C2 - Business District
§ 265-24 Composition of district; purpose.
The C2 - Business District is intended for the conduct of general business to which the public requires direct and frequent access, but which is not characterized either by constant heavy trucking other than stocking and delivery of light retail goods or by any nuisance factors other than occasioned by incidental light and noise of congregation of people and passenger vehicles. This includes such uses as retail stores, theaters and other amusement enterprises, business offices, newspaper offices and printing presses, restaurants, bars and community garages or community parking areas subject to special regulations. In-town apartment use is considered desirable, particularly in high-rise buildings with commercial usage on the lower floors. To that end, multiple-family dwellings are permitted, and the height limit is set at 100 feet. Industrial use of land is prohibited, as well as any other use which would substantially interfere with the development or continuation of the commercial structures and uses in the district.
§ 265-25 Permitted uses.
A.
In this district, the land and structures may be used, and structures may be erected, altered, enlarged and maintained, for commercial uses listed hereunder, provided that:

Unless otherwise specifically stated, each enterprise shall be conducted entirely within a completely enclosed building.
(2)
When the major portion of such products is to be sold at retail on the premises, there may be manufacture, compounding, processing or treatment of products which is clearly incidental and essential to a retail store or business.
(3)
Any such use, operation or product shall be prohibited if, upon appeal, the Board finds it is noxious or offensive by reason of emission of odor, dust, smoke, gas, vibration, noise or other similar causes.
B.
Permitted uses are:

Retail service commercial uses involving retail sales with incidental repair; amusement enterprises; business, consumer and personal services; eating and drinking establishments, including dancing and live entertainment; and financial institutions, provided that:

Institutions of postsecondary education, including without limitation colleges, universities, technical institutes, business colleges or trade, vocation or proprietary schools.

Funeral home.
(6)
Offices, including business, professional, public and semipublic.

Residential uses.

All existing and new student homes must be registered annually with Planning and Development. Issuance of registration for student homes shall not exceed one year and shall be based on the period of August 1 to July 31. All student home registrations shall expire on July 31. Student homes must pass a code compliance inspection by the Code Enforcement Department prior to being registered and occupied.

§ 265-26 Height.
The maximum heights of structures in this district shall be as specified in Article XI.
§ 265-27 Area requirements.
Each lot in this district shall comply with the area requirements as specified in Article XII.
