The adoption and enforcement of the city building code for the construction of buildings and structures located within the city serves the public interest by providing for structural stability, fire resistance, adequate ventilation and other safety and sanitary features. (Ord. 2005-13, 2005)
16.26.102: BUILDING PERMIT REQUIRED:
(1) The construction, reconstruction, restoration, extension, alteration, expansion or enlargement of any building or structure shall not be commenced until a building permit application is approved, as required by the city's adopted building code, unless exempt by the building code or state law, including agricultural buildings to the extent exempted by the provisions of Utah Code Annotated section 58-56-4, as amended.
(2) For any construction exempt from the requirements of the adopted building code or state law, the building official may require the submission of information and materials necessary to ensure compliance with the provisions of all land use ordinances, building code and state law. 16.26.103: BUILDING PERMIT APPLICATION:
(1) Application for a building permit shall be presented to the building official, including all information and materials as required by the adopted building code.
(2) Prior to the issuance of any required building permit, the proposed use, building or structure shall have received the necessary land use application approvals, as applicable, and as required by this title, and all other land use ordinances.
(3) Prior to issuance of a building permit, the applicant may be required to post a bond, or provide other financial security, in such form and sum as required by the land use authority, or building official, and approved by the city attorney, with sufficient surety running to the city to offset any costs or expenses associated with construction activities on and off the site. 16.26.104: BUILDING CODE COMPLIANCE:
All structures requiring a building permit shall comply with the requirements of the building code, as adopted by the city. (Ord. 2005-13, 2005)
16.26.105: CERTIFICATES OF OCCUPANCY:
A certificate of occupancy (CO) shall be required before any building or structure, or part thereof, may be used or occupied, as required by the adopted building code. No certificate of occupancy shall be issued permitting the occupancy or use of any building or structure unless and until:
(1) All construction has been completed, as authorized, if a building permit is required.
(2) The use conforms to the regulations of all land use ordinances and all other applicable statutes, ordinances and regulations, if no building permit is required.
(3) Payment of all applicable fees and charges, other requirements have been provided, and all conditions for the establishment of the use, building or structure have been met. (Ord. 2005-13, 2005)
16.26.106: EXEMPTIONS:
The following properties, uses and structures shall, to the extent provided by state law, be exempt from the provisions of this chapter:
(1) Properties owned and operated by the state or federal government. Where state or federal law requires that the agency take steps to comply with all applicable local regulations, this exemption shall not be construed to abrogate that requirement.
(2) Agricultural buildings to the extent exempted by the provisions of Utah Code Annotated section 58-56-4, as amended. (Ord. 2005-13, 2005)
