ADMINISTRATIVE PROVISIONS
This article sets forth the duties and responsibilities of the agencies described herein.

Pursuant to the authority granted to the town council by state law or by provisions of the Town Charter, the town council shall have the following duties and responsibilities listed herein concerning these land development regulations. The town council's authority shall include, but not be limited to, approval, approval with conditions or modifications, or denial.

(a)
Designation. The town council is designated the local planning agency (LPA) for the town which is established in section 2-309. A representative of the school board of the county shall be entitled to sit as a non-voting member of the LPA when the agency considers comprehensive plan amendments and rezonings that would, if approved, increase residential density on the property that is the subject of the application. The school board representative shall not be counted when determining the presence of a quorum.
(b)
Powers and duties. The LPA shall have all the powers authorized under F.S. § 163.3174. The LPA shall have the powers and duties provided in this section, including, but not limited to, the powers to:
(1)
Hear, review, and make recommendations to the town council regarding the adoption or amendment of the comprehensive plan;
(2)
Monitor and oversee the effectiveness and status of the comprehensive plan and recommend to the town council such changes in the comprehensive plan as may from time to time be required, including preparation of the periodic reports required by F.S. § 163.3191;
(3)
Review and make recommendations to the town council in regard to proposed land development regulations and changes to the official zoning map and make recommendations to the town council as to the consistency of the regulation or changes with the comprehensive plan;
(4)
Make its special knowledge and expertise available upon reasonably written request and authorization of the town council to any official, department, board, commission and/or agency of the town, county, state or federal government;
(5)
Adopt such rules of procedure necessary for the administration of their responsibilities.

Recording secretary. The town manager or designee shall appoint a recording secretary to serve the LPA. The secretary shall keep minutes of all proceedings of the LPA, which minutes shall be a summary of all proceedings before the LPA, attested to by the secretary, and which shall include the vote of each member upon every question. The minutes shall be approved by a majority of the members of the LPA voting. In addition, the secretary shall maintain all records of LPA meetings, hearings, proceedings, and the correspondence of the LPA.
(d)
Staff. The town manager or designee shall appoint or assign such staff as may be necessary for the local planning agency to conduct its business.

The department of community development shall have the duty and responsibility to determine, interpret and enforce all sections of the land development regulations. The department shall promote, protect, and improve the health, safety, and welfare of the citizens of the town by providing an equitable, expeditious and effective method of enforcing this chapter.
