§ 9

USE OF PROPERTY.

Allowed general use in Districts A and B:
Single-Family Dwellings and accessory buildings typical for a residence.
City of Grey Forest owned Parks and Facilities and activities related to usage of those parks and facilities.
City of Grey Forest Municipal Operations.
Fire Department Operations.
Libraries, museums, and other public use buildings with adequate parking on site[.]
Private family gatherings.
Occasional events or neighborhood parties not prohibited by this ordinance.
Studios and facilities used for art, education or exercise.
Existing Grey Moss Inn.
“Existing Grey Moss Inn” use shall mean a historically recognized facility located within the City of Grey Forest which functions as a restaurant with in-door and outdoor dining and a full-service bar in which more than fifty (50) percent of sales are food and other non-alcoholic items and existed as a facility and use prior to March 17, 1971. Such a use does not include (i) Operation as a full-service bar in which less than fifty (50) percent of sales are food and other non-alcoholic items, (ii) Operation as an amplified live-music venue, or (iii) Operation as anything other than a restaurant and/or full-service bar in which more than fifty (50) percent of sales are food and other non-alcoholic items. Such use is subject to health and safety regulations as to the maintenance of the premises and conditions of operation as may be reasonably required to avoid injury to persons or property. Furthermore, such use shall be subject to federal, state, and local regulations pertaining to health, food safety, fire and other such regulations as may be reasonably necessary to protect the health, safety, and welfare of patrons and employees.
Garage, yard, and estate sales (not more than two per year). A permit for each garage, yard and estate sale is required to be obtained through the City.
Long term rentals with a maximum of two concurrent long-term rentals on a single property[.]
Short-Term Rentals in accordance with restrictions in section 9.03.
Occupations and business typically performed at home or from a home office (including but not limited to consulting, accounting, bookkeeping, notary services, etc.) or service businesses run from a home but where the service is not performed at the home/residence (including but not limited to tree trimming, maid service, housekeeping, etc.). These types of activities may not have:
Client parking on a street
An occupation or business sign
Employees not related to the resident, who are working in the home
Usage of the more than 50% of the building square footage for business
Storage of any dangerous kinds of materials inside or outside the home.
Use prohibited in District A and B:
Occupation or business typically not performed at home including but not limited to: Industrial work, retail store, heavy manufacturing, motor vehicle or motorized equipment sales, equipment or vehicle rental, dumping, debris and junk storage, scrap and salvage activities, warehousing for others for profit, restaurants and food services, hotels, motels, etc.
Short-Term rentals except as specified in section 9.03.
Commercial or Event venues for which any form of compensation is exchanged.
An activity where odor, air quality, light, or noise creates a nuisance that interferes with normal residential quality of life or creates a safety risk; or where pedestrian and automobile traffic impedes traffic flow, except on occasions as approved by the City Council.
Enterprises that require on-street parking more than once a week.
Goods or materials for sale or stands for selling in the front yard for more than two consecutive days unless permitted by the City.
Enterprises that may result in harm to public health or that carry or dispense materials for sale or commercial use that are subject to regulation including but not limited to gasoline, oil, kerosene, propane, paint, solvents, and similar materials and products, unless permitted by the City.
Parking of inoperable, unlicensed, or unregistered vehicle for a month or more where such is both visible from the roadside and within 75 feet of the road.
Allowing any harmful materials to be dispensed or leached into a creek or waterway.
Bee keeping.
Parking more than two vehicles owned by others for the purpose of repairing on the premises.
Short-Term Rentals.
In keeping with the residential nature of the City of Grey Forest and with the intent of preserving the residential environment and character of the City, the following regulations govern Short-Term Rentals within the City of Grey Forest:
All Short-Term Rentals shall require a license
A Short-Term Rental License shall be secured prior to operation as described in section 9.03.01 of this ordinance.
The license shall be prominently displayed on the front facade of the property in a location clearly visible from the street during all periods of occupancy and contain the license number and the contact information for the owner.
The property where Short-Term Rental activities are conducted shall be the property owner’s principal residence and the property owner shall be present during the period of any rental.
Short-Term Rentals shall not be operated outdoors, in an accessory building, or in a recreational vehicle.
The Short-Term Rental shall appear outwardly to be a residential dwelling or portion thereof and be in accordance with City of Grey Forest Building and Zoning ordinances.
No signs are allowed for operation of any Short-Term Rentals[.]
Short-Term Rental occupants or guests may not park on the street[.]
Short-Term Rental occupancy on a lot is limited to two (2) guests per bedroom with a maximum of six (6) guests at any one time.
Owners operating Short-Term Rentals are required to store trash and recycling bins for the property in a location that is not visible from public rights-of-way except for the purpose of collection on scheduled trash and recycle collection days.
Use of the Short-Term Rentals for commercial events or activities is prohibited.
Short-Term Rentals shall not adversely affect the residential character of the neighborhood.
The Short-Term Rental activity and property shall comply with all applicable license requirements and ordinances and codes of the City of Grey Forest including but not limited to noise restrictions and use of city owned park property.
Short-Term Rental Licensing.
In order to operate a Short-Term Rental in accordance with Section 9.03 of this ordinance, the property owner must apply for and be granted a Short-Term Rental License. To apply and be granted a license, the property owner shall follow the application process specified in Section 9.03.01.1:
Short-Term Rental License Application Process.
To apply for a Short-Term Rental license, the property owner shall:
Obtain rental information and the Short-Term Rental License Application from the City Secretary.
complete and submit the following documentation to the City Secretary:
the signed and notarized Short-Term Rental License Application with the proper information and indicating the owner’s agreement to the Short-Term Rental regulations (e.g. occupancy limits, license display, maintaining the residential character of the neighborhood, etc.).
proof of property owner’s principal residence as stated on the Short-Term Rental License Application.
proof of current Property and Liability Insurance (summary or declarations page).
proof of passing health and fire safety inspections of the Short-Term Rental by inspectors approved by the city (contact the City Secretary to schedule, conduct, and pay for health and fire safety inspections).
provide floor plan of property where Short-Term Rental activities are conducted.
pay an annual license of $300, payable to the City of Grey Forest upon approval of the application.
Short-Term Rental License Conditions and Restrictions.
The following conditions and restrictions apply for management and issuance of Short-Term Rental Licenses:
The Short-Term Rental License is valid for one year from the approval date.
The Short-Term Rental property owner may apply for renewal through the complete Short-Term Rental License Application Process. If the property owner does not renew the Short-Term Rental License prior to the expiration date of the license, the Short-Term Rental License is terminated.
The Short-Term Rental License is not transferable. If the property owner does not continue to reside on the property or the property is sold or transferred in any manner, the Short-Term Rental License is immediately terminated.
The City of Grey Forest limits the number of active Short-Term Rental Licenses to five (5) at any one time.
