CHAPTER 1141

Enforcement

1141.01 ENFORCEMENT.

   (a)   It shall be the duty of the Zoning Inspector, who shall be appointed by the Mayor, to enforce the provisions of this Zoning Ordinance, in the manner and form and with the powers provided by this Zoning Ordinance.
   (b)   All departments, officials and employees of the Village of Edgerton, Ohio, which are vested with the duty of authority to issue permits or licenses shall conform to the provisions of this Zoning Ordinance and shall issue no permit or license for any use, building or purpose if the same would be in conflict with the provisions of this Zoning Ordinance. Any permit or license, issued in conflict with the provisions of this Zoning Ordinance, shall be null and void.

1141.02 SCHEDULE OF FEES, CHARGES, AND EXPENSES.

   Council shall by ordinance establish a schedule of fees, charges, and expenses and a collection procedure for zoning permits, amendments, appeals, variances, conditional use permits, plan approvals, and other matters pertaining to the administration and enforcement of this Zoning Ordinance requiring investigations, inspections, legal advertising, postage, and other expenses. The schedule of fees shall be posted in the office of the Zoning Inspector, and may be altered or amended only by Council. Until all applicable fees, charges, and expenses have been paid in full, no action shall be taken on any application or appeal.

1141.99 PENALTY.

   (a)   Any person, whether as principal, agent, owner, lessee, tenant, contractor, builder, architect, engineer or otherwise who violates any provision of this Zoning Ordinance shall be guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than five dollars ($5.00) nor more than one hundred dollars ($100.00) for each offense. Each day of the existence of any violation of this Zoning Ordinance shall be a separate offense.
   (b)   The erection, construction, enlargement, conversion, moving or maintenance of any building or structure and the use of any land or building which is continued, operated or maintained contrary to any provision of this Zoning Ordinance is hereby declared to be a nuisance and in violation of this Zoning Ordinance and unlawful. The Zoning Inspector may institute a suit for injunction or other appropriate action to restrain any person or governmental unit from violating any provision of this Zoning Ordinance and to cause such violation to be prevented, abated or removed. Such action may also be instituted by any property owner who may be especially damaged by the violation of any provision of this Zoning Ordinance.
   (c)   The remedies provided for in this section shall be cumulative and not exclusive and shall be in addition to any other remedies provided by law.
