ARTICLE V

- EFFECT OF THE ORDINANCE

Sec. 5-100. - Effect.

(5-101) All buildings erected hereafter, all uses of land or buildings established or changed hereafter, and all structural alterations, enlargements, relocations, and restorations of existing buildings occurring hereafter shall be subject to the requirements and regulations of this ordinance, and no land shall be used for and no building shall be erected for or converted to any use other than provided in the regulations prescribed for the district in which it is located, except as hereinafter provided.

(5-102) Where a building permit for a building or structure has been issued in accordance with law prior to the effective date of this ordinance, and provided that construction is begun within ninety (90) days of such effective date and diligently prosecuted to completion, approved plans on the basis of which the building permit has been issued and further, upon completion may be occupied under a certificate of occupancy by the use for which originally designated subject thereafter to all applicable provisions of this ordinance.

(5-103) No building or other structure shall hereafter be erected or altered:

(a)

To exceed the height;

(b)

To accommodate or house a greater number of families;

(c)

To occupy a greater percentage of lot area;

(d)

To have narrower or smaller rear yards, front yards, side yards, or other open spaces;

than herein required; or in any other manner contrary to the provisions of this ordinance.

(5-104) No part of a yard or other open space, or off-street parking or loading space required about or in connection with any building for the purpose of complying with this ordinance shall be included as part of a yard, open space, or off-street parking or loading space similarly required for any other building.

(5-105) No yard or lot existing at the time of passage of this ordinance shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or lots created after the effective date of this ordinance shall meet at least the minimum requirements established by this ordinance.

(5-106) All territory which may hereafter be annexed to the city shall be considered to be zoned single family residential. Application for building permits for uses other than residential in newly annexed areas shall be referred to the Groves City Planning and Zoning Commission by the building official. The Groves City Planning and Zoning Commission may recommend denial, or in recommending approval of such building permit, the Groves City Planning and Zoning Commission may impose such requirements and conditions with respect to location, construction, maintenance and operation in addition to those expressly stipulated in this ordinance for the particular use, as they may deem necessary for the protection of adjacent properties and the public interest. The application together with the recommendations of the Groves City Planning and Zoning Commission shall then be forwarded to the city council for final authorization before issuance of a building permit.
