ARTICLE XIII

R-C Residential Commercial District

§ 185-48 Use regulations.

A. 
Principal uses and structures permitted. The following uses and structures shall be permitted in the R-C Residential Commercial Districts:
(1) 
Detached single-family dwellings.
(2) 
Municipal buildings and grounds.
(3) 
Antique and/or gift shop.
(4) 
Arts and crafts shop.
(5) 
Beauty salon.
(6) 
Bookstore.
(7) 
Clothing and apparel store or sport shop.
(8) 
Day-care center or nursery school.
(9) 
General offices.
(10) 
Photographer's studio.
(11) 
Professional use.
(12) 
Travel agency.
(13) 
Video shop.
B. 
Permitted accessory uses. The following accessory uses shall be permitted in the R-C Residential Commercial Districts:
(1) 
Accessory uses for detached single-family dwellings in the R-C Residential Commercial Districts shall, subject to the same regulations applicable in MIDD-3, be permitted in the R-C Districts.

C. 
Conditionally permitted uses. The following uses are permitted only after review and approval by the Planning Board pursuant to the standards and criteria set forth in Article XVI:
(1) 
Conversion of existing residence or construction of a new building on a existing lot containing less than 40,000 square feet which shall have the appearance of a residential dwelling, to be used for any of the uses permitted in § 185-48A(2) through (13), inclusive.
(2) 
Construction of an access road or driveway over and across a lot in the R-C District to a property located in an adjoining I-1 or I-2 Industrial District, subject to the following requirements:
(a) 
No such access shall be permitted over a tract in the R-C Zone which is used exclusively for residential purposes.
(b) 
Except where the Planning Board finds that sound planning requires otherwise, not more than one such access shall be permitted for any tract in the I-1 or I-2 Zoning Districts as shown on the Zoning Map of Hardyston Township dated September 5, 1989,[1] and no access road or drive shall intersect a public road or highway within 200 feet of any other such access road or driveway.

(c) 
All access roads or drives capable of serving more than 100 acres shall be constructed in full conformity with Township standards for street or road design and construction set forth in Chapter 158 of the Township Code and shall meet all the standards for a collector street; provided, however, that the Planning Board may reduce such design standards to that of a minor street if the access road or drive services less than 100 acres or is a cul-de-sac having a length of 600 feet or less.
(d) 
Whenever approval is sought for an access road or drive to a tract abutting another tract in an I-1 and I-2 Zone which is landlocked and has no access to a public road or highway, the Planning Board may require dedication of an extension of said proposed access road or driveway to the boundary line of said landlocked tract; provided, however, that the applicant shall incur no obligation to improve said dedicated right-of-way strip beyond the point of applicant's proposed use, but the owner of the landlocked tract may, upon constructing a street on said right-of-way in accordance with the requirements of Subsection C(2)(c) of this section, be entitled to use the same for access to his or her otherwise landlocked parcel.
(e) 
It shall be shown that drainage shall be disposed of in accordance with the construction standards set forth in Chapter 158 of the Township Code.
(3) 
Public utility uses and essential services.

§ 185-49 Bulk requirements and other conditions.

The following requirements are applicable in the R-C Residential Commercial Districts:
A. 
Minimum lot area: 40,000 square feet.
B. 
Minimum lot width: 100 feet.
C. 
Minimum yard requirements:
(1) 
Front yard setback: 40 feet.
(2) 
Side yards shall total 40 feet and no side yard shall be less than 10 feet in width.
(3) 
Rear yards shall have a minimum depth of 40 feet.
D. 
Maximum percent of lot coverage by impervious surfaces shall not exceed 50%.
E. 
Maximum height: The height of a principal structure shall not exceed 35 feet or 2 1/2 stories, whichever is less.
F. 
Accessory structures other than driveways, walls and fences shall not be located closer than 10 feet to any rear or side property line, shall not be permitted in front yard areas and shall not exceed 15 feet in height.
G. 
Off-street parking shall be provided as required by Article XX.
H. 
Only one family shall be permitted to occupy any buildings on the site. Only accessory uses customary and incidental to the principal use shall be permitted on the site.
