CHAPTER 17

04 - TITLE AND AUTHORITY

17.04.010 - Title.

The ordinance codified in this Title 17 shall be known as the "Amended Zoning Ordinance of the City of Homedale, Idaho."

17.04.020 - Authority.

This Title 17 is adopted pursuant to authority granted by Title 67, Chapter 65 of the Idaho Code and Article 12, Section 2 of the Idaho Constitution, as amended or subsequently codified.

17.04.030 - Provisions declared minimum requirements.

In their interpretation and application, the provisions of this Title 17 shall be held to be minimum requirements, adopted for the promotion of the public health, safety and the general welfare. Whenever the requirements of this Title 17 conflict with the requirements of any other lawfully adopted rules, regulations, ordinances or resolutions, the most restrictive or that imposing the higher standards shall govern.

17.04.040 - Combining of permits.

The city is required to coordinate with other departments and agencies concerning all permits which may be required in this Title 17 and previously or subsequently adopted.

17.04.050 - Severability.

Should any section or provision of the ordinance codified in this Title 17 be declared by the courts to be unconstitutional or invalid, such decision shall not affect the validity of the ordinance codified in this Title 17 as a whole or any part thereof other than the part so declared to be unconstitutional or invalid.

17.04.060 - Repeal of conflicting ordinance effective date.

All ordinances or parts of ordinances in conflict with the ordinance codified in this Title 17 or inconsistent with the provisions of this Title 17 are repealed to the extent necessary to give this Title 17 full force and effect. This Title 17 shall become effective from and after the date of its approval and adoption, as provided by law.
