal use shall be considered floor area for purposes of determining off-street parking and loading requirements as set forth in this title; and
          4. Noise from any outdoor entertainment activity shall not be audible from any abutting R district.
    9. Hotel, motel and recreation facilities.
      1. Description. Hotels, motels and commercial amusement establishments ordinarily not requiring large sites and which have use characteristics permitting their location in or near developed commercial trade areas.
      2. Included uses.
        1. Billiard center, family.
        2. Bingo facility, commercial.
        3. Bowling alley.
        4. Country clubs and golf courses, miniature golf courses and driving ranges.
        5. Dance hall.
        6. Enclosed commercial recreation establishments, gymnasium.
        7. Health and fitness center.
        8. Hotel.*
        9. Ice skating rink.
        10. Motel.*
        11. Motion picture theater, enclosed.
        12. Racquetball club.
        13. Skating rink, enclosed.
        14. Slot car track.
        15. Swimming pool, enclosed.
        16. Tennis club.
        17. Video games.
          *An accessory use bar which is customarily incidental and subordinate to a principal use hotel or motel is included in this use unit.
    10. Offices.
      1. Description. Offices, studios, medical and dental laboratories, and certain other compatible or supporting services. The office uses included, when located on a forty-acre tract or larger, may be approved as a specific use permit. See CCC 12-3D.
      2. Included uses.
        1. Abstract company.
        2. Advertising agency.
        3. Artist studio.
        4. Bank.
        5. Broadcasting or recording studio.
        6. Bus station.
        7. Business school.
        8. Computing service.
        9. Copying service.
        10. Data processing service.
        11. Dental office, clinic, laboratory.
        12. Doctor's office.
        13. Drafting service.
        14. Employment agency.
        15. Financial institution, other than a pawnshop.
        16. Funeral home.
        17. General business offices, excluding on-premises sales of merchandise.
        18. Interior design consultant.
        19. Medical office, clinic, laboratory.
        20. Office and studio.
        21. Office building.
        22. Optician or optical laboratory.
        23. Photography studio.
        24. Prescription pharmacy, provided that no sundry or other merchandise is sold or offered for sale.
        25. Professional services, such as accountant, architect, attorney, engineer, planner or realtor.
        26. Studio or school for teaching ballet, dance, drama, fine arts, music, language, business or modeling.
        27. Therapeutic massage, licensed or certified. Certification is required from the National Certification for Therapeutic Massage Body Work or certification of completion of a program of therapeutic massage from a school licensed by the Oklahoma Board of Private Vocational Schools.
        28. Ticket office.
        29. Transportation ticket office.
        30. Travel agency.
        31. Veterinary establishments, provided that all animals are kept within suitably designed soundproof, air conditioned buildings, excluding boarding services.
    11. Passenger terminals.
    12. Shopping goods and services.
      1. Description. Retail establishments engaged in the merchandising of shopping goods and services.
      2. Included uses.
        1. Retail building material establishments, exclusive of fabrication or repair:
          1. Air conditioning and heating sales.
          2. Building materials.
          3. Electrical supply.
          4. Plumbing fixtures.
        2. Retail trade establishments:
          1. Antique shop.
          2. Appliance repair.
          3. Appliance store.
          4. Art gallery, commercial.
          5. Artist supply store.
          6. Automobile parts and accessories store.
          7. Bait shop and fishing tackle sales.
          8. Bicycle shop.
          9. Book store.
          10. Business and office machine sales.
          11. Camera and photographic supply store.
          12. Christmas tree sales (open air activities sales).
          13. Clothing and accessories store.

          18. Tune-up service (three-bay maximum).
          19. Veterinarian clinic, small animals and excluding outside animal runs.
          20. Watch and jewelry repair.

    13. Signs subject to the provisions of CCC 12-13.
    14. Uses which utilize open air activities and sales. Open air activities shall include sales from trucks, trailers, pickups and other vehicles and require an itinerant vendor license.

        3. Personal services:
          1. Auctioneer.

          1. Dry cleaning/laundry, 7,000 square feet maximum floor area.
  2. Use conditions.
    1. Change in use of an existing establishment shall effectively void any nonconforming use status and compliance with site plan review is therefore required.
    2. The uses, when located on a lot which is abutting an R district, shall be screened from the abutting R district by the erection and maintenance of a screening wall or fence along the lot line or lines in common with the R district.
    3. The permitted uses shall not interfere with or detrimentally affect any adjoining or nearby residential properties.
    4. Traffic circulation shall be reviewed and approved by the City Engineer, including the location of ingress and egress points.
    5. The subject tract of land (proposed development site) shall have either a minimum of 150 feet of frontage on a designated major arterial street or a minimum of 50 feet of frontage on a nonarterial street.

12-9B-3 Permitted Accessory Uses And Structures

  1. Signs, subject to the provisions of CCC 12-13.
  2. Structures and uses which:
    1. Are customarily accessory and clearly incidental and subordinate to permitted principal uses and structures.
    2. Are located wholly on the same lot as the permitted principal use or structure, or on a contiguous lot in the same ownership.
    3. Do not involve operations not in keeping with the character of the area.

12-9B-4 Uses Permitted By Special Exception

The following uses may be permitted as special exceptions by the Board of Adjustment in accordance with the provisions contained in CCC 12-3A:

  1. Community services, cultural and recreational facilities:
    1. Description. Community services, cultural and recreational facilities which are needed in residential areas to serve the residents or need a residential environment, but which are or can be objectionable to nearby residential uses. These uses are permitted by special exception.
    2. Included uses.
      1. Aquarium.
      2. Art gallery (not operated for profit).
      3. Assisted living center.
      4. Care home.
      5. Children's home (i.e., orphanage).
      6. College.
      7. Community group home subject to the provisions of CCC 12-5-7.
      8. Day camp.
      9. Daycare home.
      10. Elderly/retirement housing.
      11. Extended care facility.
      12. Hospital.
      13. Life care retirement center.
      14. Marina.
      15. Monastery.
      16. Novitiate.
      17. Planetarium.
      18. University.
      19. Governmental services, post office.
      20. Lodges, denominational student centers, civic or fraternal uses, excluding residential uses.
      21. Sanitarium.
      22. Temporary borrow pits for fill dirt and topsoil.
      23. Wholesaling and distribution establishments not containing over 20,000 square feet of area for storage of wares to be wholesaled or distributed.

12-9B-5 Uses Permitted By Specific Use Permit

The following uses may be permitted as specific uses by the Planning Commission and City Council in accordance with the provisions contained in CCC 12-3D:

  1. Adult detention center/correctional facility.
  2. Adult entertainment establishments:
    1. Description. Businesses which cater primarily to adults 21 years of age and above and which sell and serve alcoholic beverages (as defined by state statutes) on the premises and all sexually oriented businesses.
    2. Included uses.
      1. Bar/tavern.
      2. Beer bar.
      3. Billiard parlor/pool hall.
      4. Nightclub.
      5. Private club.
      6. Sexually oriented business.
    3. Use conditions.
      1. Bottle club, mixed beverage or beer and wine establishments and sexually oriented businesses.
      2. The uses included, when located on a lot which is abutting an R district shall be screened from the abutting R district by the erection and maintenance of a screening wall or fence along the lot line or lines in common with the R district.
      3. Bottle club, mixed beverage or beer and wine establishments, other than sexually oriented businesses, shall meet the following spacing standards; provided, however, that the spacing standards shall not apply to accessory use bars. The minimum distance from schools or churches is as follows:
        1. Public entrance doors shall be located at least 50 feet from an R district, which shall be measured in a straight line from the nearest point on a residential zoning district boundary line (not including residentially zoned expressway right-of-way) to the nearest public entrance door of the adult entertainment establishment;
        2. It shall be unlawful for any mixed beverage establishment, beer and wine establishment or bottle club which has been licensed by the ABLE Commission and which has as its main purpose the selling or serving of alcoholic beverages for consumption on the premises, or package store, to be located within 300 feet of any public or private school or church property primarily and regularly used for worship services and religious activities;
        3. The distance indicated in this subsection c3 shall be measured from the nearest property line of such public or private school or church to the nearest perimeter wall of the premises of any such mixed beverage establishment, beer and wine establishment, bottle club or package store which has been licensed to sell alcoholic beverages;
        4. The provisions of this subsection c4 shall not apply to mixed beverage establishments, beer and wine establishments, or bottle clubs, which have been licensed to sell alcoholic beverages for on-premises consumption or retail package stores prior to November 1, 2000; provided, if, at the time of application for license renewal, the licensed location has not been in actual operation for a continuous period of more than 60 days, the license shall not be renewed;
        5. The term "church," as used herein, means all contiguous property owned or leased by a church upon which is located the principal church building or structure, irrespective of any interior lot lines.
        6. The term "school, of the type which offers a compulsory education curriculum," as used herein, means all contiguous property owned or leased by a school upon which is located the principal school buildings irrespective of any interior lot lines.
  3. Airport/heliport.
  4. Bed and breakfast.
  5. Cemeteries.
  6. Commercial recreation, intensive:
    1. Description. Commercial recreation facilities, the principal activities of which are usually open air and located in undeveloped, outlying sections of the City. All uses in this category require approval of a specific use permit. See also CCC 12-3A.
    2. Included uses.
      1. Amphitheater.
      2. Amusement activities, NEC.
      3. Arena.
      4. BMX track.
      5. Drag strip.
      6. Drive-in theater.
      7. Fairground.
      8. Frisbee golf course.
      9. Go-cart track.
      10. Golf driving range.
      11. Miniature auto track.
      12. Outdoor recreation, NEC.
      13. Overnight camping for recreational vehicles.
      14. Paintball.

      2. Overnight camping for recreational vehicles requires a minimum lot area of three acres.
      3. All uses require approval of a specific use permit (see also CCC 12-3A), and are subject to the following requirements:
        1. The permitted uses shall not interfere with or detrimentally affect any adjoining or nearby residential properties.
        2. Traffic circulation shall be reviewed and approved by the City Engineer, including the location of ingress and egress points.
        3. The subject tract of land (proposed development site) shall have either a minimum of 150 feet of frontage on a designated major arterial street or a minimum of 50 feet of frontage on a nonarterial street.
  7. Community services, cultural and recreational facilities.
    1. Description. Community services, cultural and recreational facilities which are needed in residential areas to serve the residents or need a residential environment, but which are or can be objectionable to nearby residential uses. These uses are permitted by specific use permits. See also CCC 12-3D.
    2. Included uses.

  8. Marijuana retail establishments.
    1. Use conditions.
      1. The uses included when located on a lot which is abutting an R district shall be screened from the abutting R district by the erection and maintenance of a screening wall or fence along the lot line or lines in common with the R district;
      2. All parking areas and drives shall be paved with an all-weather surface as otherwise required by this title;
      3. Marijuana retail establishments shall be conducted within enclosed buildings. Buildings must be equipped with a security system. Buildings where marijuana is stored or dispensed must be equipped with ventilation/air filtration systems so that no noxious odors are detectable off the premises;
      4. Dispensing marijuana shall not be conducted in a manner that constitutes a public nuisance. A public nuisance may be deemed to exist if dispensing marijuana produces light, glare, heat, noise, noxious odor, or vibration that is detrimental to public health, safety or welfare or interferes with reasonable enjoyment of life and property;
      5. Marijuana retail establishments are specifically prohibited within 1,000 feet of any public or private school; or within 1,000 feet of another medical marijuana or marijuana retail establishment; and
      6. The distance indicated shall be measured from the nearest property line of such public or private school to the nearest perimeter wall of the premises of any such marijuana retail establishment, or within one 1,000 feet of another medical marijuana or marijuana retail establishment.
  9. Medical marijuana dispensary.
    1. Use conditions.
      1. The uses included, when located on a lot which is abutting an R district, shall be screened from the abutting R district by the erection and maintenance of a screening wall or fence along the lot line or lines in common with the R district.
      2. All parking areas and drives shall be paved with an all-weather surface as otherwise required by this Code.
      3. Medical marijuana dispensary shall be conducted within enclosed buildings; buildings must be equipped with security system; buildings where marijuana is stored or dispensed must be equipped with ventilation/air filtration systems so that no noxious odors are detectable off premises.
      4. Medical marijuana dispensary shall not be conducted in a manner that constitutes a public nuisance. 12-9B-6 Minimum Yard Requirements

The minimum yard requirements for the CG General Commercial District are as follows:

  1. Front yard. The depth of the required front yard shall be determined in the following manner: Measured from the centerline of the abutting street, add one-half of the right-of-way designated on the Coweta major street and highway plan or 25 feet if not designated on the street and highway plan, to a setback of 35 feet on arterial streets and 25 feet on nonarterial streets. When a lot has double frontage, the front yard requirements shall be provided on both streets.
  2. Side yards.
    1. On the side of an interior lot or the interior side of a corner lot which abuts a residential district, a side yard of not less than 20 feet shall be provided.
    2. On any corner lot, the depth of the required exterior side yard shall be determined in the following manner: Measured from the centerline of the abutting street, add one-half of the right-of-way designated in the Coweta major street and highway plan, or 25 feet if not designated on the street plan, to a setback distance of 35 feet on arterial streets and 20 feet for nonarterial streets.
    3. In all other cases, no side yard is required if the buildings are built to the side lot line, otherwise, at least three feet of side yard width shall be provided.
  3. Rear yard. When the property abuts residentially zoned property, or the properties are separated only therefrom by an alley or easement, there shall be a rear yard of not less than 15 feet, and if the building is to be serviced from the rear, then there shall be a rear yard requirement of 30 feet. Unattached buildings of accessory use shall be set back five feet from the utility easement or alley line, whichever is greater.

12-9C-1 Description

The CH High Intensity Commercial District is intended to accommodate those uses which, taken together, form the central business district, characterized by retail core uses, intensive office employment, and complimentary uses intended to serve persons who shop or work in the central business district. Certain related structures and uses required to serve the needs of the area are permitted outright or are permissible as special exceptions, subject to restrictions and requirements intended to best fulfill the intent of this chapter. Since the central business district of the City serves a unique and special function, it is the intent of this chapter that the CH district classification be applied to one contiguous and continuous area, and that before additional areas contiguous to those already classified CH are considered for inclusion within the CH district, consideration should be given to the appropriateness of the CG General Commercial District as an alternate designation intended to create a less congested character than that of the CH district.

12-9C-2 Permitted Principal Uses

Business schools and vocational schools not involving uses of an industrial nature which would not otherwise be permitted in this district.

Photography studios, art studios, art galleries, art sales, interior design studios, craft studios, craft sales, antique shops, establishments for the teaching of music, dancing or other performing arts.

Radio and television stations.

Retail establishments, sales and display rooms.

Service and repair establishments including automobile service stations and repair garages.

Uses which utilize open air activities and sales. Open air activities shall include sales from trucks, trailers, pickups and other vehicles and require an itinerant vendor license. (See 4-4.)

Christmas tree sales.

Fruit and vegetable sales.

Plant sales.

Other.

Utilities substations.

Veterinary establishments.

12-9D-1 Description And Purpose

  1. The DT Downtown District is defined as all properties fronting on Broadway Street from State Highway 51 to 151st Street, and Lot Ten Less the West Ten Feet, Block 52, New Coweta.
  2. The downtown district is intended primarily to provide areas for commercial development compatible with the scale, character and streetscape of the traditional downtown area of the City. Appropriate land uses include public facilities, commercial retail, primarily on the street and pedestrian level, with office and/or residential uses above or below the street level. Portions of the area may be appropriate for inclusion in a local or other cultural resource designation. The uses, structures, and project design should focus on providing an interesting pedestrian experience that has variety and vitality and that is not dependent upon direct vehicular access or immediately adjacent parking.

12-9D-9 Design Criteria

  1. Exterior requirements and restrictions.
    1. Building materials that are similar to those used traditionally shall be used. Brick, stone, and painted wood are appropriate as primary materials. New products that convey a scale, finish, and character similar to traditional materials that have a proven durability in the City climate also may be considered.
    2. A large featureless surface or panelized products that lack a sense of scale are prohibited.
    3. A plaster finish may be used when its detail expresses visual interest and conveys a sense of human scale.
    4. Coverage shall not exceed 40 percent of any exposed wall surface.
  2. Site plan review required. Site plan review is required for all development in the downtown district. The applicant shall submit a complete site plan application pursuant to CCC 12-3C.

12-9D-10 Landscaping And Aesthetics

In the downtown area (Broadway from Highway 51 to 151st Street), streetscaping is required. For every 25 feet of road frontage, one of the following items is required:

  1. One bench.
  2. Two chairs.
  3. Two potted plants.
  4. Two window boxes with plants/flowers.
