A new building is hereafter erected or enlarged.

A building existing on the effective date of this chapter is enlarged to the extent that the cost of construction exceeds 50% of the market value of the building, as shown on the Town of Gates Assessor's records, or to the extent that the building's capacity is increased by more than 50% in terms of the units used in the "Required Parking Spaces" column of § 190-14.

The use is changed to another use with greater parking requirements, provided that if the enlargement of a building existing at the time hereof is less than 50%, parking space shall be provided in proportion to the increase only. Any use requiring 1/2 or more of a parking space shall be deemed to require the full space.

Other uses not specifically listed above shall furnish parking as required by the Planning Board. The Planning Board shall use the above list as a guide for determining requirements for said other uses.

The off-street parking requirements of two or more uses, structures or parcels of land may be satisfied by the same parking or loading space, used jointly, to the extent that it can be shown by the owners or operators of the uses, structures or parcels that their operations and parking needs do not overlap in point of time. If the uses, structures or parcels are under separate ownership, the right to joint use of the parking space must be evidenced by a deed, lease, contract or other appropriate written document to establish the joint use.

The design of all parking areas and/or lots shall be such as to demonstrate a safe and efficient means of movement for both vehicles and pedestrians.

Unless otherwise provided or permitted, the stacking or storage of solid fuel (wood, lumber or other material) for use in wood-burning stoves in any front yard is prohibited.

Any person in violation of Subsection A at the time of the adoption of this section shall have a period of 45 days from the date of adoption to be in compliance therewith.

Parking areas shall have a minimum aisle width of 15 feet for one-way traffic and 24 feet for two-way traffic. The minimum parking space shall be nine feet in width and 18 feet in length for 90º, 60º and 45º parking or 10 feet in width and 20 feet in length for parking parallel to the aisle.

Any parking area which is intended to be used during nondaylight hours shall be properly illuminated to avoid accidents. Any lights used to illuminate a parking lot shall be so arranged as to reflect the light away from all adjoining property.

Except for single-family dwellings, any parking area shall be designed in such a manner that any vehicle leaving or entering the parking area from or into a public or private street shall be traveling in a forward motion. Access or driveways for parking areas or loading spaces shall be located in such a way that any vehicle entering or leaving such lot shall be clearly visible for a reasonable distance to any pedestrian or motorist approaching the access or driveway from a public or private street.

The required number of parking and loading spaces, as set forth in this section, together with driveways, aisles and other circulation areas, shall be improved with acceptable impervious material, to provide a durable and dust-free surface or large aggregate stone or asphalt.

All parking and loading areas shall provide for proper drainage of surface water to prevent the drainage of such water onto adjacent properties or walkways.

The owner and/or lessee of the property used for parking and/or loading shall maintain such area in good condition without holes and free from dust, trash and other debris. Trash receptacles shall be placed in parking lots near entrances, exits and sidewalks for collection of paper and other litter. These are not to be dumpsters.

The parking of a disabled vehicle within a residential or commercial district for a period of more than one week shall be prohibited unless such vehicle is stored in an enclosed garage or other accessory building or otherwise screened, in accordance with this chapter, from public view.

Unless otherwise permitted, no unlicensed motor vehicle of any type or kind shall be parked or stored on any residentially zoned property unless it is parked or stored in a completely enclosed building. No more than one recreational trailer, motor home, boat or other personal recreational vehicle belonging to an occupant of the premises may be stored on a driveway or in a required side yard as long as such vehicle is not used for habitation and does not impede the view of pedestrians or vehicles from seeing one another for a reasonably safe distance. The parking or storing of commercial vehicles or trailers in residentially zoned areas is prohibited, except that one commercial vehicle not exceeding three-fourths-ton rated capacity being used by an occupant of the premises may be so parked or stored on the premises.

In all parking areas of more than five vehicles, parking shall be so distributed as to service the individual units or business. Parking lots shall be kept small and in other ways broken into smaller units through provision of islands and plantings.
