LAND USE CATEGORIES; ZONING DISTRICTS ESTABLISHED; ZONING MAP

Sec. 125-123.- Purpose.

The purpose of this article is to describe the specific uses and restrictions that apply to land use categories in the land use element of the comprehensive plan as well as the zoning districts for the county. These regulations are intended to allow development and use of property only in compliance with the goals, objectives, and policies of county as expressed in the county comprehensive plan.

Sec. 125-124. - Land use categories and zoning districts distinguished.

Land use categories for the county are established in the county comprehensive plan and are the product of an analysis of both the existing conditions in the county as well as the application of planning and growth management principles. Land use categories must be reviewed and approved by the state department of community affairs (DCA). These districts may only be modified by a comprehensive plan amendment that must also be reviewed and approved by DCA. Zoning districts are specific defined areas where certain uses are permitted, prohibited, or restricted. By state law, all zoning districts must be consistent with the county comprehensive plan.

Sec. 125-125. - Land use categories.

Land use categories for the county are established in the comprehensive plan, future land use element, including a map series. The land use categories and classifications defined in the future land use element of the county comprehensive plan and delineated on the future land use map shall be determinants of permissible activities on any parcel in the unincorporated areas of the county. The land use categories are:

Agricultural/residential

Agricultural/open

Conservation

Transition

Landfill

Park

Sec. 125-126. - Zoning districts.

For the purpose of this chapter, the county is hereby divided into zoning districts as follows:

RM Residential mixed

Sec. 125-127. - Comparative land use designations and zoning districts.

For the purposes of this chapter, the county zoning districts are consistent with the following land use designations of the county comprehensive plan. This comparison is for informational purposes only. Any use of any land must comply with the requirements of the specific zoning districts as described in this section and with all other requirements of this chapter and all other applicable government regulations.

Sec. 125-128. - Zoning map.

(a)

The unincorporated area is hereby divided into zones, or districts, as shown on the official zoning map (also known as the official zoning map series). The boundaries of the zoning districts of the county are shown on the map entitled, "Zoning Map Series, Glades County, Florida," dated and certified by the county clerk. Said map is hereby incorporated into and made a part of this chapter by reference.

(b)

The official zoning map shall be identified by the signature of the chairman of the board of county commissioners and attested by the county clerk, and bearing the seal of the county of under the following words: "This is to certify that this is the Official Zoning Map referred to in Section I of Ordinance Number 75-3 of Glades County, Florida, together with the date of the adoption of this ordinance." If, in accordance with the provisions of this chapter and F.S. ch. 125, changes are made in district boundaries or other matter portrayed on the official zoning map, such changes shall be entered on the official zoning map promptly after the amendment has been approved by the board of county commissioners, with an entry on the official zoning map as follows: "On (date), by official action of the Board of County Commissioners, the following (change) changes were made in the Official Zoning Map: (brief description of nature of change)," which entry shall be signed by the chairman of the board of county commissioners and attested by the county clerk. No amendment to this chapter which involves matter portrayed on the official zoning map shall become effective until after such change and entry has been made on the map.

(c)

No changes of any nature shall be made in the official zoning map or matter shown thereon except in conformity with the procedures set forth in this chapter. Any unauthorized change of whatever kind by any person shall be unlawful.

(d)

Regardless of the existence of purported copies of the "Zoning Map Series, Glades County, Florida," which may from time to time be made or published, the Zoning Map Series of Glades County Florida, in the office of the county clerk shall be the final authority for zoning districts in the county.

(e)

In the event that the official zoning map becomes damaged, destroyed, lost or difficult to interpret because of the nature or number of changes and additions, the board of county commissioners may by resolution adopt a new official zoning map which shall supersede the prior official zoning map. The new official zoning map may provide for corrections or drafting or other errors or omissions in the prior official zoning map, but no such correction shall have the effect of amending the original official zoning map or any subsequent amendment thereof. The new official zoning map shall be identified by the signature of the chairman of the board of county commissioners and attested by the county clerk, and bearing the seal of the county under the following words: "This is to certify that this Official Zoning Map supersedes and replaces the Official Zoning Map adopted (date of adoption of map being replace) as part of Ordinance No. 75-3 of Glades County, Florida." Unless the prior official zoning map has been lost, or has been totally destroyed, the prior map or any significant parts thereof remaining, shall be preserved, together with all available records pertaining to its adoption or amendment.

Sec. 125-129. - Interpretation of district boundaries.

Where uncertainty exists with respect to the boundaries of any of the aforesaid districts as shown on the "Zoning Map Series, Glades County, Florida," the following rules shall apply:

(1)

Where district boundaries are indicated as approximately following the center lines of streets or highway right-of-way lines, such centerlines, street lines, or highway right-of-way lines shall be construed to be such boundaries.

(2)

Where district boundaries are so indicated that they approximately follow lot lines, such lot lines shall be construed to be such boundaries.

(3)

Where district boundaries are so indicated that they are approximately parallel to the centerlines or street lines of streets, or the centerlines of highway right-of-way, such district boundaries shall be construed to being parallel thereto and at such distance therefrom as indicated on the zoning map series. If no distance is given, such distance shall be determined by the use of the scale on said zoning map series.

(4)

Where the boundary of a district follows a railroad line, such boundary shall be deemed to be located in the middle of the main tracks of said railroad line.
