- TITLE, PURPOSE AND INTENT
This ordinance shall be known, cited and referred to as the "Village of Hinckley Zoning Ordinance". As used in this ordinance, the word "title" shall refer to all provisions of this ordinance.
The intent of this ordinance is to divide the municipality into districts for the purpose of classifying, regulating and restricting the location of trades, industries and commercial enterprises, and the location of buildings arranged, intended and designed for specified use; of regulating and limiting the intensity of the buildings hereafter erected; of classifying, regulating and determining the area of front, rear, and side yards, courts and other open spaces about buildings; and regulating and limiting the intensity of the use of the land and lot area within such municipality; creating a Zoning of Board Appeals; defining certain terms used in said ordinance; providing penalties for its violation; and designating the time when the ordinance shall take effect.
The purpose of this zoning ordinance is to guide development in accordance with existing and future needs in order to protect, promote and improve the public health, safety, morals, convenience, order, appearance, prosperity and the general welfare of the citizens of the Village of Hinckley. More specifically, this ordinance is intended to assist in achieving the following objectives:
1.
To encourage the development of buildings and uses on appropriate sites in order to maximize community-wide social and economic benefits while accommodating the particular needs of all residents, and to discourage development on inappropriate sites;
2.
To protect and enhance the character and stability of existing residential, commercial and industrial areas, and to gradually eliminate nonconforming uses and structures;
3.
To conserve and increase the value of taxable property throughout this municipality;
4.
To ensure the provision of adequate light, air and privacy for the occupants of all buildings;
5.
To provide adequate and well-designed parking and loading space for all buildings and uses, and to reduce vehicular congestion on the public streets and highways;
6.
To provide for efficient administration and fair enforcement of all regulations set forth herein; and
7.
To clearly and concisely explain the procedures for obtaining variances, special use permits, amendments and the like.
If any section, clause, provision, or portion of this ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect the remainder of this ordinance.
It is not intended by this ordinance to repeal, abrogate, annul, impair or interfere with any existing easements, covenants, deed restrictions, agreements, ordinances, rules, regulations or permits previously adopted or issued pursuant to law. However, wherever this ordinance imposes greater restrictions, the provisions of this ordinance shall govern.
The provisions of this ordinance shall be interpreted and applied as minimum requirements, shall be liberally construed in favor of the municipality and shall not be deemed a limitation or repeal of any other power granted by Illinois Revised Statutes.
All ordinances or parts of ordinances of the municipality, inconsistent or conflicting with this ordinance, to the extent of the inconsistency only, are hereby repealed.
This ordinance shall be effective after notice and publication, hearing and adopting by the governing body as required by Illinois Revised Statutes.
