5. - B-4. HIGHWAY BUSINESS DISTRICTS

Sec. 86-127.- Purpose.

The purpose of this article is to establish a district designed and intended to accommodate highway-oriented retail, service, and other miscellaneous uses and use variances which are most compatible with uses typically located along major arterial local roads and county, state and federal highways. Access is provided to customers arriving in vehicles.

Sec. 86-128. - Limitations of use.

Permitted uses in the B-4 district are subject to the following additional general limitations:

(a)

Dwelling units and lodging rooms other than those located in a transient hotel or motel are not permitted.

(b)

All businesses, services, processing or storage shall be conducted in completely enclosed buildings unless said open storage is a minimum of 150 feet from any residential district, and then only if said open storage is completely nonvisible by reason of a wall or opaque fence, or as otherwise indicated hereafter, and except when establishments of the "drive-in" type offer goods and services directly to customers waiting in parked motor vehicles.

(c)

Outdoor sales of retail items may be sold only if:

(1)

The sale takes place on the same property where a permanent retail business is located.

(2)

The items sold are among the permitted uses listed for this district.

(3)

The items are sold by the same owners of the permanent business.

(4)

Said outdoor sales shall not result in the lack of compliance with any other required provision of this chapter, such as setback, parking, etc.

(d)

Storage of construction equipment, not exceeding ten feet in height is permitted in accordance with limitations listed in subsection (b) above.

Sec. 86-129. - Permitted uses.

The following listed uses and no others are permitted uses in a B-4 district:

(a)

Any use permitted in a B-3 district except uses permitted in a B-2 district, dwelling units, churches, parks, and playgrounds.

(b)

Additional retail and service uses, as follows:

(1)

Boat sales, motor and sail, including servicing and repairs conducted in conjunction therewith.

(2)

Car washes and auto laundries.

(3)

Mobile home sales.

(4)

Motor home sales, camper and motor vehicle trailer sales.

(5)

Motor vehicle sales, including servicing and repairs conducted in conjunction therewith.

(6)

Motorcycle sales, including servicing and repairs conducted in conjunction therewith.

(7)

Lumberyards.

(8)

Construction materials and equipment storage for residential and commercial construction company.

(c)

Public and community service uses, as follows:

(1)

Libraries.

(2)

Police stations.

(3)

Fire stations.

(4)

Other such public uses.

(d)

Residential uses, as follows:

(1)

Motels and transient hotels.

Sec. 86-130. - Maximum floor area ratio.

In a B-4 district, the floor area ratio of all buildings and structures on a zoning lot shall not exceed 3.0.

Sec. 86-131. - Required yards.

In a B-4 district, regulations governing required yards in a B-3 district shall apply.

Sec. 86-132. - Building height.

No building or structure may be changed or erected in this district so as to have a height greater than 40 feet.
