40 - SUPPLEMENTARY REQUIREMENTS
No building or structure (except those constructed for flood control purposes by a governmental agency) shall be constructed within a flood channel. Structure and building setbacks along and around established flood channels shall be in accordance with the most currently adopted "Iron County Flood Channel Setback Standards," approved by resolution.

A.
Supplementary Requirements for Circus and/or Carnival, Christmas Tree Sales and Other Temporary Uses. The zoning administrator may issue a temporary use permit for a circus and/or carnival or other amusement enterprise of a similar nature, Christmas tree sales lot or other temporary use not to exceed sixty days in duration, with a finding that the use will not conflict with the uses in the vicinity of the subject property. To determine the compatibility of uses, the zoning administrator may call a public hearing. Request for a temporary use permit shall be submitted in writing on the application provided by the county.
In issuing the permit, the zoning administrator may:
1.
Identify the length of the time the temporary use permit shall be valid;
2.
Identify hours of operation of the temporary use;
3.
Identify and establish any other requirements determined necessary for the protection of the health, safety and welfare of the residents of Iron County.
B.
Temporary buildings and uses are permitted as follows:
1.
Temporary buildings, mobile homes and travel trailers used in conjunction with construction work only during the period of such construction, subject to securing a temporary use permit and the following:
a.
Any permit approved for such temporary building, mobile home or travel trailer shall be limited to a period of time not to exceed one year from the date of approval, but such permit may be renewed for an additional one year period thereafter upon the property owner submitting to the zoning administrator satisfactory evidence indicating the need for such temporary building, mobile home or travel trailer continues to exist.
b.
Unless such use permit is renewed, any temporary building, mobile home or travel trailer shall be removed from the property upon the expiration of the previously approved use permit or within ten days after completion of the construction work, whichever occurs first.
2.
Temporary uses such as the cutting or storage of lumber or the storage of building materials and construction equipment conducted or used in conjunction with construction work only during the period of such construction, subject to securing a use permit and the following:
a.
Any use permit approved for such temporary use shall be limited to a period of time not to exceed one year from the date of such approval, but such permit may be renewed for an additional one year period thereafter upon the property owner submitting to the zoning administrator satisfactory evidence indicating that the need for such temporary use continues to exist.
b.
Unless such use permit is renewed, such temporary use shall be removed from the property upon the expiration of the previously approved use permit or within ten days after completion of the activity, whichever occurs first.
3.
Temporary Real Estate Offices.
a.
Such office shall be located on the property being subdivided or sold, and its use shall be limited to the sale of lots or property.
b.
Such office shall be subject to the height, yard, intensity of use and parking regulations for the zoning district in which it is located and shall meet minimum water and sanitary standards as required by the zoning administrator.
c.
Any use permit approved for such office shall be limited to a period not to exceed two years from the date of approval but may be renewed for an additional one year period if lots or property remain unsold.
d.
Unless such use permit is renewed, such office shall be removed from the property upon the expiration of the use permit.
