LEGAL PROVISIONS
(a)
Penalty. Any person who shall violate or fail to comply with any of the provisions of this Code shall, upon conviction, be fined an amount not exceeding $500.00. Each day's violation shall constitute a separate offense and shall be punishable under the terms of this Code. Nothing herein shall prevent the city from taking such other lawful action as is necessary to prevent or remedy any violation.
(b)
Validity. In the event any section, subsection, paragraph, sentence, clause, or phrase of this Code shall be declared or adjudged invalid or unconstitutional by a court of competent jurisdiction, such judgment shall in no manner affect the validity of the remainder of the Code.
(c)
Repeal of conflict. All zoning codes or conflicting development regulations in effect at the time of the effective date of this Code herewith be and the same are hereby repealed.
(d)
Effective date. This Code shall be effective immediately upon its adoption.
(e)
Codification. This Code shall be made a part of the Deerfield Beach City Code and the provisions herein may be renumbered for such purpose.

When a change in zoning district or land use designation boundaries, land use regulations, a comprehensive plan amendment, or an amendment to the zoning and land development code is being considered by the city commission, no development order, site plan approval, permit, or license of any kind shall be issued, and no change of occupancy shall occur if such development order, site plan approval, permit, license, or occupancy would result in the nonconforming or unlawful use of the subject property should the proposed change be adopted.
(b)
Effective date: The restriction of such issuance, approval or change of occupancy shall begin on the earlier of:
(1)
The date of notification to affected property owners of the proposed change; or
(2)
The date of the first publication of notice of a public hearing of the proposed change; or
(3)
The date of the first action by the City Commission of the City of Deerfield Beach to initiate the proposed change, which may include direction given to staff to prepare a study, ordinance or resolution for commission consideration.
