ADMINISTRATION AND
ENFORCEMENT
§ 152.350 APPLICABILITY.
Except where noted, the various provisions of this chapter are applicable throughout this chapter.

§ 152.351 GOVERNMENT AGENCY EXEMPTION.
(A) Any work to be completed by a government agency on a street right-of-way within the territorial jurisdiction of the town which is owned by that government agency shall be exempt from any requirement to secure a town building permit prior to beginning the work.
(B) This exemption shall not waive any other requirements for compliance with the rules and regulations contained in this chapter.

§ 152.352 PLAN COMMISSION JURISDICTION.
The geographic area over which the Plan Commission shall have jurisdiction is the territorial jurisdiction of the town.

§ 152.353 DIRECTOR OF PLANNING SERVICES; DUTIES.
The designated Director of Planning Services of the town is hereby vested with the duty to administer and enforce the regulations under this chapter.

§ 152.354 ZONING AND COMPREHENSIVE PLANNING MAPS.
(A) The map entitled “Town of Ellettsville Corporate Boundary and Zoning Districts Map” is hereby determined to be the official zoning districts map for this chapter.
(B) The map entitled “Comprehensive Plan Map” is hereby determined to be the official comprehensive plan map for this chapter.
(C) Both maps are incorporated herein by reference.

§ 152.355 MAINTAINING COMMON NUISANCE.
Any structure erected, raised, or converted, or land or premises used, in violation of this chapter or an ordinance or regulation made under this chapter, is a common nuisance and the owner or possessor of the structure, land, or premises is liable for maintaining a common nuisance.

§ 152.356 SUBDIVISION OF LAND PERMITTED.
Subdivision of land is permitted, and subdivision plans and plats shall be required for all subdivisions of land except exempt subdivisions of land, in all zoning districts within the planning and zoning jurisdiction of the town provided the newly created parcels have access directly to a public street or road.

§ 152.357 REFERENCE TO OTHER STATUTES AND REGULATIONS.
Any legal citation or reference to another statute, ordinance or regulation shall be meant to include all amendments thereto or replacement thereof.

§ 152.358 CONFLICT WITH OTHER STATUTES.
Where the requirements under this chapter are in conflict with the requirements of any other statute or law that is in effect within the town’s territorial jurisdiction, the more restrictive requirement shall prevail.

§ 152.359 SEPARABILITY.
The several provisions of this chapter are separable as follows: If any court of competent jurisdiction shall adjudge any provisions of this chapter to be invalid, the judgment shall not affect any other provisions of this chapter not specifically included in the judgment.

§ 152.360 VIOLATIONS AND FINES.
Any person, firm, or corporation violating any of the provisions of this chapter shall be fined $25 for each offense. Separate offenses shall be deemed committed on each day during or on which a violation occurs or continues. Any person(s), company, business or non-profit organization that violates any of the provisions of this section commits a Class E ordinance violation.

§ 152.361 AMENDMENT AND REPLACEMENT.
The Plan Commission shall give notice and hold a public hearing on proposed amendments to or replacement of this chapter pursuant to I.C. 36-7-4-602(a) and (b).

§ 152.362 PERMITS AND CODE VIOLATIONS.
No permit shall be issued for any parcel of land on which there is an outstanding Town of Ellettsville code violation. Permits may only be issued when all violations have been abated.
