ARTICLE VII

PARKING AND LOADING STANDARDS

Sec. 52-181.- General.

Off-street parking and loading space shall be provided in accordance with the regulations of this section for all nonagricultural uses whenever:

(1)

A building is constructed or a new use is established.

(2)

The use of an existing building is changed to a use requiring more parking facilities.

(3)

An existing building or use is altered or enlarged so as to increase the amount of parking space required.

Sec. 52-182. - Design requirements for parking facilities.

(a)

Parking facilities shall be paved with a hard all-weather surface which may include concrete or bituminous material, or any other stable material where the applicant shows to the satisfaction of the Township board of supervisors that such material will significantly support vehicles anticipated to use such parking facilities.

(b)

Parking lots shall be designed with the minimum required parking space and driveway dimensions as shown on attachment 1 of this chapter; however, parking spaces located parallel to a curbline shall have a width of eight feet and a length of 23 feet.

(c)

Appropriate bumper guards or curbing shall be provided as required by the Township board of supervisors in order to clearly define parking spaces or limits of paved areas and to prevent vehicles from projecting into required yards or rights-of-way. No motor vehicles parked within an off-street parking facility shall be permitted to extend into a street right-of-way.

(d)

Parking lots shall be graded to a minimum slope of one percent to provide for drainage. Adequately sized inlets and storm sewers shall be provided to discharge stormwater in accordance with a plan to be approved by the Township board of supervisors.

(e)

All parking lots shall be adequately marked and maintained for the purpose of defining parking spaces and driveways. As a minimum, the lines of all parking spaces and driveways (including directional arrows, etc.) shall be in a color typically suitable for such markings and shall be at least four inches in width. Painted lines, arrows and dividers shall be provided and maintained to control parking and to direct vehicular circulation. In the event parking lots are not marked as required by this section, the Township may at its option, perform or hire the said marking to be done and recover the same from the owner or tenant of said lot in the manner permitted by law.

(f)

Handicapped parking spaces shall conform with the latest regulations issued under the authority of the Americans with Disabilities Act.

(g)

All parking spaces shall be on the same lot as the principal building except when permitted elsewhere by the Township board of supervisors. Common parking facilities for more than one residential lot may also be permitted by the Township board of supervisors provided use of the parking spaces is guaranteed for all lots, the number of driveways entering from the development to the street is reduced, and the amount of landscaping area in the required front yard is increased.

(h)

The Township board of supervisors may authorize a reduction in the number and size of off-street parking spaces in cases where the applicant can justify the reduction and still provide adequate parking facilities.

(i)

The developer shall be responsible for the construction of any necessary traffic control devices or additional acceleration lanes required by a traffic impact study approved by the Township board of supervisors or by the state department of transportation in the case of egress to major thoroughfares.

(j)

Parking lots shall be designed so that each vehicle may proceed to and from the parking space provided for it without requiring the moving of any other vehicle. All commercial and industrial use driveways shall be designed and constructed as to permit vehicles to pull out rather than back out onto any street. All other driveways that enter onto an arterial, major collector or minor collector street shall be designed and constructed to provide adequate turnaround area to permit vehicles to pull out rather than back out onto the street. All dead-end parking lots shall be designed to provide sufficient back-up area for all end parking spaces.

(k)

Except for driveways serving agricultural or residential uses, all driveways connecting to a public street shall be located at least 100 feet from the intersection of any street lines and shall be designed in a manner conducive to safe ingress and egress.

(l)

All driveways connecting to a public street from an agricultural or residential use shall be located outside of any clear sight triangle established for a street intersection.

(m)

Where possible, driveways shall be located on minor rather than major streets.

(n)

All driveways shall be located, designed and constructed as approved by the Township board of supervisors. Not more than two driveways shall be provided to any single lot or business establishment unless the frontage exceeds 300 feet. Driveways shall be located as to provide minimum safe stopping distance requirements as described in PennDOT Publication 282 Highway Occupancy Permit Handbook. Driveways within a lot containing a single-family dwelling unit shall have a minimum width of ten feet and shall be located no closer than three feet from any side or rear lot line unless the driveway is part of a common parking facility. All other nonresidential driveways shall be at least 12 feet wide for each lane of traffic and shall be located no closer than ten feet from any side or rear lot line. (o)

Where provided, bus parking shall be designed to safely permit the discharge and collection of occupants of the bus at the use within the lot. Where additional safety protection for pedestrian and vehicular traffic can be achieved, bus parking shall be separated from other parking areas within the lot.

(p)

A greenbelt shall be provided between a parking lot and all lot lines. The greenbelt shall be planted in grass, shrubbery, trees or other types of plant material, but in no case shall these areas be paved or covered with an impervious or semi-pervious surface, except as needed to provide vehicular and pedestrian access to the lot. The minimum width of the greenbelt shall be as follows:

(q)

Unless provided by this or other chapters of this Code of Ordinances of East Donegal Township, all parking lots and facilities shall be illuminated during hours of operation and maintain a minimum of 0.75 footcandles at any point. In no case, shall parking lot lighting exceed 0.5 footcandles beyond a residential property line. The Township reserves the right to monitor lighting operations and require additional blocking of lighting.

Sec. 52-183. - Residential parking requirements.

(a)

All dwelling units, other than townhouse dwelling units, shall be required to have two off-street parking spaces per unit.

(b)

All townhouse and multifamily dwelling units shall be required to have 2½ off-street parking spaces per unit.

(c)

Space within a private garage or within a garage incorporated within a dwelling shall not be considered a parking space.

Sec. 52-184. - Institutional parking requirements.

(a)

Churches shall be required to have one space for each four seats provided.

(b)

Schools shall be required to have one space for each two teachers, employees or administrators and in high schools, one space for each ten students.

(c)

Child day care centers shall be required to have one space for each six students enrolled.

(d)

Hospitals shall be required to have one space for each 1.5 beds, and one space for each doctor and other hospital support staff.

(e)

Nursing or retirement care facilities shall be required to have one space for each five beds in the facility, plus one space for each two employees; except, where individual units are provided in the form of individual dwelling units, one space per dwelling unit is required.

(f)

Other institutional facilities shall be required to have one space for each 200 square feet of gross floor area, or in the event the principal use is conducted outside of a building, one space for each 200 square feet of lot area used for the principal use.

Sec. 52-185. - Commercial parking requirements.

Commercial facilities shall be required to have one off-street parking space per each full-time employee in the largest working shift. Additional spaces shall be determined by the following uses:

(1)

Retail stores: one space for each 400 square feet of gross floor area. Vehicle spaces in front of fuel pumps are not to be considered as satisfying required parking spaces.

(2)

Personal service shops: one space for each 400 square feet of gross floor area.

(3)

Professional offices: one space for each 400 square feet of gross floor area.

(4)

Medical: three spaces for each doctor maintaining an office.

(5)

Restaurant: one space for each 200 square feet of gross floor area.

(6)

Automobile service station: one space for each 300 square feet of gross floor area. Vehicle spaces in front of fuel pumps are not to be considered as satisfying required parking spaces.

(7)

Bowling alley: four spaces for each alley.

(8)

Golf course: one space for each ¼ tee.

(9)

Driving range: one space for each tee.

(10)

Motel: one space for each rental unit.

(11)

Outdoor amusement: one space for each three persons attending the outdoor amusement at any given time, based upon the number of persons estimated or expected by the producer to attend or upon the number of advance ticket sales made tip to and, including ten days prior to the scheduled date for such amusement, whichever is greater.

(12)

Fraternal organizations: one space for each two seats provided in the largest single room used for the assembly of the membership of the organization.

(13)

Other commercial: one space for each 200 square feet of gross floor area, or in the event the principal use is conducted outside of a building, one space for each 200 square feet of lot area used for the principal use.

Sec. 52-186. - Industrial parking requirements.

Adequate off-street parking spaces for all full-time employees shall be provided on the employer's property. Additional spaces shall be determined by the following: Visitor parking: one space for each 600 square feet of company office gross floor area or four spaces minimum.

Sec. 52-187. - Design requirements for loading and unloading space.

(a)

Adequate off-street loading and unloading space shall be provided on the same lot with every building or part thereof hereafter erected or occupied for any use which involves the receipt or distribution of materials or merchandise by motor vehicle. This space shall be so placed and arranged as not to interfere with free movement of vehicles and pedestrians over a public street.

(b)

Driveways providing access to loading and unloading spaces shall be a minimum of 24 feet wide for two-way traffic and a minimum of 15 feet wide for one-way traffic. Where additional safety protection for pedestrian and vehicular traffic can be achieved, driveways to loading and unloading spaces shall be separated from other internal traffic within a lot.

(c)

Loading and unloading spaces shall be designed so that each vehicle may proceed to and from the space provided for it without requiring the moving of any other vehicle. All driveways shall be so designed and constructed as to permit vehicles to pull-out rather than back-out onto a street. All dead-end loading and unloading spaces shall be designed to provide sufficient back-up and turnaround area for all vehicles intended to utilize such spaces.

(d)

Loading and unloading spaces and all related driveways and vehicular maneuvering areas shall be paved with a hard all-weather surface which may include concrete or bituminous material, or other material complying with the street pavement specifications adopted by the Township board of supervisors.

(e)

All loading and unloading facilities shall be adequately marked and maintained for the purpose of defining all loading and unloading spaces and driveways. As a minimum, the lines of all spaces and interior drives (including directional arrows, etc.) shall be in a color typically suitable for such markings and shall be at least four inches in width. Painted lines, arrows and dividers shall be provided and maintained to control truck parking and to direct vehicular circulation.

(f)

A minimum 20-foot-wide greenbelt shall be provided between all lot lines and all loading and unloading spaces, driveways and vehicular maneuvering areas within the lot. The greenbelt shall be planted in grass, shrubbery, trees or other types of plant material, but in no case shall these areas be paved or covered with an impervious or semi-pervious surface, except as needed to provide vehicular and pedestrian access to the lot.

(g)

No loading or unloading spaces shall be permitted between the building and an adjoining street right-of-way.
