05.- VIOLATIONS, ENFORCEMENT AND PENALTIES
(a)
Any violation of any provision of this title is unlawful and a public nuisance.
(b)
Violations of this title are abated in accordance with the procedures set forth in title 16 of the Fernley Municipal Code.
(a)
Any of the following is considered a violation of this title and is subject to the enforcement remedies provided by this chapter and by the Nevada state law:
(1)
Development or use without, or inconsistent with, permit or approval. Any activity that is not authorized or is inconsistent with all of the required permits, approvals, certificates and authorization required by this title.
(2)
Development or use inconsistent with title. An activity that is inconsistent with any regulation of this title or any amendment to this title.
(3)
Development or use inconsistent with conditions. To violate, by act or omission, any term, condition or qualification placed by the city upon a required permit, certificate, rezoning, plan approval or other form of authorization granted by the city to allow the use, development or other activity upon land or improvements of land.
(4)
Making lot or yard nonconforming. To reduce or diminish any lot area so that the yards or open spaces are smaller than prescribed by this title.
(5)
Increasing intensity or density. To increase the intensity and/or density of use of any land or structure, except in accordance with the procedural and substantive requirements of this title.
(b)
For purposes of this subsection, an "activity" or "activities" includes:
(1)
To erect, construct, reconstruct, remodel, alter, maintain, move or use any building, structure or sign, or
(2)
That use, alteration or maintenance of any land.
(a)
Any person, firm or corporation, whether as principal agent, employee or otherwise, in violation of this title (see section 32.05.020) is guilty of a misdemeanor and upon conviction thereof is punishable as provided in chapter 1.04 of the Fernley Municipal Code.
(b)
A person, firm or corporation in violation of this title is guilty of a separate offense for each and every day during which the violation is committed, continued, not remedied, or otherwise maintained.
