ARTICLE XXVI
Wireless Communications Collocation Towers on Public Sites
§ 104-184 Collocation of communications antennae on towers on public property.
A.
Collocation policy. The Borough of Glen Gardner shall plan for and accommodate the growing demand for communications antennae by collocating such new antennae on towers sited on publicly owned sites controlled or designated by the Borough and which are appropriate locations for facilitating antennae transmission and for minimizing visual and other impacts on the public associated with communications antennae.
B.
Location. A communications tower with supporting wires and facilities will be permitted on Block 21, Lot 19, a ten-and-eight-tenths-acre Borough-owned property currently used by the Glen Gardner Water Company, with the intention of satisfying at one location the increasing demand for communications antennae of any diverse carriers for the foreseeable future.
C.
Public/private partnership to implement collocation policy.
(1)
Said collocation communications tower will be installed, maintained and operated by a private business and/or regulated public utility on public property under a lease agreement with the Borough of Glen Gardner pursuant to the Local Lands and Buildings Law and/or the Local Public Contracts Law[1] of the State of New Jersey and in compliance with the ordinance requirements of the Borough.

In order to assure that said tower at the above referenced location will accomplish the intent of this article, any lease agreement with the private operator or regulated public utility shall include requirements, but not be limited, to the following requirements:
(a)
The tower will be structurally constructed to be capable of supporting at least 300 antennas which meet radio frequency requirements.
(b)
The tower shall not exceed 550 feet from grade.
(c)
Antennae space shall rented to all interested carriers at a rate reflecting the fair market price for such services.
(d)
Compliance with the design and performance standards set forth in § 104-23F(3)(d).
(3)
The private entity or regulated public utility which will install, maintain and operate the collocation tower will be selected through an open public bidding process under specifications and a lease agreement to be prepared for the Borough Mayor and Council under applicable New Jersey law governing public-private agreements. Specifications will include, but not be limited to, a demonstration of suitable past site management experience, compliance with prescribed construction standards with a cost and revenue analysis for the first five years of operation.
