ARTICLE VA
D-1 Downtown District

§ 265-28.1 Establishment; requirements.
A.
The Downtown District in the Village of Holley shall consist of addresses:
(1)
Within the Public Square; and
(2)
Numbers 1 through 12 Thomas Street; and
(3)
Numbers on Geddes Street Extension.
B.
The Downtown District will conform to the C-1 provisions of this Code, except as set forth below.
C.
Within the Downtown District, the following provisions shall apply:
(1)
No sign shall be internally illuminated, nor shall it consist of flashing, intermittent, rotating or moving light or lights.
(2)
Bare-bulb signs shall not be permitted, subject to the following exception:
(a)
A neon-type "open" sign not exceeding two square feet in area.
(3)
No apartments, or residential uses, shall be permitted on the first floor of any building in this district.
(4)
Apartments, or residences, shall be permitted on floors above the first floor (street level), subject to all applicable provisions of the New York State Property Maintenance Code or other New York State Fire or Building Codes.

(a)
Apartments, or residences, within this district are not required to provide a minimum number of parking spaces per unit, or residence.
(b)
Residents, or tenants, of these units, or locations, may be provided authorization to utilize municipal parking lots, upon request, and subject to certain restrictions, requirements, fees, or limitations.
