27.0

AMENDMENTS

The City Council may from time to time, on its own motion or on petition, amend, supplement, change, modify, or repeal by ordinance the boundaries of districts or regulations, or restrictions herein established.


27.1.- PETITION AND DEPOSIT.

Before any action shall be taken as provided in this section, the party proposing or recommending a change in the district regulations or district boundaries shall deposit with the Director of Finance the sum of one hundred dollars ($100.00) for each acre or portion of acre that is within the tract of land that is to be rezoned. Said deposit shall not be refundable for failure of the City Council to adopt the proposed change. Provided, however, no deposit shall be required whenever the change is proposed by the City Plan Commission, the City Council or any member thereof, or by an official taxing agency or commission of the City of Ferguson.

27.2. - PLAN COMMISSION REVIEW.

Any proposed amendment, supplement, change, modification or repeal shall be first submitted to the Plan Commission for its recommendation and report.

27.3. - PUBLIC HEARING.

Upon the filing of the recommendation and report by the Plan Commission with respect to any proposed amendment, supplement, change, modification or repeal, or upon failure to report in 30 days, the Council shall proceed to hold a public hearing in relation thereto, giving at least 15 days' notice of the time and place of such a hearing, and if a proposed amendment, change or modification recommends a change in the District Boundaries by rezoning of certain property, then such notice shall, in addition to the legal description of the property, contain a commonly recognized designation or address; which notice shall first be published in a newspaper having a general circulation in the City.

27.4. - NOTICE TO OWNERS.

In addition, where the proposed amendment recommends a change in the District Boundaries by rezoning of property (a) at least one week prior to the time the City Council holds a public hearing on the rezoning, the City Clerk shall have mailed notices of the proposed rezoning to all owners of property as shown on the last tax rolls of the City, which is located within 185 feet of any part of the property being considered for rezoning action.

27.5. - CITY COUNCIL ACTION.

The City Council shall vote as follows:

27.51.

The City Council shall not take final action on any bill proposed under this section until at least six (6) days after the public hearing.

27.52.

Any ordinance under this section proposing a change of zoning for property shall require an affirmative vote of a majority of the entire Council for adoption. In the case of an adverse recommendation from the Plan Commission for a change of zoning for property, five (5) affirmative votes of the Council will be required. All other proposals, amendments, supplements, changes, modifications, or repeals hereunder shall require an affirmative vote of a majority of the entire Council for adoption.

27.53.

If a protest against any proposal, amendment, supplement, change, modification, or repeal shall be presented in writing to the City Clerk, duly signed and acknowledged by the owners of thirty percent (30%) or more, either of the areas of the land (exclusive of streets and alleys) included in such proposed change, or within an area determined by lines drawn parallel to and one hundred and eighty-five (185) feet distant from the boundaries of the district proposed to be changed, such proposed amendment, supplement, change, modification, or repeal shall not become effective except by a favorable vote of two-thirds (⅔) of all members of the City Council.
