The preservation and improvement of the quality of the natural and manmade environment within the Village of Goshen, in the face of population growth, urbanization and technological change with the accompanying demands on natural resources, are found to be of increasing and vital importance to the health, welfare and economic well-being of present and future inhabitants and require forthright action by the governing body of the Village of Goshen; therefore, the Village of Goshen hereby creates and environmental review board to act in an advisory capacity to the planning board.
The environmental review board shall consist of five members, who shall be appointed by the mayor, with approval of the village board, who shall serve as follows: two of whom shall serve for three years, two of whom shall serve for two years and one of whom shall serve for one year. Thereafter the term of office shall be three years. Persons residing within the Village of Goshen who are interested in the improvement and preservation of environmental quality, who are [at least] 21 years of age, and registered voters, shall be eligible for appointment as a member of the environmental review board.
The village board shall appoint a member of the environmental review board to act as chairperson thereof, at the suggestion of the environmental review board members. The environmental review board shall adopt rules and procedures for its meetings. It shall keep accurate records of its meetings and activities and file them with the village clerk. A compilation of the year's minutes shall constitute an annual report.
Vacancies on the environmental review board shall be filled in the same manner as the original appointment, except that a vacancy occurring other than by the expiration of term of office shall be filled only for the remainder of the unexpired term.
The powers and duties of the environmental review board shall be to:
16.4.1. Advise any officials or agencies of the Village of Goshen on matters affecting the preservation, development and use of the natural and manmade features and conditions of the village insofar as quality, biological integrity, beauty and other activities and developments; it shall also advise on any major threats posed to environmental quality, so as to enhance the long range value of the environment to the people of the village.
16.4.2. Administer the implementations set forth in the provisions of the Environmental Quality Review Act, L.L. No. 5 of 1977, and shall:
16.4.2.1. Review environmental assessment forms.
16.4.2.2. Make recommendations on the significance and nonsignificance of actions.
16.4.2.3. Review environmental impact statements and recommend on the scope, adequacy and contents of environmental impact statements.
16.4.2.4. Make recommendations to decision-makers.
16.4.3. Carry out such other duties as may be assigned from time to time by the village board of trustees.
