CHAPTER 6

ZONING DISTRICTS

5A-6-1: DISTRICTS ESTABLISHED:

For the purposes of this Title, the City is hereby divided and classified into the following zoning districts:
   (A)   Residence Districts:
      R-1 Single-Family Residence District
      R-2 Single-Family Residence District
      R-3 Multi-Family Residence District
   (B)   Business Districts:
      B-1 Neighborhood Convenience Shopping District
      B-2 Community Shopping Center District
      B-3 General Business District
      M-U Mixed-Use District
   (C)   Office And Industrial Districts:
      O Office District
      OR&I Office, Research and Light Industrial District
      I-1 General Industrial District

5A-6-2: MAPS:

   (A)   Such land and the district classification thereof shall be as shown on the map designated as the "City of Darien Zoning District Map", dated and signed by the Clerk of the City upon adoption. This Zoning District Map and all notations, dimensions, references, and symbols shown thereon pertaining to such districts shall be as much a part of this Title as if fully described herein and shall be filed as part of this Title by the Clerk of the City. The Zoning Enforcement Officer shall, no later than March 31 of each year, publish a Zoning District Map clearly showing the existing zoning uses, dimensions, restrictions, regulations, and classifications of the City for the preceding calendar year. Provided, however, that if in any calendar year there are no changes in zoning uses, dimensions, restrictions, regulations and classifications, no map shall be published for such calendar year. An updated copy of the Zoning District Map showing all amendments thereto shall be kept at all times on file with the City Clerk. Said Map shall be available for public inspection in the office of the City Clerk and any later alterations of this Map adopted by amendment as provided in this Title shall be similarly dated, filed, and made available for public reference.
   (B)   The following rules shall apply with respect to the boundaries of the various districts as shown on the Zoning District Map:
      1.   District boundary lines are the center lines of highways, streets, alleys, easements, railroad rights of way, toll roads, expressways, and rivers; or section, division of section, tract and lot lines; or such lines extended, unless otherwise indicated.
      2.   Boundaries indicated as approximately following the center lines of highways, streets, alleys, easements, toll roads, or expressways shall be construed to follow such center lines.
      3.   Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.
      4.   Boundaries indicated as approximately following City limits shall be construed as following City limits.
      5.   Boundaries indicated as following railroad lines shall be construed to be the established center line of the right of way or if no center line is established, the boundary shall be interpreted to be midway between the right-of-way lines.
      6.   Boundaries indicated as approximately following the center lines of streams, rivers, canals, lakes, or other bodies of water shall be construed to follow such center lines, and in the event of change in the center line, shall be construed as moving with the center line. The center line shall be interpreted as being midway between the shorelines.
      7.   Boundaries indicated as parallel to or extensions of features indicated in subsections (B)1 through (B)6 of this Section shall be so construed.
      8.   Whenever any street, alley, or other public way is vacated by official action of the City Council, or whenever such area is franchised for building purposes, the zoning district line adjoining each side of such street, alley, or other public way and all areas so involved shall then and henceforth be subject to all regulations of the extended districts.
      9.   Boundaries indicated as dividing a lot or tract shall be construed as being located as shown on the Zoning District Map.
      10.   Distances not specifically indicated on the Zoning District Map shall be determined by the scale of the Map. (Ord. 0-03-00, 4-3-2000)

5A-6-3: ZONING OF ANNEXED LAND:

Whenever any territory is hereafter annexed to the City, in any manner whatsoever, such territory, upon annexation, shall be classified or zoned under this Title as an R-1 District, except as may be provided for by a preannexation agreement or an annexation agreement accompanying a zoning recommendation, all as provided for by law.
