ZONING HEARING BOARD

§ 15-1001 Organization, Procedure and Grant of Power.

1. 
Establishment. Pursuant to the provisions of Act 247 of 1968, as amended, the Pennsylvania Municipalities Planning Code, 53 P.S. § 10101 et seq., a Zoning Hearing Board is hereby established.
2. 
Appointment.
A. 
Number and Qualification of Members. The Zoning Hearing Board shall consist of five members, whose qualifications, membership, organization and procedures shall be as set forth in Article IX of the Pennsylvania Municipalities Planning Code, as amended, 53 P.S. § 10901 et seq.
B. 
Alternate Members. The Township Supervisors may appoint up to three alternate members of the Zoning Hearing Board who shall serve pursuant to Article IX of the Pennsylvania Municipalities Planning Code, as amended, 53 P.S. § 10901 et seq.
3. 
General Grant of Power. The Zoning Hearing Board shall perform all of the duties and have all of the powers prescribed by Article IX of Act 247 of 1968, as amended, of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10901 et seq., and as herein described.

§ 15-1002 Hearing Procedures.

1. 
Parties Appellant Before the Zoning Hearing Board.
A. 
Appeals from any decision of the Zoning Officer and proceedings to challenge the validity of this chapter may be filed with the Zoning Hearing Board in writing by any Officer or agency of the Township, or by any person aggrieved.
B. 
Requests for a variance may be filed with the Zoning Hearing Board by any landowner, any authorized agent of such landowner, or by the Zoning Officer.
2. 
Applications Required.
A. 
All requests and appeals made to the Zoning Hearing Board shall be in writing, either on forms provided by the Township, or as prepared by the applicant. Every appeal or request shall refer to a specific provision of this chapter, and shall exactly set forth the interpretation that is claimed, the plans for the conditional use or the details of the variance that is applied for, and shall also contain the following:
(1) 
The name and address and phone number of the applicant or appellant.
(2) 
The name and address and phone number of the owner of the lot to be affected by the change, variance or appeal.
(3) 
A brief description of the location and the lot to be affected by the change, variance or appeal.
(4) 
A statement of the present zoning classification of the lot in question, the improvements thereon and the present use thereof.
(5) 
An accurate description of the present improvements, and the additions or changes intended to be made under this application, indicating the size of such proposed improvements, material, and general construction thereof. In addition, there shall be attached a plot plan of the real property to be affected, indicating the location and size of the lot, and size of the improvements thereon, and proposed to be erected thereon, with such features, such as streams, watercourses, elevations, sinkholes, and generally such other features as are reasonably necessary to explain the problem. Said plan need not necessarily be professionally prepared.
3. 
Procedure and Notice for Hearings.
A. 
The Zoning Hearing Board and Township shall conduct hearings and make decisions in accordance with the procedures set forth in Article IX of the Pennsylvania Municipalities Planning Code, as amended 53, P.S. § 10901 et seq.
B. 
Notice shall be given as prescribed by Article IX of the Municipalities Planning Code, as amended, 53 P.S. § 10901 et seq. In addition to the notice required by the MPC, notice shall be given at such time and in such manner as shall be prescribed by the rules adopted by the Zoning Hearing Board.
C. 
Notice shall also be conspicuously posted on the affected tract of land for at least seven consecutive days prior to the hearing. The posting shall consist of a sign at least 24 inches by 24 inches.
D. 
The procedures followed at the hearing shall conform to those set forth in the Municipalities Planning Code, as amended, 53 P.S. § 10101 et seq.
4. 
Zoning Appeals to Court. Appeals to Court shall be governed by Article X-A of the Pennsylvania Municipalities Planning Code, as amended, 53 P.S. § 11001-A et seq.
