CHAPTER 17

67 COMMERCIAL HEMP-RELATED AND ACTIVITY

§ 17.67.010 Purpose and intent.

The purpose of this chapter is to further fulfill the purposes and intents set forth in Chapter 5.68 of the Hanford Municipal Code. No person shall operate a commercial hemp business without first obtaining a conditional use permit and complying with all the requirements of Chapter 5.68 of the Hanford Municipal Code and complying with all applicable state law requirements.

§ 17.67.020 Definitions.

Unless otherwise provided herein, the terms used in this chapter shall have the meanings ascribed to them in Chapter 5.68 of the Hanford Municipal Code.

§ 17.67.030 Location of hemp retailers and commercial hemp businesses.

A. 
In cases in which five percent or more of a retailer's business or gross receipts is derived from the sale of hemp in the form of CBD products, such retailers will be a permitted use only in Service Commercial (C-S), Highway Commercial (C-H), Corridor Mixed Use (MX-C), and Downtown Mixed Use (MX-D) zone districts and shall be a conditional use only in Regional Commercial (C-R) zone districts. In cases in which less than five percent of a retailer's business or gross receipts is derived from the sale of hemp in the form of CBD products, such retailers shall be allowed in zone districts as other retail uses in accordance with Section 17.08.030.
B. 
Commercial hemp businesses shall be permitted only in Heavy Industrial (I-H) and Light Industrial (I-L) zone districts.
C. 
Section 17.08.030 is amended in the manner reflected in Attachment 1 of the ordinance codified in this chapter, which is incorporated by reference, to add commercial hemp businesses and hemp retailers.
