Zoning map.
1-53-1.1. Establishment of zoning map. The locations and boundaries of the zoning districts established within the county shall be shown on a map, comprising one or more sheets, entitled "Zoning Map of Hendry County, Florida," adopted August 27, 1991, and which is incorporated herein.
1-53-1.2. Certification of zoning map. The zoning map shall be identified by signature of the chairman of the board of county commissioners, attested by the county clerk, and shall bear the words: "This is to certify that this is the Zoning Map referred to in Section 53-1 of the Land Development Code of Hendry County, Florida," together with the date of the adoption of this code. The zoning map shall be maintained in the office of the county clerk. Copies may be produced and circulated for the convenience of county officials and of the general public, and shall be marked so as to indicate that the zoning map is located in the office of the county clerk.
1-53-1.3. Unauthorized changes prohibited. No changes of any nature shall be made on the zoning map or any matter shown thereon except in conformity with the procedures set out in chapter 1-50 and in applicable state law. Any unauthorized change of whatever kind by any person or persons shall be considered a violation of this code and punishable as provided in chapter 1-51.
1-53-1.4. Replacement of zoning map. If the zoning map becomes damaged, lost, destroyed or difficult to interpret by reason of the nature or number of changes, the board of county commissioners may by ordinance adopt a new zoning map, which shall supersede the prior zoning map.
1-53-1.5. Interpretation of zoning district boundaries. The location of any zoning district boundaries shown on the zoning map shall be determined using the following rules:
(1)
Zoning district boundary lines are intended to follow centerlines of streets or alleys, street or railroad rights-of-way, or watercourses, or to be parallel or perpendicular thereto unless said zoning district lines are fixed by dimensions shown on the zoning map.
(2)
Where zoning district boundaries approximately follow platted lot lines on the zoning map, said lot lines shall be construed to be said boundaries.
(3)
Where zoning district boundaries approximately follow county limits, said limits shall be construed to be said boundaries.
(4)
Where zoning district boundaries approximately follow section lines or subsection lines, said lines shall be construed to be said boundaries.
(5)
Where the foregoing rules cannot be applied to a zoning district boundary traversing unsubdivided property, or where a zoning district boundary divides a lot, the location of any said boundary shall be determined by dimensions shown upon the zoning map or by use of the scale shown upon the zoning map.
(6)
If, after the application of the foregoing rules, uncertainty exists as to the exact location of the zoning district boundary, the community development director shall interpret and determine said location in accordance with the intent and purpose of this code. Appeal from the interpretation of the community development director shall be only to the board of county commissioners in accordance with procedures prescribed in section 2-10-25 or its successor.
