CHAPTER 5

RESIDENTIAL ZONES

10-5A-1: PURPOSE:

This article establishes provisions, regulations and requirements for single-family zones. The purpose of these zones is as follows:
   A.   Large lot residential (LLR): To preserve the rural character of lands adjacent to the city limits to allow for orderly growth and the efficient provision of city services as necessary.
   B.   Single-family residential (SFR): To allow for the development of single-family homes in areas where urban services are provided. (1984 Code § 5-5-1)

10-5A-2: USE REGULATIONS:

   A.   Permitted Uses: The following uses and structures are principally permitted uses on each building site in the residential zones:

   C.   Prohibited Uses: Any use which is incompatible, including, but not limited to, industrial, adult entertainment and manufactured home parks, is prohibited. (1984 Code § 5-5-2; amd. 2014 Code)

10-5A-3: DEVELOPMENT STANDARDS:

No structure, nor the enlargement of any structure, shall be hereafter erected or maintained unless the following are provided and maintained in connection with such structure or enlargement:
   A.   Yards:
      1.   Front Yard: Each lot upon which a dwelling is constructed shall have a front yard of not less than twenty two feet (22').
      2.   Side Yard: On interior lots, there shall be a side yard on each side of a main building of not less than eight feet (8').
      3.   Corner Lots: On corner lots, the side yard requirements shall be the same as for interior lots, including a side yard of not less than ten feet (10') on the side adjacent to the street which intersects the street upon which the building or structure maintains frontage.
      4.   Reversed Frontage Lots: On a reversed frontage lot, there shall be maintained a setback from the side street of not less than fifty percent (50%) of the front yard required on the lots on the rear of such corner lots, but such setback need not exceed twenty feet (20'). No accessory building on a reversed corner lot shall project beyond the front yard required to the adjacent lot to the rear, nor be located nearer than ten feet (10') to the side lot line of an adjacent lot.
      5.   Rear Yard: There shall be a rear yard having no less than ten feet (10'). (1984 Code § 5-5-3)
   B.   Minimum Lot Size And Dimensions:
      1.   Within the Single-Family Residential (SFR) Zone, every dwelling erected or structurally altered shall be on a lot having an area of not less than seven thousand five hundred (7,500) square feet, a width at the established lot line of not less than seventy five feet (75'), and a depth of not less than one hundred feet (100').       2.   Within the Large Lot Residential (LLR) Zone, every dwelling erected or structurally altered shall be on a lot having an area of not less than two hundred seventeen thousand eight hundred (217,800) square feet (5 acres) and a width at the established lot line of not less than three hundred feet (300').    C.   Lot Coverage: Lot coverage shall not exceed forty percent (40%). (1984 Code § 5-5-3)
   D.   Parking:
      1.   A minimum of two (2) off street parking spaces shall be provided for each single-family dwelling. (Ord. 613, 7-11-2016)

10-5B-1: PURPOSE:

This article establishes provisions, regulations and requirements for a multi-family zone. The purpose of this zone is to allow for the development of residential units at higher densities in areas where urban services are provided. (1984 Code § 5-6-1)

10-5B-2: USE REGULATIONS:

   A.   Permitted Uses: Permitted uses are:
Any use permitted in a single-family residential zone.
Apartments, duplexes and townhouses.
Manufactured home parks, subject to chapter 15, article E of this title.
Planned unit developments with a density of six (6) or greater dwelling units per acre.
   B.   Conditional Uses: Conditional uses are:
Any use permitted as a conditional use in a single-family residential zone.
Hotel, motel or bed and breakfast.
   C.   Prohibited Uses: Any use which is incompatible including, but not limited to, industrial and adult entertainment, is prohibited. (1984 Code § 5-6-2; amd. 2014 Code)

10-5B-3: DEVELOPMENT STANDARDS:

   A.   Yard And Area: No structure, nor the enlargement of any structure, shall be hereafter erected or maintained, unless the following described yards and lot areas are provided and maintained in connection with such structure or enlargement:
      1.   Front yard: Twenty feet (20') minimum.
      2.   Side yard: Eight feet (8') minimum.
      3.   Rear yard: Ten feet (10') minimum.
      4.   Every dwelling erected or structurally altered to accommodate single-family and multi-family dwelling units shall be on a lot having a width at the established lot line of not less than seventy-five feet (75') on at least one side on lots having an area of not less than seven thousand five hundred (7,500) square feet.
   B.   Open, Recreation Space:
      1.   Open and recreation space shall be provided as follows:
         500 square feet per unit for the first 10 units.
         400 square feet per unit for 11-20 units.
         300 square feet per unit for 21 units and above.
      2.   The requirement for recreation space may not be satisfied through the utilization of parking areas or building separation. One hundred (100) square feet of the required square footage per unit may be provided in private open space, such as patios and balconies.
   C.   Screening: Yards, fences, walls or vegetative screening shall be provided at the edges of the development where needed to protect residents and adjacent property owners from undesirable views, lighting, noise or other on site and off site influences. In particular, extensive off street parking areas, service areas for loading and unloading purposes, other than for passenger use, and areas for storage and collection of refuse and garbage, shall be screened (See § 10-9-7 for fencing regulations).
   D.   Parking:
      1.   A minimum of two (2) off street parking spaces shall be provided for each living unit of a multi-family structure. (1984 Code § 5-6-3; amd. Ord. 613, 7-11-2016; Ord. 682, 5-10-2021)
