COMMERCIAL DISTRICTS

§ 159.060 REGULATIONS AND RESTRICTIONS.

   The following regulations shall apply to all Commercial Districts and shall be subject to the provisions of §§ 159.017, 159.125 through 159.129, 159.140 through 159.142 and 159.155 through 159.158.

§ 159.061 PURPOSE.

   The commercial district is established to provide areas for a wide range of retail stores and personal service establishments which are desirable to provide for both day-to day and occasional shopping needs.

§ 159.062 PERMITTED USES.

   (A)   The following retail business and service uses are permitted.
   (B)   Provided, they are operated entirely within a building, except for off-street parking and loading facilities:
      (1)   Apparel shops;
      (2)   Art and school supply stores;
      (3)   Art galleries and studios;
      (4)   Auto accessory stores;
      (5)   Bakery shops, including the baking and processing of food products when prepared for retail sales on the premises only;
      (6)   Barber shops and beauty parlors;
      (7)   Bicycle sales and repair;
      (8)   Book and stationery stores, excluding adult book stores;
      (9)   Bowling alleys;
      (10)   Camera and photographic supply shops for retail sale;
      (11)   Candy and ice cream shops;
      (12)   Carpet, rug and linoleum stores;
      (13)   Catalog offices for mail order stores;
      (14)   China and glassware stores;
      (15)   Coin and philatelic stores;
      (16)   Costume rental shops;
      (17)   Custom dressmaking, millinery, tailoring or shoe repair shops, when conducted for retail sales on the premises only;
      (18)   Department stores;
      (19)   Drugstores;
      (20)   Dry-cleaning and pressing establishments, when cleaning is not done on the premises;
      (21)   Dry goods stores;
      (22)   Electrical appliance stores and repairs, but not including appliance manufacture or assembly;
      (23)   Florist shops and conservatories for retail trade on the premises only;
      (24)   Food, meat and fruit stores;
      (25)   Frozen food stores and food lockers;
      (26)   Furniture stores and upholstery when conducted as a part of the retail operations and secondary to the main use;
      (27)   Furrier, when conducted for retail trade;
      (28)   Garden supply stores;
      (29)   Gift and card shops;
      (30)   Hardware stores;
      (31)   Hobby stores;
      (32)   Interior decorating shops, including upholstery and making of draperies, slipcovers, and other similar articles, when conducted as a part of the retail operations and secondary to the main use;
      (33)   Jewelry and watch sales and repair shops;
      (34)   Leather goods and luggage stores;
      (35)   Locksmiths;
      (36)   Meat markets;
      (37)   Millinery shops;
      (38)   Musical shops, musical instrument sales and repair, retail trade only;
      (39)   Orthopedic and medical appliance stores, but not including the assembly or manufacture of the articles;
      (40)   Package liquor stores;
      (41)   Paint and wallpaper stores;
      (42)   Pet shops and pet supplies;
      (43)   Picture framing, when conducted for retail trade on the premises only;
      (44)   Photo developing and processing; photography studios, including the development of film and pictures when done as part of the retail business on the premises;
      (45)   Public utility collection offices;
      (46)   Residential glazing service;
      (47)   Restaurants, tearooms or cafés, when the establishment is not of the drive-in type;
      (48)   Sewing machines, sales and service;
      (49)   Shoe and hat stores, and repairing when done as part of the retail business;
      (50)   Signs, as regulated by this code;
      (51)   Sporting goods stores;
      (52)   Stationery stores;
      (53)   Taxidermists;
      (54)   Theater, indoor;
      (55)   Toy stores;
      (56)   Typewriter and adding machine sales and service;
      (57)   Undertaking establishments, funeral parlors or mortuaries; and
      (58)   Variety stores.

§ 159.063 SPECIAL USES.

   The following uses may be applied by special use permit:
   (A)   Other retail business used not specifically listed in § 159.062 when found to have economic compatibility with established uses on adjoining property;
   (B)   Accessory uses, including off-street parking and loading facilities;
   (C)   Ambulance services, private;
   (D)   Amusement establishments, such as arcades, billiard parlors, commercial swimming pools, health and fitness centers, racquetball clubs, skating rinks and other similar places of recreation;
   (E)   Animal hospitals, clinics and grooming services when conducted wholly within an enclosed building;
   (F)   Automobile repair, minor, provided all activities are conducted in building areas equipped with facilities which will prevent the escape of noxious fumes or noise compatible with the normal use of other zoning lots in the vicinity;
   (G)   Automobile and motor vehicle sales;
   (H)   Automobile service stations, gas stations, automobile service stations/mini-marts;
   (I)   Automobile washing, including the use of mechanical conveyors, blowers and steam cleaning;
   (J)   Banks and financial institutions including drive-in facilities;
   (K)   Billiard and poolrooms;
   (L)   Blueprinting and duplicating establishments;
   (M)   Catering, limited to secondary uses or when found to have economic compatibility with other established uses on adjoining properties;
   (N)   Commercial and industrial glazing establishments;
   (O)   Contractors’ offices, limited to administrative and/or clerical functions;
   (P)   Contractors offices and shops, if operated as an integral part of a retail business enterprise otherwise permitted in § 159.062; provided that:
      (1)   No manufacturing, fabricating or assembly of products is performed on the premises;
      (2)   All operations, all dispatching areas and facilities for workers and equipment, and materials are within the principal enclosed building; and
      (3)   No outside parking of commercial vehicles or equipment will be allowed, except for normal deliveries and shipments during business hours;
   (Q)   Currency exchanges;
   (R)   Dental laboratories;
   (S)   Hospitals, sanitariums, rest homes and nursing homes;
   (T)   Hotels and motels, including restaurants and meeting rooms;
   (U)   Laundries, automatic, self-service types or hand;
   (V)   Loan offices and finance companies;
   (W)   Massage or similar personal service shops;
   (X)   Office, business and professional, including clinics, medical or dental;
   (Y)   Parking lots and garages, other than accessory;
   (Z)   Animal hospitals when conducted wholly within an enclosed building;
   (AA)   Plumbing, heating and air conditioning sales and services;
   (BB)   Postal substations;
   (CC)   Public utility collection offices and public services uses, including;
      (1)   Electric substations;
      (2)   Fire stations;
      (3)   Police stations;
      (4)   Public art galleries and museums;
      (5)   Public libraries;
      (6)   Telephone exchanges, repeater stations and other outdoor equipment essential to the operation of the exchange in the interest of public convenience and necessity; and
      (7)   Bus terminal or other public transportation terminal facilities.
   (DD)   Restaurant, drive-in type;
   (EE)   Retail or service business establishments in buildings 225 square feet or less;
   (FF)   Savings and loan associations;
   (GG)   Schools: music, dance, business, commercial or trade;
   (HH)   Taverns, pubs and cocktail lounges;
   (II)   Telephone answering services;
   (JJ)   Telephone booths, public;
   (KK)   Tobacco shops;
   (LL)   Travel bureau and transportation ticket offices; and
   (MM)   Other retail business or personal service shops not specifically listed in this section, when found to be economically compatible with established uses on adjoining properties.
   (NN)   The following special use may be permitted in specific situations in accordance with the procedures outlined in §§ 159.170 to 159.175, as appropriate: Adult-use cannabis dispensing organization.

§ 159.064 CONDITIONS OF USE.

   All permitted and special uses in this district shall be retail and service establishments dealing directly with consumers and shall be subject to the following conditions.
   (A)   The sale of foodstuffs or articles intended for human consumption shall be conducted wholly within an enclosed building.
   (B)   There shall be no manufacture, processing or treatment of products other than that which is clearly incidental and essential to the retail business conducted on the same premises.
   (C)   The uses, operations or products shall not be objectionable due to odor, dust, smoke, noise, vibration or other similar causes.
   (D)   Any exterior sign displayed shall pertain only to a use conducted within the building.

§ 159.065 SITE AND STRUCTURE REQUIREMENTS.

   (A)   Yards.
      (1)   Front yard. All commercial lots shall have a front yard of not less than 70 feet in depth, and no building, accessory building or structure shall be located within the front yard.
      (2)   Side yards. None, except where the use abuts upon the side of a lot in an R District, in which case, there shall be a side yard on the lot in the C-1 District, the same as specified for the adjacent R District and, In addition, shall be fenced and screened from view from any adjoining lot in the R District; except where there is no rear alley or access easement, then two feet on one side only. Where the rear lot line of a corner lot in a C-1 District is in common with or separated only by an alley from any line of a lot in a residence district, a ten-foot side yard on the street side of the C-1 lot shall be provided.
   (B)   Construction of walls.
      (1)   Exterior walls.
         (a)   Materials permitted.
            1.   All exterior walls facing or paralleling all streets, as defined in § 159.004, of any building located in a Commercial Zoning District shall be constructed of face brick, decorative or architectural stone.
            2.   All exterior walls of any building located in a Commercial Zoning District which do not face or parallel a street, as defined in § 159.004, shall be constructed of face brick, common brick, plain stone, decorative stone or architectural stone, or any combination thereof.
         (b)   Materials prohibited.
            1.   No exterior wall, facing or paralleling any street, as defined in § 159.004, of any building located in a Commercial Zoning District shall be constructed of cement blocks, concrete blocks, slag blocks, cinder blocks, stucco, common brick, synthetic brick veneer, metal or wood, or any combination thereof.
            2.   No exterior wall, which does not face nor parallel any street, as defined in § 159.004, of any building located in a Commercial Zoning District shall be constructed of cement blocks, concrete blocks, slag blocks, cinder blocks, stucco, synthetic veneer, metal or wood, or any combination thereof.
      (2)   Fire walls.
         (a)   Fire walls, as defined in the applicable provisions of the Village Fire Prevention Code and Building Code, constructed with a fire stop rating of not less than two hours shall be installed and maintained between all commercial use units constructed in buildings within Commercial Zoning Districts.
         (b)   All fire walls shall be constructed, installed and maintained to extend from the floor of the lowest commercial unit, through all ceilings, to join with and attach to the roof of the subject building.

§ 159.066 ADDITIONAL RESTRICTIONS.

   The following restrictions shall apply to this District:
   (A)   Sales of secondhand merchandise prohibited;
   (B)   All business or service or processing of aforesaid stores, shops or business shall be conducted wholly within a completely enclosed building, except for automobile parking and off-street loading and the sale of automotive fuel and/or vehicles;
   (C)   The repair or processing of goods shall be limited to those which are not objectionable by reason of odor, dust, smoke, noise, vibration, heat or glare or water-carried waste;
   (D)   All products, whether primary or incidental, shall be sold at retail on the premises where produced;
   (E)   Outside storage or material or supplies is prohibited; and
   (F)   Any lighting must be so placed as to reflect the light away from lots in residential districts.

§ 159.067 OFF-TRACK WAGERING FACILITY.

   Provided that the a parcel in the Crestwood Commercial Zoning District exceeds 250 feet in its greatest linear dimension and five acres in net acres (excluding streets) the operation of an off-track wagering facility and the taking of wagers upon athletic events and all other events as defined and permitted by Illinois for a wagering or sports book facility, together with the service of food and alcoholic beverages, conditioned upon the issuance of village licenses, shall be a permitted use, all in accordance with the Village Plan and Zoning Ordinance.
