ARTICLE I

GENERAL PROVISIONS

§ 14-100 Short Title.

This Ordinance shall be known and may be cited as the "Fairfield Borough Zoning Ordinance."

§ 14-101 Authority.

A. 
Statutory Authority: § 14-601 of the Pennsylvania Municipalities Planning Code (Act of 1968, P.L. 805, No. 247, as reenacted and amended)[1] provides that the Fairfield Borough Council may enact and amend a Zoning Ordinance to implement community development objectives established by the Borough Council. The Southwest Adams Joint Comprehensive Plan has been adopted by Borough Council and establishes specific policies and community development objectives that the Borough Council seeks to implement through the adoption of the Fairfield Borough Zoning Ordinance.

B. 
Applicability: This Ordinance requires that, within Fairfield Borough, in the County of Adams and the Commonwealth of Pennsylvania, no land, body of water, or structure shall hereafter be used or occupied, and no structure or part thereof shall hereafter be erected, constructed, reconstructed, moved, or structurally altered unless in conformity with all the regulations and procedures herein specified for the Zoning District in which such land, body of water, or structure is located.

§ 14-102 Community Development Objectives.

In accordance with the Southwest Adams Joint Comprehensive Plan as revised and adopted by the Fairfield Borough Council on April 25, 2015, there is hereby established a Zoning Ordinance for the Borough, which is set forth in the text and map that constitute this Ordinance. The Zoning Ordinance is adopted in the interest of protecting and promoting the public health, safety, morals, and general welfare, and shall be deemed to include the following objectives, among others, as may be stated in the Southwest Adams Joint Comprehensive Plan.
A. 
Direct new development to support and enhance the existing character of the Borough and the districts within which new uses are located.
B. 
Preserve and promote a balanced variety of residential, recreational, commercial, industrial, institutional, agricultural, and conservation land uses in the Borough.
C. 
Ensure that adjacent land uses are compatible with regard to noise, traffic, odor, activity, and appearance.
D. 
Guide existing vacant land resources to achieve a desired pattern of land development relative to the community infrastructure and natural features carrying capacity.
E. 
Safeguard the tax base, promote economic development, and provide for local employment through appropriate utilization of existing and potential nonresidential lands.
F. 
Promote the conservation of existing land uses, rural traits, and natural amenities which presently characterize the Borough.
G. 
Maintain the quality of land development and the local environment with reasonable controls.
H. 
Ensure that land development and other construction does not conflict with adjacent municipalities and other developments not under the jurisdiction of the Borough.
I. 
Assimilate private development and redevelopment within reasonable time periods in relation to the phasing of public improvements.
J. 
Provide thorough land use controls, design standards, and guidelines which would encourage mutually compatible and supportive development.

§ 14-103 Principal Use.

Unless specifically provided by this Ordinance, the provisions of this Ordinance shall be interpreted to allow only one (1) principal use on a lot.
