RESIDENTIAL DISTRICTS

10-9A-1: PURPOSE:

The R-1 residential district is established for existing and future one-family detached dwelling areas which are provided with full urban services. (Ord. 1098, 11-8-2004)

10-9A-2: BULK STANDARDS:

The following standards apply in the R-1A, R-1B, and R-1C one- family residential districts and are the minimum requirements unless otherwise noted: (Ord. 1177, 9-8-2008)

Notes:
   1.    Additional Minimum Lot Area Requirements: If the lot is not served by municipal water and sewer, then the minimum lot area in each of the above listed zoning districts shall be 21/2 acres. Provided, however:
      a.    If the subject lot is a lot of record as of February 1974, and is not served by municipal water or sewer, then the minimum lot area in each of the above listed zoning districts shall be 40,000 square feet.
      b.    If the subject lot is a lot of record as of February 1974, and is not served by municipal sewer but is served by municipal water, then the minimum lot area shall be 20,000 square feet.
   2.    Additional Minimum Lot Width Requirements:
      a.    If the subject lot is not served by municipal water or sewer, then the minimum lot width shall be 170 feet for an interior lot and 200 feet for a corner lot or that minimum lot width as set forth above, whichever is greater.
      b.    If the subject lot is not served by municipal sewer but is served by municipal water, then the minimum lot width shall be 100 feet or that minimum lot width as set forth above, whichever is greater.
   3.    Attached Garages: An attached garage with no living space above, below, in front of or behind it, may meet the minimum side yard setback standard for accessory structures found in subsection B of this section rather than the larger setback required of principal structures as found in this table.

      1.    Additional impervious surface may be allowed by a stormwater facilities maintenance agreement (SWFMA) as listed above, provided the following criteria are met:
         a.   A stormwater management system shall be constructed within the property (not within any public easements or right of way) that meets the best management practices design criteria as set forth in the northwest area ordinances and stormwater manual.
         b.   The stormwater management system, grading plan (including necessary details for construction, showing proper location, material, size, grades and vegetation), and erosion control plan shall be approved by the engineering division prior to ground disturbance or installation of the facility.
         c.   The stormwater management system is considered a private system and the responsibility of maintenance is that of the owner.
         d.   The stormwater management design of the facility shall provide storage and treatment for the regulatory 100-year event volume as it relates to the additional impervious surface being considered.
         e.   A stormwater facilities maintenance agreement that includes an operation and maintenance plan with annual reporting to the city shall be entered into between the applicant and city to address responsibilities and maintenance of the stormwater system.
         f.   An escrow or fee, to be determined by the city engineer, shall be submitted to the city with the stormwater management system submittal. The final amount and submittal process shall be determined by the city by the time the owners are ready to submit the stormwater management system and grading plan. Surety shall be provided to draft the SWFMA by the City Attorney and to ensure construction of the system according to the plans approved by the city engineer.
         g.   The soils shall be tested to determine the infiltration capacity at and below the stormwater facility to ensure the stormwater management facility performs and functions within the assumed design parameters. A three foot (3') separation shall be maintained from seasonal high water levels and the bottom of any facility. (Ord. 1209, 4-26-2010; amd. Ord. 1386, 8-10-2020)

10-9B-1: PURPOSE:

10-9C-1: R-3A MULTIPLE-FAMILY RESIDENTIAL DISTRICT:

   A.   Purpose: The R-3A multiple-family residential district is established in areas which are provided with full urban services for single family and multiple-family residential buildings containing no more than four dwelling units per building, with densities ranging from four (4) to eight (8) dwelling units per net acre.
   B.   Allowable Uses: See table in Section 10-6-1 of this title for a listing of allowable uses within the R-3A multiple-family residential district.
   C.   Site Plan Review: All development within the R-3A multiple-family residential district shall comply with Title 10, Chapter 15, Article J, Site Plan Review.
   D.   Minimum Standards: The following standards apply in the R-3A multiple-family residential district and are the minimum requirements unless otherwise noted:

      3.   Minimum Distance Between Structures: In addition to the setback requirements of Section 10-9C-2 of this article, the following minimum distances shall be maintained between structures:
         a.   A minimum of twenty feet (20') shall be maintained between the sidewalls of end units.
         b.   Where the rear of a structure faces the rear of an adjoining structure, the minimum distance between structures shall be sixty feet (60').
         c.   Where the rear of a structure faces the sidewall or front of an adjoining structure, the minimum distance between structures shall be forty feet (40').
   E.   Platted Additions: The following platting standards apply in the R-3A multiple-family residential district:
      1.   Density: All developments shall be built in platted additions to the city having a maximum density of eight (8) dwelling units per net acre.
      2.   Recreational Space: At least twenty percent (20%) of the open space shall be reserved for playgrounds and/or recreational space.
   F.   Other Requirements:
      1.   The developer of each multiple-family development shall be responsible for grading and planting open space areas disturbed during the development process and for building the playground and/or recreational space required in E2.
      2.   All internal private roadways shall be a minimum width of twenty-eight feet (28'), as measured from the back of curb to the back of curb, with parking allowed on one side only; or twenty-four feet (24'), as measured from the back of curb to the back of curb, with no parking allowed.
      3.   All parking and driving surfaces shall be surfaced with concrete or asphalt and shall be defined by continuous concrete perimeter curbing.
      4.   Sidewalks shall be provided from parking areas, loading zones, and recreation areas to the entrances of the buildings.
      5.   Garages and other accessory structures shall be architecturally compatible in construction and appearance with the main building.
      6.   Any dumpster, garbage or waste container shall comply with Section 10-15-9.
      7.   All exterior vertical surfaces of a residential principal structure or residential accessory structure shall comply with Section 10-15-17. (Ord. 1482, 8-12-2024)

10-9C-2: R-3B MULTIPLE-FAMILY RESIDENTIAL DISTRICT:

   A.   Purpose: The R-3B multiple-family residential district is established in areas which are provided with full urban services for multiple-family residential developments with densities of eight (8) to twelve (12) dwelling units per net acre in buildings containing no more than twelve (12) dwelling units per building.
   B.   Allowable Uses: See table in Section 10-6-1 of this title for a listing of allowable uses within the R-3B multiple-family residential district.
   C.   Site Plan Review: All development within the R-3B multiple-family residential district shall comply with Title 10, Chapter 15, Article J, Site Plan Review.
   D.   Minimum Standards: The following standards apply in the R-3B multiple-family residential district and are the minimum requirements unless otherwise noted:

10-9C-3: R-3C MULTIPLE-FAMILY RESIDENTIAL DISTRICT:

   A.   Purpose: The R-3C multiple-family residential district is established in areas which are provided with full urban services for multiple-family residential developments with densities of twelve (12) to thirty-five (35) dwelling units per net acre.
   B.   Allowable Uses: See table in Section 10-6-1 of this title for a listing of allowable uses within the R-3C multiple-family residential district.
   C.   Site Plan Review: All development within the R-3 multiple-family residential district must comply with Title 10, Chapter 15, Article J, Site Plan Review.
   D.   Minimum Standards: The following standards apply in the R-3C multiple-family residential district and are the minimum requirements unless otherwise noted:

10-9D-3: ALLOWABLE USES:

10-9E-1: PURPOSE:

The LaFayette neighborhood is a unique area to the city, and is the subject of a component of the city comprehensive plan. The LaFayette neighborhood comprehensive plan component encourages growth in the area by means of the planned unit development approach. As multiple-family developments are proposed in the neighborhood and are found compatible by the city, the ordinance that is specific to the LaFayette neighborhood will be amended by adding the new development for the subject property. 10-9E-2: TRAFFIC ALLOCATION:

A principal reason for planning the development of the LaFayette neighborhood by means of a specific comprehensive plan component and a separate ordinance unique to the neighborhood is that the traffic capacity of the main arterial streets in the neighborhood is limited. Consequently, to better assure that the key intersections in the neighborhood function at an acceptable level, and to allow for an equitable distribution of traffic to all properties in the neighborhood, regardless of whether they are the first or last to develop, traffic generation is carefully planned and monitored. Each proposed development is analyzed against the needs and resources of the whole neighborhood, and at the same time, the ordinance for the LaFayette neighborhood is amended by adding a new use/development. A peak P.M. rush hour traffic amount will also be allocated for the new use/development. (Ord. 1098, 11-8-2004)
