ARTICLE IV

LOW DENSITY RESIDENTIAL LR DISTRICT

§ 14-400 Statement of Legislative Intent.

In expansion of the Community Development Objectives contained in Article I of this Ordinance, it is hereby declared to be the intent of the LR District to:
A. 
Establish reasonable standards to provide for future residential development in the Borough.
B. 
Preserve the quiet and uncongested neighborhoods that currently exist in Fairfield's single-family residential areas.
C. 
Exclude incompatible commercial, industrial, and high density residential uses from locating in lower density residential neighborhoods.
D. 
Provide for single-family detached residential neighborhoods within walking distance of amenities such as schools, churches, and shopping opportunities in the mixed-use area of the historic core of Fairfield.
E. 
Encourage the use of innovative residential design techniques, such as cluster development or village development, which may result in the retention of open spaces resources and/or the development of Borough extensions that exhibit village character.
F. 
Encourage residential development at a density sufficient to allow for the efficient provision of public water and sewer service.

§ 14-401 Use Regulations.

A. 
Permitted Uses: The following uses are permitted in the LR District.
1. 
Churches.
2. 
Emergency Services.
3. 
Municipal Uses.
4. 
No-Impact Home-Based Businesses, in accordance with § 14-1201.W.
5. 
Private Parks.
6. 
Private Schools.
7. 
Public Parks.
8. 
Public Schools.
9. 
Single-Family Detached Dwellings.
10. 
Small Wireless Facility—Tower-Based—Inside Public Right-of-Way, in accordance with § 14-1201.DD.
B. 
Accessory Uses: The following uses are permitted as accessory uses to any permitted principal use in the LR District:
1. 
Car Port.
2. 
Child Care Facility (accessory to nonresidential use) in accordance with § 14-1201.G.
3. 
Family Child Care, in accordance with § 14-1201.L.
4. 
Gazebo.
5. 
Group Child Care, in accordance with § 14-1201.G.
6. 
Pet House.
7. 
Private Garage.
8. 
Private Swimming Pool, in accordance with § 14-1101.H.
9. 
Small Wireless Facility—Co-Location—Inside Public Right-of-Way, in accordance with § 14-1201.CC.
10. 
Utility/Storage Building.
11. 
Wireless Communication Facility—Co-Location—Outside Public Right-of-Way, in accordance with § 14-1201.KK.
C. 
Special Exception Uses: The following uses are permitted by Special Exception in the LR District in accordance with the following standards and criteria, as well as any reasonable conditions that the Zoning Hearing Board may deem necessary, including conditions to protect the historic and architectural integrity of Fairfield Borough as described in the National Register of Historic Places Continuation Sheet — Fairfield Historic District, as published by the United States Department of the Interior, and in accordance with the procedures set forth in § 14-1607.

Cluster Development, in accordance with § 14-1201.H.
2. 
Village Development, in accordance with § 14-1201.II.
3. 
Uses Not Expressly Permitted Elsewhere in this Ordinance, in accordance with § 14-1201.GG.
D. 
Conditional Uses: The following uses are permitted by Conditional Use in the LR District in accordance with the following standards and criteria, as well as any reasonable conditions that the Borough Council may deem necessary, including conditions to protect the historic and architectural integrity of Fairfield Borough as described in the National Register of Historic Places Continuation Sheet — Fairfield Historic District, as published by the United States Department of the Interior, and in accordance with the procedures set forth in § 14-1608.

Home Occupations, in accordance with § 14-1201.O.

§ 14-402 Dimensional Requirements.

A. 
Maximum Residential Density.
1. 
Cluster Development: Three (3) dwelling units per acre.
2. 
Village Development: Five (5) dwelling units per acre.
3. 
All Other Residential Development: Two (2) dwelling units per acre.
B. 
Minimum Lot Area.
1. 
Single-Family Detached lot created after the effective date of this Ordinance and not part of a Cluster Development or a Village Development: Forty Thousand (40,000) square feet.
2. 
Single-Family Detached Lot existing prior to the effective date of this Ordinance: Seven Thousand Five Hundred (7,500) square feet.
3. 
Single-Family Detached Lot in a Cluster Development: Seven Thousand Five Hundred (7,500) square feet.
4. 
Single-Family Detached Lot in a Village Development: Seven Thousand Five Hundred (7,500) square feet.
5. 
Single-Family Semi-Detached Lot in Village Development: Four Thousand Five Hundred (4,500) square feet.
6. 
Townhouse Lot in a Village Development: Two Thousand Five Hundred (2,500) square feet.
7. 
All Other Uses: Twenty Thousand (20,000) square feet.
C. 
Minimum Lot Width.
1. 
Single-Family Detached Lot created after the effective date of this Ordinance: One Hundred Fifty (150) feet.
2. 
Single-Family Detached Lot existing prior to the effective date of this Ordinance and not part of a Cluster Development or a Village Development: Sixty (60) feet.
3. 
Single-Family Detached Lot in a Cluster Development: Sixty (60) feet.
4. 
Single-Family Detached Lot in a Village Development: Sixty (60) feet.
5. 
Single-Family Semi-Detached Lot in a Village Development: Fifty (50) feet.
6. 
Townhouse Lot in a Village Development: Twenty-five (25) feet.
7. 
All Other Uses: One Hundred Fifty (150) feet.
D. 
Maximum Lot Coverage.
1. 
Single-Family Detached Lot created after the effective date of this Ordinance and not part of a Cluster Development or a Village Development: Twenty-five percent (25%).
2. 
Single-Family Detached Lot existing prior to the effective date of this Ordinance: Fifty percent (50%).
3. 
Single-Family Detached Lot in a Cluster Development: Fifty percent (50%).
4. 
Single-Family Detached Lot in a Village Development: Fifty percent (50%).
5. 
Single-Family Semi-Detached Lot in a Village Development: Sixty percent (60%).
6. 
Townhouse Lot in a Village Development: Seventy-five percent (75%).
7. 
All Other Uses: Fifty percent (50%).
E. 
Minimum Vegetative Coverage.
1. 
Single-Family Detached Lot created after the effective date of this Ordinance and not part of a Cluster Development or Village Development: Seventy-five percent (75%).
2. 
Single-Family Detached Lot existing prior to the effective date of this Ordinance: Fifty percent (50%).
3. 
Single-Family Detached Lot in a Cluster Development: Fifty percent (50%).
4. 
Single-Family Detached Lot in a Village Development: Fifty percent (50%).
5. 
Single-Family Semi-Detached Lot in a Village Development: Forty percent (40%).
6. 
Townhouse Lot in a Village Development: Twenty-five percent (25%).
7. 
All Other Uses: Fifty percent (50%).
F. 
Minimum Front Setback.
1. 
Single-Family Detached Lot created after the effective date of this Ordinance and not part of a Cluster Development: Thirty (30) feet.
2. 
Single-Family Detached Lot existing prior to the effective date of this Ordinance: Twenty (20) feet.
3. 
Single-Family Detached Lot in a Cluster Development: Twenty (20) feet.
4. 
All Other Uses except a Village Development: Twenty (20) feet.
G. 
Build-to Line.
1. 
Village Development: Eight (8) feet, with variation as required in § 14-1201.II.3.a.
H. 
Minimum Side Setback.
1. 
Single-Family Detached Lot created after the effective date of this Ordinance and not part of a Cluster Development or a Village Development: Twenty (20) feet.
2. 
Single-Family Detached Lot existing prior to the effective date of this Ordinance: Ten (10) feet.
3. 
Single-Family Detached Lot in a Cluster Development: Ten (10) feet.
4. 
Single-Family Detached Lot in a Village Development: Ten (10) feet.
5. 
Single-Family Semi-Detached Lot in a Village Development: Ten (10) feet.
6. 
Townhouse Lot in a Village Development: Five (5) feet, except for interior side property line, where no side setback line is required.
7. 
All Other Uses: Twenty (20) feet.
8. 
Accessory Structures: Minimum side setback for accessory structures shall comply with § 14-1101.A.
I. 
Minimum Rear Setback.
1. 
Single-Family Detached Lot created after the effective date of this Ordinance and not part of a Cluster Development or a Village Development: Twenty (20) feet.
2. 
Single-Family Detached Lot existing prior to the effective date of this Ordinance: Ten (10) feet.
3. 
Single-Family Detached Lot in a Cluster Development: Ten (10) feet.
4. 
Single-Family Detached Lot in a Village Development: Ten (10) feet.
5. 
Single-Family Semi-Detached Lot in a Village Development: Ten (10) feet.
6. 
Townhouse Lot in a Village Development: Ten (10) feet.
7. 
All Other Uses: Twenty (20) feet.
8. 
Accessory Structures: Minimum rear setback for accessory structures shall comply with § 14-1101.A.
J. 
Maximum Building Height: Thirty-five (35) feet, unless otherwise defined in § 14-1101.D or elsewhere in this Ordinance.
