ARTICLE XV

CF Community Facilities Zone

§ 550-88 Permitted uses.

Permitted principal uses in the CF Zone shall be as follows:
A. 
Public schools.
B. 
Municipal offices.
C. 
Fire departments, including volunteer fire departments.
D. 
Police departments.
E. 
Municipal garages.
F. 
Municipal recycling centers.
G. 
Public works storage yards and salt/grit storage sheds.
H. 
Public works truck washing facilities.
I. 
Recreational facilities.
J. 
Rescue and/or first aid squads.
K. 
Senior citizen center.
L. 
Wireless communication towers in accordance with § 550-38.
M. 
Such other uses as may be interpreted by the Land Use Board to be exclusively public municipal activities.

§ 550-89 Accessory uses.

Permitted accessory uses in the CF Zone shall be as follows:
A. 
Wireless communication towers in accordance with § 550-38.
B. 
Windmills in accordance with the provisions of § 550-40.

[1]Small solar systems limited to the lesser of 15 kilowatts (15 kw) or 110% of the average of the three prior years’ electrical energy consumption. Solar panels and solar arrays may be rooftop mounted or ground mounted in the rear yard area only, at the applicant’s discretion. Ground-mounted solar panel arrays shall be prohibited from being located within the front yard area. In the event that an applicant proposes to locate ground-mounted solar panel arrays in the side yard area, application shall be made to the Zoning Officer for the grant of a waiver. In order to receive such waiver, the applicant shall demonstrate to the Zoning Officer that the location of the solar panel arrays on the roof of the residence (or other structure on the lot) or in the rear yard area is impracticable or will exact undue hardship because of peculiar conditions pertaining to the land in question. In the event that the Zoning Officer has doubt or difficulty with making a determination as to the granting of such waiver or in the event that the Zoning Officer denies such waiver, application shall be made to the Land Use Board for the grant of such waiver, which shall be treated as an exception pursuant to N.J.S.A. 40:55D-51. All ground-mounted small solar systems will be located upon the lot in closer proximity to the principal residence thereon than to any neighboring homes or building envelopes on adjoining properties that are unimproved. Ground-mounted solar arrays permitted by the Land Use Board, upon proper application, to be located within the side yard setback area shall be effectively screened from view from the street and adjacent properties by evergreen plantings having a minimum planted height of 48 inches and a maximum on-center planting spacing of 10 feet to create a continuous visual buffer. After completion of installation, the applicant shall provide written notice of the existence of such small solar energy system to the emergency service providers (Fredon Township Fire Department and Fredon Emergency Medical Services) identifying the subject property by block and lot, street address and a graphic plan or narrative identifying the location of the electrical service disconnect for the solar energy system.

D. 
Outdoor furnaces in accordance with the provisions of § 550-42.
E. 
All those accessory buildings or uses customarily incidental to the main permitted use in the zone.

§ 550-90 Zone requirements.

A. 
All municipally owned facilities in the CF Zone are encouraged to incorporate the following provisions:
(1) 
Green infrastructure treatments in accordance with the provisions of § 550-47.
(2) 
Solar energy devices in accordance with the provisions of § 550-41.
(3) 
An energy audit of all facilities to establish where and how energy is being used in buildings and facilities, and to identify opportunities for energy and cost savings. Funding is available through The New Jersey Board of Public Utilities, Office of Clean Energy (BPU) Municipal/Local Government Energy Audit Program.
(4) 
Adherence to a municipal green purchasing program, also known as environmentally preferable purchasing, which is the coordinated purchasing of goods and services to minimize impacts on human health and the natural environment. Examples of green purchasing include the purchase of products made from recycled content that are themselves recyclable, green cleaning products, green maintenance equipment and materials, and energy-efficient appliances or equipment for municipal use.
B. 
The following area, yard and bulk requirements shall be met for all lots in the CF Zone:
(1) 
Front yard. The minimum front yard setback shall be 50 feet.
(2) 
Side and rear yards. The minimum side and rear yard setbacks shall be 75 feet for the principal structure and 25 feet for off-street parking areas and other accessory structures.
(3) 
Building coverage. The maximum building coverage on any lot shall be 25% of the total lot area.
(4) 
Lot area. The minimum area for each lot shall be the minimum area necessary to accommodate all required yards and off-street parking.

§ 550-91 Reversion of property to private use.

If the public use of any area in the CF Zone is discontinued and the property reverts to private ownership or use, no new use shall be established until another zone district is applied to this property by the governing body, following the submission of a recommendation by the Land Use Board.
