CHAPTER 11

MOBILE HOME AND RECREATIONAL VEHICLE PARKS

4-11-1: PURPOSE; GENERAL PROVISIONS:

   (A)   Purpose: The purposes of this Chapter are to promote the health, safety and general welfare of the citizens of the County by providing minimum standards to prevent overcrowding of land, to avoid congestion, stabilize and protect the residential character of mobile home parks and surrounding areas, encourage development providing open spaces and planned site designs, insure protection of the natural landscape and character of the area, to eliminate incompatible uses to facilitate the adequate provision of water supply, sewage disposal and sanitation for all mobile home and/or recreational vehicle parks.
   (B)   Conflicting Regulations: Wherever any provision of this Chapter imposes more stringent regulations, requirements or limitations than are required by the provisions of any other law or ordinance, the provisions of this Chapter shall govern.
   (C)   Severability: If any Section, clause or provision of this Chapter be declared by the courts to be invalid, such invalidity shall not affect other provisions of this Chapter as a whole or any part thereof other than the part so declared invalid, and to this extent the provisions of this Chapter are declared to be severable.
   (D)   Private Agreements: It is not the intent of the provisions of this Chapter to abrogate or annul any easement, deed restrictions or other agreement between individuals; provided, however, that wherever the provisions of this Chapter impose a greater restriction upon the use of land and buildings within mobile home parks and/or recreational vehicle parks, the provisions of this Chapter shall govern.
   (E)   Vested Rights: This Chapter and any of the provisions herein established are not intended and shall not be construed to establish any vested right in or on behalf of any person in respect to the continuation, construction or expansion of any mobile home park and/or recreational vehicle park or any activity occurring in connection therewith, which does not comply with this Chapter.
   (F)   Jurisdiction: The jurisdiction of this Chapter shall include all lands and waters within the limits of Elko County excluding incorporated towns, cities or Indian Reservation lands. (Ord. 1972-B, 2-9-72)
   (G)   Enforcement: Responsibility for enforcement shall be the duty of the Department of Engineering Services or their authorized representatives. (Ord. 1976-N, 8-5-76)

4-11-2: CODES ADOPTED CONCURRENTLY:

The following codes or portions thereof are hereby adopted by reference and made a part of this Chapter:
Uniform Plumbing Code
Uniform Building Code, Dangerous Building and One and Two Family Dwelling Code and Referenced Codes
Uniform Sign Code
National Electrical Code
being the editions currently in effect in Elko County. (Ord. 1976-D, 4-8-76)

4-11-3: DEFINITIONS:

As used in this Chapter, words used in the present tense include the future tense; words in the singular include the plural and vice versa. The word "shall" is mandatory and the word "may" is permissive; the word "persons" includes an agency, association, firm, partnership or corporation as well as an individual, and terms not herein defined shall have the meanings customarily assigned thereto.
BUILDING OFFICIAL: An official authorized by Elko County, Nevada, to enforce the provisions of this Chapter.
BUILDINGS: Any structure having a roof and used or built for the shelter or enclosure of persons, animals, chattels or property of any kind, including, but not limited to carports, ramadas, awnings, but not including recreational vehicles.
   (A)   Principal Building: A building including a mobile home or group of buildings within which is conducted the principal use of the lot on which the building is located.
   (B)   Accessory Buildings: A subordinate building on the same lot with a principal building or use, the use of which is customarily incidental to the main building or use. When attached to the principal building, the accessory building shall be required to maintain the same yard setbacks as those of the principal building.
   (C)   Central Accessory Building: A structure housing toilet, lavatory and such other facilities as required or permitted by this Chapter.
CABANA: Any portable, demountable or permanent cabin, room, enclosure, or other building erected, constructed or placed on any mobile home lot or on any recreational vehicle space within six feet (6') of any recreational vehicle. (Ord. 1972-B, 2-9-72)
CARPORT: An accessory building having two (2) or more open sides, used by occupants of a mobile home park or recreational vehicle park. (Ord. 1976-N, 8-5-76)
LOT: A parcel of land separated from other parcels by description for purposes of lease, sale or separate use.
MOBILE HOME: A transportable, single-family dwelling unit suitable for year-round occupancy and containing similar plumbing, waste disposal and electrical conveniences as immobile housing.
   (A)   Dependent Mobile Home: A mobile home without toilet and/or bathing facilities.
   (B)   Independent Mobile Home: A mobile home having toilet and bathing facilities built in as a permanent part of the structure.
MOBILE HOME LOT: A portion of land within a mobile home park or mobile subdivision used or intended to be used for parking of one mobile home, including the land covered by the mobile home, required yards and parking area, and attached or detached accessory buildings and structures and open space.
MOBILE HOME PARK: An area, parcel or tract of land having as its principal use the rental, leasing or occupancy of space by two (2) or more mobile homes on a permanent or semi-permanent basis, including any accessory buildings, structures or uses customarily incidental thereto.
MOBILE HOME SPACE: A portion of land within a mobile home park designed for the parking of one mobile home including accessory buildings, parking areas, yards and open space.
PARKING SPACE: A fully accessible space for the parking of permitted vehicles; each space shall be a minimum of nine feet by twenty feet (9' x 20') containing an area of not less than one hundred eighty (180) square feet exclusive of driveways or aisles.
PLANNED SITE DESIGN: Method or design approach which shall be used in the development of mobile home parks and recreational vehicle parks.
RAMADA: Any roof, or shade structure, installed, erected or used above a mobile home, recreational vehicle, lot, space or portion thereof.
RECREATIONAL VEHICLE: Includes but is not limited to any of the following:
   (A)   Camping Trailer: A folding structure usually made of canvas, mounted on wheels and designed for travel, recreation and vacation use.
   (B)   Motor Home: A portable temporary dwelling to be used for travel, recreation and vacation, constructed as an integral part of a self-propelled vehicle.
   (C)   Pickup Coach: A structure designed to be mounted on a truck chassis for use as a temporary dwelling for travel, recreation and vacation.
   (D)   Travel Trailer: A vehicular, portable structure built on a chassis, designed to be used as a temporary dwelling for travel, recreation and vacation uses.
RECREATIONAL VEHICLE PARK: A parcel or tract of land having as its principal use the transient rental of two (2) or more spaces for recreational vehicles including accessory buildings, structures or uses.
RECREATIONAL VEHICLE PARKING SPACE: The area within a recreational vehicle park utilized for vehicle parking, having a minimum width of ten feet (10') and a minimum length of twenty feet (20'), containing square feet exclusive of driveways or aisles.
RECREATIONAL VEHICLE SPACE: A lot or parcel of land within a recreational vehicle park containing a net minimum land area of one thousand two hundred (1,200) square feet for the transient parking of one recreational vehicle for the exclusive use of its occupants for transient dwelling purposes, including permitted accessory uses and structures.
SANITARY STATION: A facility used for removing and disposing of wastes from recreational vehicle holding tanks.
SETBACK: The minimum horizontal distance between a lot line and the nearest point of a building, structure or use including the distance between buildings, mobile homes, recreational vehicles and related uses.
SWIMMING POOL: Any constructed pool used for swimming, bathing or wading, whether below ground or above, regardless of depth or surface area.
TEMPORARY PARKING OF MOBILE HOME: Any specified length of time less than three (3) months.
TRANSIENT DWELLING PURPOSES: The continual rental or parking of a recreational vehicle space or spaces for the same vehicle to persons for a period not to exceed twenty eight (28) days. (Ord. 1972-B, 2-9-72)
UNFIT FOR HUMAN HABITATION OR OCCUPANCY: Any mobile home, vehicle park, structure or building and any facility which is dangerous or detrimental to human life or health through either lack of maintenance or repair generally or because of unsafe or improper construction, installation or inadequate sewerage facilities or as defined in the Uniform Building Code IV (Dangerous Building) latest addition. (Ord. 1976-N, 8-5-76)

4-11-4: PERMITS:

   (A)   It shall be unlawful for any person to do any conversion, erection, alteration, installation, addition, moving or construction within an existing or new mobile home park and/or recreational vehicle park unless a mobile home and/or recreational vehicle parks construction permit has been obtained in addition to all other required construction permits.
   (B)   All required permits shall have been obtained prior to construction. The County Building Official shall inspect all facilities and the installation and/or construction thereon of any items required for the compliance with the approved plans.
   (C)   If approved, permits shall be issued for a mobile home park and/or recreational vehicle park by the Building Official, which shall be in writing and shall be displayed by the permittee on the premises for which it is applicable.
   (D)   The mobile home park and/or recreational vehicle permits shall be issued for an indefinite period; provided, however, that work shall commence within ninety (90) days of issuance of the permit and shall not be interrupted for any period of time in excess of six (6) months. Violation of either of the above shall render the permit null and void.
   (E)   No permit shall be issued for an existing or new mobile home park and/or recreational vehicle park whereby four (4) or more mobile homes and/or recreational vehicle spaces are to be constructed, unless the Planning Commission shall find from the application and other facts and documents that the applicant is able to conform to the regulations as set forth in this Chapter.    (F)   Applications for permits shall be made to the Building Official.
Permits for existing or new mobile home and/or recreational vehicle parks whereby three (3) or less new mobile home and/or recreational vehicle spaces are to be constructed may be approved by the Building Official provided, however, that the new spaces comply with the mobile home and/or recreational vehicle park standards of the State of Nevada. (Ord. 1976-N, 8-5-76)
   (G)   Each application and the required accompanying data and information which provide for four (4) or more mobile home and/or recreational vehicle spaces shall be reviewed by the Planning Commission which shall make such findings as are consistent with this Chapter and the best interests of the general welfare of the public. Applications for mobile home parks and/or recreational vehicle parks shall be accompanied by development plans designed in accordance with the purpose and intent of the following development plan. 4-11-5: DEVELOPMENT PLANS:

   (A)   A site development plan of the proposed mobile home park or recreational vehicle park shall be prepared which includes the minimum following descriptive data:
      1.   Complete legal description: Name of the park, location by section, township and range, reference to dimension and bearing to a section corner or quarter-section corner.
      2.   Name, address and phone number of land planner, engineer, surveyor or other persons preparing the plan and the owner and applicant.
      3.   Scale, north point and date of preparation.
      4.   A small scale location map showing the relationship of the mobile home park or subdivision to the surrounding neighborhood including public streets, railroads and community facilities.
      5.   Topography by contours of the site, adequate to show the character and drainage of the land. (minimum five feet [5'] contours.)
      6.   Two (2) photographs in color taken of the proposed site in a north/south direction and east/west direction.
      7.   The location, widths and names of all public streets within or adjacent to the park or subdivisions.
      8.   Dimensions of all boundary lines of the subdivision or park; gross and net acreage of the site and net acreage of all open spaces and recreational areas.
      9.   Street system layout including locations and width.
      10.   Dimensions of all lots, parcels, spaces and total number of mobile home lots or spaces. Each lot or space shall be designated as an independent or dependent mobile home lot or space.
      11.   Sewage disposal method.
      12.   Water supply method.
      13.   Existing and proposed electrical distribution lines, including outlets for spaces.
      14.   Locations, dimensions and designations of all accessory buildings and structures including swimming pools and recreation facilities.
      15.   Sketch showing location and size of any proposed business identification sign including all advertising copy proposed on the face of such signs.
      16.   Existing conditions of the site, including buildings, structures, wells, streams and such additional conditions as necessary or required.
      17.   A letter approving proposed method of water supply and sewage disposal systems from the Health Department, State of Nevada.
      18.   Existing use or uses of adjoining lands.
      19.   Trash and garbage locations, method of screening and disposal method.
   (B)   Requirements:
      1.   Two (2) sets of plans and specifications together with complete mechanical, structural and improvement plans of work to be performed, drawn to scale; such plans shall show all roadways, walks, lots, spaces, complete sewer, water and electrical details, buildings, structures, including building elevations and plans, trash disposal locations and details of enclosure or screening method, landscape details, and fire hydrant locations and details.
      2.   All off-site improvements including streets shall be constructed in accordance with the County of Elko Subdivision Ordinance and/or as required by the Planning Commission.
   (C)   Fees shall be:
      1.   Site Plan Check Fee: Twenty five dollars ($25.00) per mobile home park and/or recreational vehicle park wherein four (4) or more spaces are to be constructed plus two dollars ($2.00) per each lot or space shown therein. Ten dollars ($10.00) in those cases whereby three or less spaces are to be constructed plus two dollars ($2.00) per each lot or space.
      2.   Fees for electrical, plumbing, building and sign permits as required by Elko County.

4-11-6: MOBILE HOME PARK STANDARDS:

   (A)   Intent: The following standards are intended to encourage development from a site plan design approach to protect the natural environment and character of the County of Elko, to provide open spaces and densities comparable to low-density, multi-family areas, utilizing the cluster type designs, permitting certain accessory and complementary uses and structures which assure protection of the environment.
   (B)   Uses Permitted:
      1.   One mobile home per lot or site as a principal use.
      2.   One carport, cabana, ramada or patio and one detached storage room per mobile home.
      3.   Community recreation buildings and facilities, laundry, car wash, or boat storage facilities serving the mobile home park or subdivision only.
      4.   Management offices and/or one single-family dwelling, or mobile home used exclusively for living quarters by the operator or manager of the park.
   (C)   Development Standards:
      1.   Maximum building height: Two (2) stories or thirty feet (30').
      2.   Minimum net site or lot area per mobile home: Two thousand five hundred (2,500) square feet.
      3.   Minimum net mobile home site width: Forty feet (40').
      4.   Minimum setback of any building or mobile home from a bordering public street line: Five feet (5').
      5.   Minimum setback of any building or mobile home from a zoning district boundary: Five feet (5').
      6.   Minimum setback line from the exterior boundary line of the mobile home park or subdivision: Five feet (5').
      7.   All utilities shall be placed underground.
      8.   The mobile home and all accessory buildings shall occupy not more than fifty percent (50%) of the total area of the lot or space.
   (D)   Placement of Mobile Home on the Space or Lot:
      1.   Minimum front setback from internal street: Five feet (5').
      2.   Minimum distance between mobile homes; two (2) opposing sides or between a side and an opposing end or between a mobile home and a detached accessory building: Fifteen feet (15').
      3.   Between two (2) opposing ends of a mobile home: Ten feet (10').
      4.   Minimum side yards on side of mobile home having no doors: Five feet (5')
      5.   Expandable sections of a mobile home or attached accessory buildings shall be considered a part of the mobile home proper for setback requirements.
   (E)   General Mobile Home Park Requirements:
      1.   All vehicle parking spaces and driveways shall be surfaced in an approved manner.
      2.   Exposed ground surfaces in all other parts of a mobile home park shall be covered with stone screening or other approved organic material or protected with a vegetative growth that is capable of preventing soil erosion and eliminating objectionable dust.
      3.   Density Requirements: Maximum density shall not exceed eight (8) mobile homes, lots or spaces per gross acre of area.
      4.   All mobile home parks containing five (5) or more mobile home lots shall have at least one recreation area or open space accessible from all lots or spaces. The cumulative size of such recreation area or open space shall not be less than ten percent (10%) of the gross mobile home park area and shall be landscaped in an approved manner as per the approved plans.
      5.   Storage on a public right of way shall be prohibited for mobile homes.
      6.   Pedestrian ways shall have a minimum width of eight feet (8') and shall be surfaced with an approved material.
      7.   The individual address or numbering system for mobile homes shall be subject to the approval of the Building Official.
   (F)   Mobile Home Park Street System:
      1.   All mobile home spaces shall be provided with safe and convenient vehicular access from public or private streets. Alignment width and gradient of all streets shall be properly adapted to topography and subject to the approval of the Building Official.
      2.   Street Surfacing: All streets shall be surfaced in an approved manner and shall be drained in an approved manner.
      3.   Access to mobile home parks shall be designed to minimize congestion and traffic hazards and shall provide for safe movement of traffic at their entrances or exits to adjoining streets.
      4.   All streets and driveways shall have approved surface material section not less than twenty four feet (24') in width and a right of way of not less than thirty feet (30').
      5.   All streets and driveways shall be lighted at night with at least the equivalent of a fifty (50) watt lamp for each one hundred (100) lineal feet of street.
      6.   Alleys except where justified and approved shall not be permitted.
   (G)   Vehicle Parking Requirements:
      1.   Each mobile home, lot or space shall have a designated minimum of two (2) off-street parking spaces, not less than nine feet (9') wide by twenty feet (20') in length, containing a net area of one hundred eighty (180) square feet.
      2.   Each mobile home park shall provide sufficient parking and maneuvering space so that the parking, loading or maneuvering of vehicles incidental to parking shall not necessitate the use of any public street, sidewalk or right of way or any private grounds not a part of the mobile home park. 4-11-7: RECREATIONAL VEHICLE PARK STANDARDS:

   (A)   Intent: The following standards are intended to encourage development providing sufficient open space and complementary uses under conditions which assure protection of the character of the district in which the parka are located. The recreational vehicle parks shall not be exposed to adverse influences and no portion subject to flooding, subsidence or erosion. A site development plan design approach shall be the method encouraged in planning recreational vehicle parks.
   (B)   Uses Permitted:
      1.   One recreational vehicle and/or two (2) vehicles per vehicle space as the principal use.
      2.   Accessory uses, such as:
         a.   One detached carport, one detached cabana, ramada or patio and one detached storage room per recreational vehicle space.
         b.   Community recreation buildings and facilities, laundry, car and truck wash, boat or storage facilities serving the recreational park only.
         c.   Management offices and/or one single-family dwelling, or one mobile home used exclusively for living quarters by the operator of the park.
   (C)   Development Standards:
      1.   Maximum building height: Two (2) stories or thirty feet (30'), whichever is greater.
      2.   Minimum net site area per recreational vehicle space: One thousand two hundred (1,200) square feet.
      3.   Minimum setback of any building or recreational vehicle from any public street line: Twenty feet (20').
      4.   All utilities shall be placed underground.
   (D)   Placement of Recreational Vehicle on Individual Space:
      1.   Minimum setback from private access street: Ten feet (10').
      2.   Minimum distance between recreational vehicles: Between fronts with two-way access street, forty feet (40'); between fronts with one-way access street, thirty two feet (32').
      3.   Between two (2) opposing sides or between a side and an opposing end, or between a recreational vehicle and a central accessory building, twenty feet (20').
      4.   Between two (2) opposing ends of recreational vehicles: Ten feet (10').
      5.   Expandable sections of recreational vehicles shall be considered apart of the recreational vehicle proper. (Ord. 1972 B, 2-9-72)
   (E)   General Requirements:
      1.   Soil and ground cover requirements for vehicle parking space: Exposed ground surfaces in all parts of every recreational vehicle parking space shall be paved or surfaced in an approved manner. Each vehicle parking space shall have a minimum width of ten feet (10').
      2.   Exposed ground surfaces in all other parts of the recreational vehicle park: Shall be covered with stone screenings, or other approved organic material or protected with a vegetative growth that is capable of preventing soil erosion and eliminating objectionable dust.
      3.   Density requirements: The density shall not exceed fifteen (15) recreational vehicle spaces per gross acre of park site.
      4.   Recreational area or open space: In all recreational vehicle parks containing five (5) or more recreational vehicle sites, there shall be required one recreation area or open space accessible from all recreational vehicle spaces. The size of such recreation area or open space shall not be less than ten percent (10%) of the gross park area and shall be landscaped in an approved manner.
      5.   Pedestrian accessways shall have a minimum width of eight feet (8') and shall be surfaced with an approved material.
   (F)   Street System:
      1.   All vehicle spaces shall be provided with safe and convenient vehicular access from public or private streets to each vehicle parking space. Alignment width and gradient shall be properly adapted to topography and subject to approval of the Planning Commission.
      2.   Surfacing: All streets and individual vehicle parking space shall be spaces surfaced in an approved manner and shall be well drained.
      3.   Access: Access to recreational vehicle parks shall be designed to minimize congestion and traffic hazards at their entrance or exit and allow safe movement of traffic on adjacent streets. All traffic ingress or egress from such parks shall be through controlled entrances and exits.
      4.   Internal Streets, Off-Street Parking and Maneuvering:
         a.   Twenty feet (20') minimum paved width for internal streets.
         b.   Noncontinuous streets in excess of four hundred feet (400') shall be prohibited and all noncontinuous streets shall provide a sufficient turnaround area to facilitate by forward motion a complete turnaround.
         c.   Off-street Parking and Maneuvering Area: each recreational vehicle park shall provide sufficient parking and maneuvering space so that the parking shall not necessitate the use of any public street, sidewalk or right of way or any private grounds not part of the recreational vehicle park. 4-11-8: WATER SUPPLY SEWAGE DISPOSAL AND ELECTRICAL SYSTEM:

4-11-9: ACCESSORY BUILDINGS AND SERVICE FACILITIES:

   (A)   Central Accessory Building: A central accessory building containing the necessary toilet and plumbing fixtures shall be provided in all recreational vehicle parks and shall be provided in mobile home parks when required by the Planning Commission. Such buildings or structures shall be conveniently located.
   (B)   Central accessory buildings housing toilet facilities shall conform to Elko County Building Codes.

4-11-10: REFUSE DISPOSAL:

   (A)   Refuse and Garbage Handling: Provisions shall be made so that the storage, collection and disposal of refuse in the parks may be conducted so as to create no health hazards or air pollution.
   (B)   Refuse collection areas shall be screened from view by fencing or landscaping in an approved manner.

4-11-11: FUEL SUPPLY AND STORAGE:

   (A)   Installation of liquified petroleum gas or fuel oil containers on any space or lot within a park shall be subject to the following:
      1.   Containers shall be securely, but not permanently, fastened to prevent overturning.
      2.   Containers shall not contain a gross capacity of more than one hundred fifty (150) U.S. gallons unless a greater capacity is approved by the Building Official. (Ord. 1976-N, 8-5-76)

4-11-12: FIRE PROTECTION STANDARDS:

All recreational vehicle parks and mobile home parks shall be subject to rules and regulations of the Nevada Fire Protection Authority and all applicable laws. In every mobile home park and recreational vehicle park, or portion thereof, shall be installed and maintained fire hydrants and fire extinguishers of the number and type, size and location as may be required by the local fire department having jurisdiction. Extinguishers may be installed in lieu of faucets and hose upon approval of the local fire department. (Ord. 1972-B, 2-9-72)

4-11-13: GENERAL REGULATIONS:

   (A)   Signs:
      1.   All accessory buildings for public use shall have each room and building clearly signed as to its particular use.
      2.   Restrooms shall be clearly signed and illuminated.
      3.   Signs identifying buildings and rooms shall not exceed two (2) square feet in area and name the use only.
      4.   One business identification sign advertising the recreational vehicle park, mobile home park and located on the premises, subject to:
         a.   The total aggregate area shall not exceed one hundred (100) square feet for both faces of such sign and shall be displayed not more than twenty five feet (25') above ground.
         b.   An identification sign shall not be animated or flashing but may be illuminated.
         c.   Sign construction permit shall be obtained from the Building Official prior to construction of this sign.
   (B)   Occupancy and Use Certificates: No recreational vehicle park or mobile home park shall be used for occupancy until a final inspection and written approval is obtained from the Health Department and a certificate of use occupancy has been obtained from the Building Official.
   (C)   Compliance and Non-Conforming Uses:
      1.   Any existing mobile home park and/or recreational vehicle park, which is abandoned or discontinued for a period of six (6) months or more shall comply with all requirements of applicable laws and this Ordinance if approval is granted to re-establish the use.
      2.   All new mobile home parks and/or recreational vehicle parks shall conform to all requirements herein.
   (D)   Swimming Pools: Outdoor swimming pools shall comply with the following standards:
      1.   Setbacks: Swimming pools shall not be located in any required front yard, in any utility easement, or less than five feet (5') to any lot line or building except that public swimming pools shall not be located closer than fifteen feet (15') to any lot line.
      2.   Mechanical Equipment: All heaters, pumps, filters, or other mechanical equipment shall be located not less than five feet (5') to any lot line.
      3.   Public Safety: Swimming pools shall be adequately protected to discourage unauthorized access. (Ord. 1976-N, 8-5-76)

4-11-14: VARIANCE OR EXCEPTION PROVISIONS AND REQUIREMENTS:

   (A)   A variance or exception of any requirements of this Chapter may be granted by the Planning Commission. Applications for an exception or variance shall be filed with Elko County and accompanied by the following:
      1.   A filing fee of twenty five dollars ($25.00) for each variance or exception requested.
      2.   A detailed plot plan drawn to scale showing necessary information and details for a determination by the Planning Commission.
      3.   Completed application form.
   (B)   A variance shall not be granted unless the Planning Commission shall find sufficient evidence that:
      1.   There are special circumstances or conditions applying to the land in question and not common to other lands in that area.
      2.   Granting of the variance will not be materially detrimental to the public welfare or to the property in the general area.
      3.   Granting of the variance is necessary for the preservation and enjoyment of substantial property rights.
      4.   Granting of the variance is necessary to facilitate a desirable cluster design approach allowing flexibility in accordance with the intent of this Chapter for the development of mobile home parks or subdivisions.

4-11-15: VIOLATION AND PENALTIES:

   (A)   Violations: Any structure upon which construction is started or any structure which is altered, enlarged or repaired, or the use of land which is begun and changed after enactment of this Chapter regulating recreational vehicle parks and/or mobile home parks, and which is in violation of any of its provisions is hereby declared a public nuisance. Any person who violates or fails to comply with the provisions of this Chapter, the owner of any structure or land or part thereof, and any contractor, builder or agent employed in connection therewith who has assisted knowingly in the commission of any such violation, shall be guilty of a separate offense and upon conviction thereof shall be liable to the penalties provided herein.
   (B)   Penalties: Any violation of this Chapter shall be punishable by a fine not to exceed five hundred dollars ($500.00) or by imprisonment in the County jail for a period not to exceed six (6) months, or by both such fine and imprisonment, in the discretion of the court. Each day that a violation is wilfully permitted to exist shall be constituted a separate offense. The imposition of any sentence shall not exempt the offender from compliance with the requirements of this Chapter. (Ord. 1972-B, 2-9-72)
