The Town Council hereby establishes a Plan Commission to consist of seven members. The Ellettsville Plan Commission shall consist of membership as specified in I.C. 36-7-4-207(b), as amended.
Members of the Ellettsville Plan Commission shall be appointed for terms of office, as specified in I.C. 36-7-4-217 and I.C. 36-7-4-218, as amended. Terms are by the calendar year. If a member resigns or leaves the Commission an appointment will be made by the President of the Town Council to fill the unexpired term.
If a Commission member no longer holds a government position a replacement to the Plan Commission will be appointed by the Town Council.

At the first regular meeting of the year the Plan Commission shall elect a President, Vice President and Secretary. A regular meeting time will be determined. Monthly meetings will be held pending the filing of new zoning petitions. Special meetings may be called to be held by the President of the Commission with public notice posted at least 48 hours in advance. All meetings are open to the public with the exception of executive sessions held to discuss litigation or personnel. Commissioners may be paid for each meeting attended as determined yearly by the Town Council. A member excusing themselves due to a conflict of interest from any part of a meeting shall not be paid for the meeting. All documents relative to any hearing must be delivered to Town Hall at least 24 hours prior to the meeting.

The Ellettsville Plan Commission members serve the citizens of the community and shall have the community’s interest in mind when hearing zoning cases which relate to the zoning ordinance and the regulatory powers of Indiana state land use and zoning law.

Except in the preparation and adoption of the Comprehensive Plan a member may not participate in a zoning hearing where the member has a direct or indirect financial interest. A Commission member may not represent another petitioner before the Commission.

§ 152.316 CONDUCT OF HEARINGS.
The first order of business is a staff review, followed by a presentation by the petitioner, then by opponents to the case, then discussion by the Commission and finally a formal vote on the petition. Cases should produce written findings of fact and written reasons for a decision to be made. Any rejected petition must not be reheard for a six-month period. At the new hearing new information, and a new or substantially new request must be offered. Subdivision plats must be approved if all of the subdivision requirements are met. The President may set reasonable time limits on speakers who wish to address the Commission.
