CHAPTER 11

OFF-STREET PARKING AND LOADING REQUIREMENTS

5A-11-1-1: SCOPE OF REGULATIONS:

The off-street parking and loading provisions of this Title shall apply as follows:
   (A)   For all buildings and structures erected and all uses of land established after the effective date hereof, or any amendment hereto, accessory off-street parking and loading facilities shall be provided as required by the regulations which follow. However, where a building permit for a building or structure has been issued in accordance with law prior to the effective date hereof, or any amendment hereto, and completion is accomplished within eighteen (18) months of the effective date hereof, or any amendment hereto, said building permit may be completed and off- street parking and loading facilities in the amounts required for the issuance of said building permit may be provided, all in accordance with the approved plans on the basis of which the building permit has been issued, and further, may, upon completion, be occupied under a certificate of occupancy by the use for which originally designated.
   (B)   When the existing intensity of use of any building, structure, or parcel of land constructed before or after the effective date hereof is increased by the addition of dwelling units, gross floor area, design, capacity, employees, or other units of measurement specified herein for required off-street parking or loading facilities, off-street parking and loading facilities as required herein shall be provided for such increase in intensity of use. When the intensity of use of any building, structure, or parcel of land is increased as specified above, the off-street parking and loading requirements of this Title shall be applied to the entire building, structure, or parcel of land and off-street parking and loading facilities shall be provided in accordance with the off-street parking and loading requirements of this Title.
   (C)   When the existing intensity of use of any building, structure, or parcel of land constructed before or after the effective date hereof shall be decreased through the reduction of dwelling units, gross floor area, design capacity, employees, or other units of measurement specified herein for required off- street parking or loading facilities, and further, when the decrease would result in a requirement for fewer total off-street parking or loading spaces, off-street parking and loading facilities may be reduced accordingly, provided that existing off-street parking and loading facilities shall be so decreased only when the facilities remaining will at least equal or exceed the off-street parking or loading requirements resulting from the application of the standards of this Title to the entire building, structure, or parcel of land as modified.
   (D)   Whenever the existing use of a building or structure constructed before or after the effective date hereof shall thereafter be changed to a new use, off-street parking, or loading facilities shall be provided as required for such new use. (Ord. 0-03-00, 4-3-2000)

5A-11-1-2: EXISTING PARKING AND LOADING FACILITIES:

Accessory off-street parking and loading facilities in existence on the effective date hereof, or any amendment hereto, shall not hereafter be reduced below, or if already less than, shall not be further reduced below, the requirements for a similar new building, structure, or use of land under the provisions of this Title. 5A-11-1-3: PERMISSIVE PARKING AND LOADING FACILITIES:

Nothing in this Title shall be deemed to prevent the voluntary establishment of off-street parking or loading facilities to serve any existing use of land or buildings; provided, that all regulations herein governing the location, design and operation of such facilities are adhered to.
However, once any such off-street parking or loading facilities are established, they shall be decreased only when the facilities remaining will at least equal or exceed the off-street parking or loading requirements resulting from application of the standards of this Title to the entire use of the building, structure, or parcel of land as modified. 5A-11-1-4: SUBMISSION OF PLOT PLAN:

Any application for a certificate of occupancy and building permit shall include therewith a plot plan, drawn to scale and fully dimensioned, indicating all off-street parking or loading facilities to be provided in compliance with this Title. Data shall also be provided specifying the use of the building, structure, or parcel of land, and the number of dwelling units, gross floor area, design capacity, number of employees, or other units of measurement specified herein for determining the number of off-street parking or loading spaces required by this Title. 5A-11-1-5: TIME OF CONSTRUCTION OF OFF-STREET PARKING AND LOADING FACILITIES:

Off-street parking and loading facilities, as required by this Title, shall be constructed at the time of erection, establishment, alteration, or enlargement of the building, structure, or use of land they are required to serve. No certificate of occupancy shall be issued by the Zoning Enforcement Officer until the required parking and loading facilities have been installed. (Ord. 0-03-00, 4-3-2000)

5A-11-2-1: GENERAL REQUIREMENTS:

   (A)   Location:
      1.   All Uses: All off-street parking spaces required to serve a building, structure, or use erected or established after the effective date hereof or any amendment hereto, or subsequently altered or enlarged, shall be located on the same lot as the building, structure, or use served, or, except for single-family and two-family residences, within three hundred feet (300') walking distance of such building, structure, or parcel of land if said spaces are located in the same zoning district.
      2.   Nonconforming Parking Lots: Owners of property nonconforming as to off-street parking, except for single-family and two-family residences, who elect to provide off-street parking and become conforming, may locate such parking on land other than the lot on which the building, structure, or use is located; provided, that such parking shall be located within three hundred feet (300') walking distance of said building, structure, or parcel of land. Provided, however, that the owners of such property may only provide off-street parking for a nonresidential use within a residential area after having received approval to do so by the City Council.
   (B)   Joint Parking Facilities:
      1.   Off-street parking facilities for separate uses may be provided collectively, if the total number of spaces so provided is not less than the sum of the separate requirements governing location of accessory off-street parking spaces in relation to the use served, and is located not more than three hundred feet (300') walking distance from all of the buildings, structures, and uses which such parking is intended to serve.
      2.   Further, no off-street parking space or portion thereof shall serve as a required space for more than one use unless a variance is granted pursuant to the provisions of Section 5A-2-2-3 of this Title.
      3.   In the case of joint parking facilities, parking may occur in the required yard without regard to side lot line or rear lot line at the point of combination of the parcels.
   (C)   Control Of Off-Site Or Joint Parking Facilities:
      1.   Off-Site Facilities: In cases where the required off-street parking facilities are permitted on land other than the lot on which the building, structure, or use served is located, such facilities shall be in the same possession, whether by deed or long-term lease, as the lot occupied by the building, structure, or use to which the parking facilities are accessory. A copy of the deed or lease shall be filed with the City Clerk.
   In addition, appropriate covenants shall be filed for record in the office of the county recorder as follows:
         (a)   For the lot on which the required parking is located, covenants shall be filed by the owner of said lot, providing that such lot shall provide and be maintained for the required number of off street parking spaces during the existence of the building, structure, or use for which such parking is intended.
         (b)   For the lot on which the building, structure, or use is located, covenants shall be filed by the owner of said lot, providing that the building or structure, shall be used or the use maintained only for as long as the required number of off street parking spaces are provided, in accordance with this title or any amendment hereto. Such covenants shall be reviewed by the city attorney as to content and form.
      2.   Joint Facilities: In cases where the required off street parking facilities are collectively provided and used, written covenants and easements assuring their retention, maintenance, and use for such purposes shall be executed by the parties concerned. Such covenants and easements shall be filed with the city clerk, reviewed as to content and form by the city attorney, and filed for record in the office of the county recorder.
   (D)   Access: Except on lots accommodating single-family dwellings, each off street parking space shall open directly upon an aisle or driveway of such width and design as to provide safe and efficient means of vehicular access to such parking space as provided in subsection (F) of this section. All off street parking facilities shall be designed with appropriate means of vehicular access to a street in a manner which will least interfere with traffic movement and as may be provided in the applicable zoning district regulations or other ordinances of the city. All driveways shall conform to all applicable driveway specifications adopted by the city.
   (E)   Computation: When the determination of the number of off street parking spaces required by this title results in a requirement of a fractional space, any fraction of less than one- half (1/2) may be disregarded, while a fraction of one-half (1/2) or more shall be counted as one parking space. Off street parking spaces required on an employee basis shall be based on the maximum number of employees on duty or residing, or both, on the premises at any one time. (Ord. 0-03-00, 4-3-2000)
   (F)   Design And Maintenance:
      1.   Plan: The design and construction of parking lots or areas shall be subject to the standards specified by this title, and to other such standards in this title, or other ordinances of the city, as may be adopted by the city council from time to time.
      2.   Character: Accessory off street parking spaces may be open to the sky or enclosed in a building, provided, that enclosed parking spaces shall have a vertical clearance of at least seven feet (7').
      3.   Parking Space, Stall, And Aisle Dimensions And Arrangements: The stall and aisle dimensions and arrangements of all parking areas shall meet the following criteria:
         (a)   The minimum stall width shall be nine feet (9').
         (b)   The minimum stall length shall be eighteen feet (18'), except for parallel parking which shall be twenty four feet (24') in length.
         (c)   The minimum aisle width shall be dependent on the parking angle of the parking stall and on whether aisle traffic is one- way or two-way. All two-way aisles shall be twenty four feet (24') in width. Parking shall be designed in compliance with the following table:

      4.   Surfacing And Striping: All open off street parking facilities and maneuvering areas, including parking spaces accessory to a single-family dwelling, shall be constructed with asphalt, concrete or other approved hard surface paver material in compliance with the engineering specifications as approved by city council, and as may be amended from time to time. All off street parking shall be restricted to a hard surface required by this section. Residential driveways nonconforming to the surfacing requirement as of the date of this title, may be continued until such time as the principal structure is completely reconstructed.       5.   Lighting: Any lighting used to illuminate off street parking areas shall be designed in accordance with the standards of the Illuminating Engineers Society (IES). The lighting shall be directed away from adjoining properties and public streets in such a way so as not to create a nuisance. (See section 5A-12-4-3 of this title.)
      6.   Storm Drainage: All parking lots or areas shall be designed and constructed in accordance with the city stormwater control regulations and subject to the review and recommendations of the city engineer.
      7.   Barrier Curbs Required: All parking lots shall be provided with six inch (6") barrier curbs. Wheel stops are not allowed in parking lots.
      8.   Landscape Requirements: All parking lots must be designed in compliance with chapter 10 of this title.
   (G)   Overnight Parking Restrictions: There shall be no overnight parking of semitruck, semitrailer, or any truck weighing over eight thousand (8,000) pounds on private property, or on public right of way, with the exception of truck parking areas permitted by the zoning district and construction trailers permitted by the zoning enforcement officer.
   (H)   Display Of Vehicles For Sale: Off street parking facilities shall not be used for the parking of a motor vehicle or vehicles for the purpose of displaying the same for sale unless the primary use of the property on which the parking facility is located is in the business of selling or leasing used or new motor vehicles; however, this section shall not prohibit an owner or occupant of property in areas zoned residential from displaying vehicles for sale on the property's off street parking facilities provided the vehicle is owned by the owner or occupant of the residential property. 5A-11-2-2: OFF STREET PARKING REQUIREMENTS:

Off street parking spaces shall be provided in accordance with the specific parking and loading classes as hereinafter set forth in the off street parking and loading table, found in section 5A-11-5 of this chapter. The zoning enforcement officer or designee shall determine the parking and loading class of a use which, though not contained by name in a parking and loading class, is deemed to be similar in nature and clearly compatible with the listed uses. Parking spaces for accessory uses not specifically enumerated within a parking and loading class shall be assumed to be included in the principal (permitted or special) use requirement. 5A-11-2-3: ACCESSIBLE PARKING REQUIREMENTS:

Accessible parking spaces shall be provided in compliance with the Illinois accessibility code 1 . The standards described below are consistent with the Illinois accessibility code. For all requirements regarding accessible (handicapped) parking spaces, the above referenced code supersedes and adds to the standards established by this title.
   (A)   Size: Each accessible parking stall shall consist of parking spaces measuring eight feet (8') in width and an adjacent access aisle, measuring eight feet (8') in width, diagonally striped with a high quality yellow paint recommended by the paint manufacturer for pavement striping. The standard length of an accessible parking stall shall be the same as all other parking stalls.
   (B)   Number: All parking lots required by this title shall provide the following number of accessible parking stalls:

   (C)   Access: The required access aisle must have a smooth transition with adjacent walk surfaces, either by joining at a common level of use or a curb ramp.
   (D)   Identification: Each accessible parking space shall be equipped with a sign which complies with section 11-301 of the Illinois rules of the road. Signs shall be vertically mounted on a post or a wall, at front center of the parking space, no more than five feet (5') horizontally from the front of the parking space, and set four feet (4') from finished grade of the parking space to the bottom of the sign. 5A-11-3: DRIVEWAY REQUIREMENTS:

   (A)   Driveways And Access Points In Residence Districts:
      1.   Pavement Width: The pavement width shall not exceed twenty four feet (24') within a public street right of way, except that the driveway may include a flair at the street not to exceed a radius of three feet (3'). Within the front or corner side yard, the pavement width shall not exceed a total width of thirty five feet (35'), except for circular driveways permitted by this section. A ribbon along both sides of a driveway, not to exceed eighteen inches (18") on a side, consisting of paver brick, decorative stone or similar material, shall be permitted, so long as the setback requirements are met.
      2.   Multiple Curb Cuts For Circular Drives On Interior Lots: Two (2) curb cuts forming one circular drive shall be allowed on interior residential lots that contain a minimum of one hundred feet (100') of street frontage. The width of circular drives on private property shall not exceed thirteen feet (13') in pavement width, except for any pavement that provides direct access into an attached garage.
      3.   Multiple Curb Cuts On Corner Lots: On corner lots, two (2) curb cuts shall be allowed on lots with a minimum of one hundred feet (100') of street frontage along both the front and corner side lot lines. The curb cuts may either be unconnected with one curb on each street frontage or may be connected to form one circular drive pavement. No curb cut may be closer than fifty feet (50') from any intersecting street right of way line (40 feet on cul-de-sacs and dead end streets). A third curb cut shall be allowed on the secondary street frontage of a corner lot, only if it is set back a minimum of one hundred fifty feet (150') from the intersecting street right of way lines.
      4.   Minimum Distance From Property Line: The minimum distance of any driveway used for a single-family attached or detached dwelling shall be five feet (5') from any property line and cannot be located in a platted easement. For other uses (permitted or requiring special use approval) in the residential districts, the separation between the property line and the driveway shall be a minimum of twenty feet (20'). Residential driveways nonconforming to the setback requirements as of the date of this title may be continued until such time as the principal structure is completely reconstructed, subject to a site inspection by city staff to assess site drainage conditions prior to the issuance of a permit. Joint driveways may occur in the required yard without regard to the side lot line or rear lot line at the point of combination of the parcels. (Ord. 0-38-08, 10-6-2008)
   (B)   Driveways And Access Points In Business, Office And Industrial Districts:
      1.   Location Of Access Points: Points of vehicular ingress and egress from the site shall be limited to the adjacent major and/or secondary thoroughfares only and site plans shall be reviewed by the zoning enforcement officer for location and design of curb cuts and driveways. Such design and location shall at least comply with the following standards, unless otherwise recommended by the city engineer, for proper and safe ingress and egress from the site:
         (a)   Maximum Number Of Driveways: Driveways for each piece of property shall be limited to one in the first one hundred fifty front feet (150') of street frontage and one per additional one hundred front feet (100') of street frontage.
         (b)   Minimum Width: The minimum width of driveways at the property line shall be as follows: driveways designed for one-way traffic shall be at least twelve feet (12') and no greater than fifteen feet (15') wide; driveways designed for two-way traffic shall be at least twenty four feet (24') and no greater than thirty feet (30') wide. Any minimum width not in compliance with these regulations shall require the approval of the City Engineer.
         (c)   Minimum Distance From Property Line: The minimum distance of any driveway from any property line shall be regulated within the off-street parking facilities setback in each zoning district, with the exception of joint parking facilities.
         (d)   Minimum Distance Between Driveways:
            (1)   Business Districts: The minimum distance between driveways shall be fifty feet (50') measured from the two (2) closest driveway curb cuts.
            (2)   Office And Industrial Districts: The minimum distance between driveways on a site or lot shall be two hundred feet (200') measured from the two (2) closest driveway curb cuts.
         (e)   Minimum Distance From A Street Intersection:
            (1)   Business Districts: The minimum distance of a driveway from a street intersection shall be fifty feet (50') measured from the corner of the intersection of the street right of way to the nearest end of the curb cut.
            (2)   Office And Industrial Districts: The minimum distance of a driveway into the site from a street intersection shall be one hundred feet (100') measured from the point of intersection of the curb lines of the street rights of way to the nearest end of the driveway curb cuts.
         (f)   Minimum Distance From Crosswalk: The distance from the end of the driveway curb cut to the nearest crosswalk shall not be less than ten feet (10').
         (g)   Maximum Curb Radii: All driveways shall have curb radii not less than fifteen feet (15') nor more than necessary to accommodate the largest vehicle which must maneuver on-site as shown by the appropriate truck turning template.
         (h)   Angle Between Curb Line And Center Of Driveway: The angle between the curb line of the street and the center line of the driveway shall not be less than sixty degrees (60°).
         (i)   Medians: Where a driveway is permitted into a street having a barrier median, a break shall not be made in that median unless competent engineering judgment indicates that left turn bays can be constructed and signalized if necessary, and further, that no hazard or impediment is created for through traffic.
         (j)   Common Driveways:
            (1)   Business Districts: Business establishments adjacent to, adjoining, or integrated in a shopping center, or cluster commercial facilities, shall use common driveways with other business establishments in that center. However, driveways from adjoining properties shall not be cross-connected if the result is to effectively increase the number of driveways available to the properties if their frontage were not summed.
            (2)   Office And Industrial Districts: Office-industrial establishments adjacent to, or integrated in an industrial park or similar cluster facilities, shall use a common access with other office-industrial establishments in that park or cluster facility. (Ord. 0-03-00, 4-3-2000)

5A-11-4-1: GENERAL REQUIREMENTS:

   (A)   Location: All required off-street loading facilities shall be located on the same lot as the use served except where central loading facilities are provided, in accordance with the provisions of subsection (B) of this Section.
   (B)   Central Loading: Central loading facilities may be substituted for off-street loading berths on the individual lots, provided the following conditions are fulfilled:
      1.   Each lot served shall have direct access to the central loading area without crossing streets.
      2.   The total number of off-street loading berths provided shall meet the minimum requirements herein specified, based on the sum of the several types of uses served. Area of types of uses may be totaled before computing number of loading berths.
      3.   No lot served shall be more than five hundred feet (500') removed from the central loading area.
      4.   Written covenants and easements assuring the retention, maintenance, and use of the loading facilities for such purposes shall be executed by the parties concerned. Such covenants and easements shall be filed with the City Clerk, reviewed as to content and form by the City Attorney, and filed for record in the office of the County Recorder.
   (C)   Yard Requirements For Off-Street Loading Facilities:
      1.   Off-street loading facilities which are located in a building or structure, shall comply with the yard requirements of the zoning district in which located.
      2.   Unenclosed off-street loading facilities shall comply with the following yard requirements:
         (a)   Loading facilities shall not be located in any front yard or corner side yard.
         (b)   Loading facilities shall be permitted in the interior side yard or rear yard, provided they shall not be located within twenty feet (20') of any property line, except in the case of central loading facilities in which case the area of a required interior side yard may be occupied by off-street loading facilities.
         (c)   Whenever an off-street loading facility abuts or adjoins a lot in a residence district, the off-street loading facility shall not be nearer than thirty feet (30') from such property line.
   (D)   Size: Unless otherwise specified, a required off-street loading berth shall be at least twelve feet in width by at least thirty feet in length (12' x 30'), exclusive of aisle and maneuvering space, and shall have a vertical clearance of at least fourteen feet (14').
   (E)   Access: Each required off-street loading berth shall be designed with appropriate means of vehicular access to a street in a manner which will least interfere with traffic movements as may be provided in the applicable zoning district regulations or other ordinances of the City.
   (F)   Computation: When determination of the number of off-street loading berths required by this Title results in a requirement of a fractional berth, any fraction of less than one-half (1/2) may be disregarded while a fraction of one-half (1/2) or more, shall be counted as one loading berth.
   (G)   Screening And Landscaping: Off-street loading facilities adjoining a right of way or residential property shall be screened with fences, hedges or walls of at least seventy five percent (75%) opacity all year long along such property lines. Lighting of the facilities shall be directed away from surrounding property and public streets in such a way so as not to create a nuisance.
   (H)   Surfacing: All open off-street loading berths shall be improved with a compacted macadam base, not less than seven inches (7") thick, surfaced with not less than two inches (2") of asphaltic concrete or some comparable all-weather dustless material.
   (I)   Utilization: Space allocated to any off-street loading use shall not, while so allocated, be used to satisfy the space requirements for any off-street parking facilities or portions thereof.
   (J)   Minimum Facilities: Uses for which off-street loading facilities are required herein, but which are located in buildings of less floor area than the minimum prescribed for such required facilities, shall be provided with adequate receiving facilities, accessible by motor vehicle off any adjacent service drive on the same lot. 5A-11-4-2: OFF-STREET LOADING REQUIREMENTS:

Off-street loading berths shall be provided in accordance with the specific parking and loading classes as hereinafter set forth in the off-street parking and loading table found in Section 5A-11-5 of this Chapter.
