FENCES, WALLS

AND LANDSCAPING SECURITY, ORNAMENTAL OR SCREENING

§ 153.130 HEIGHT OF FENCES AND WALLS IN SIDE AND REAR YARDS.

   Fences and walls in side or rear yards may not exceed 6.5 feet in height in all residential districts nor 8 feet in business and industrial districts or between residential and business or industrial districts.

§ 153.131 HEIGHT OF FENCES, SOLID WALLS AND HEDGES IN FRONT YARDS.

   Fences, solid walls and hedges in excess of 36 inches in height in the minimum front yard building setback area are prohibited in all districts.

§ 153.132 OPENNESS OF FENCES.

   Except in residence districts, all fences in excess of 4 feet shall be at least 30% open for passage of light and air, except screening for mechanical equipment. This requirement is satisfied if the fence is at least 30% open from at least one view point along a 180 degree arc from the outside of the fence.

§ 153.133 BARBS OR SPIKES ON FENCES.

   No fence shall have barbs or spikes at any point less than 6.5 feet above the ground, except where the fence is used for agricultural purposes.

§ 153.134 PLACEMENT OF FENCES ALONG LOT LINES.

   Fences may be placed along lot lines, provided no damage of any kind results to the abutting property.

§ 153.135 DIRECTION OF FENCE FACING.

   That side of the fence considered to be the face or front (back of fence is usually applied to fence posts) shall either face toward the adjoining property or be so applied that both sides of the fence have the same appearance.

§ 153.136 FENCES IN PUBLIC RIGHTS-OF-WAY.

   No fence, wall or hedge may be placed in a public right-of-way.

§ 153.137 TYPES OF SCREENING.

   The screening required in this subchapter shall consist of a fence, wall or landscaping area and shall be approved by the Council after recommendation by the Planning Commission in each instance. Landscape planting may be required in addition to the screening fence or wall.

§ 153.138 SCREENING IN RESIDENTIAL DISTRICTS.

   Screening shall be required in residential districts where:
   (A)   Off-street parking areas contain more than 4 parking spaces that are within 30 feet of an adjoining lot.
   (B)   The driveway to a parking area of more than 6 parking spaces is within 15 feet of an adjoining lot.

§ 153.139 SCREENING IN PROXIMITY TO RESIDENTIAL LOT.

   Screening of at least 60% opacity shall be required where:
   (A)   Any business or industrial use is adjacent to any zoned residential, along the boundary of any such residential lot;
   (B)   Any business, parking lot or industrial use is across the street from a residential district, but not on that side of a business or industrial use considered to be the front;
   (C)   Any non-residential use in residential districts by conditional use permit or PUD, such as schools, houses of worship, day care facilities over 10, residential facilities over 6, or public uses other than parks, adjoins any single or two family residential lot.

§ 153.140 SCREENING OF MECHANICAL OPERATING EQUIPMENT.

   Screening shall also be provided where privately owned mechanical operating equipment is located on the ground of the premises, the screening shall be constructed and located so as to prevent direct view of the equipment. Mechanical operating equipment shall include all exterior devices used to service the building or its occupants, including but not limited to electrical, HVAC, plumbing, communications (including telephone and dish antennae) and storage tanks.

§ 153.141 TRAFFIC VISIBILITY.

   Except in the Central Business (“CB”) District, all signs, plantings, landscape material, fence, screening material, and other material in a site distance triangle shall be located and maintained so as not to obstruct the vision of motor vehicle operators. SITE DISTANCE TRIANGLE is the area between the point of intersection of the right-of-way lines of public streets and a straight line connecting points on the right- of-way lines 30 feet from the point of intersection.

§ 153.142 RESPONSIBILITY FOR SCREENING.

   The owner or occupant of the premises containing the use or features to be screened shall provide the required screening.

§ 153.143 FENCES IN NON-RESIDENTIAL SITUATIONS AND EXCEPTIONAL AND UNUSUAL CIRCUMSTANCES IN RESIDENTIAL DISTRICTS.

   After review by the Planning Commission, the Council may authorize issuance of a conditional or interim use permit allowing deviations from these requirements for fences, walls, and landscape screening. The applicant must submit a site plan, documentation showing the unusual circumstances justifying the proposed deviation, and plans for the proposed fence, wall or landscape screening. This provision is intended to allow flexibility in meeting the purpose and intent of this section without proving a hardship and to improve the livability, appearance, and security of properties and their relationships to one another.

§ 153.144 RELOCATED STRUCTURE.

   (A)   A moving permit and a building permit shall be obtained from the city before any building or structure that is more than 120 square feet in floor area and has been wholly or partially erected on any premises, located either within or outside of the city, is moved to or placed upon any premise in the city.
   (B)   The applicant shall submit the following with the permit application:
      (1)   Photographs of the structure to be moved (taken from 2 or more angles), of the lot to which the structure is to be moved, and of adjacent lots and structures;
      (2)   A site plan; and
      (3)   A list of proposed improvements to the structure.
   (C)   Any such building or structure shall conform to all the provisions of this chapter in the same manner as a new building or structure. (See § 150.06 for general and special requirements applicable to moving any structure on a street or highway.)

§ 153.145 LANDSCAPING.

   Appropriate and unified landscaping is essential to meet the community objectives established in the Comprehensive Plan. A Landscape Plan must be submitted in the Site Plan review stage for all development in R-3 Districts and all Business and Industrial Districts.
   (A)   Minimum requirements. In all districts, all developed uses shall provide and maintain a landscaped area according to minimums in the District Requirements Chart. Planting within the area shall be subject to approval of the City Council. Ponds are permitted as a landscaping component.
   (B)   Landscape yard along all streets. In all residential districts, all developed uses shall provide and maintain a landscaped front yard. The front yard shall be kept clear of all structures, storage and off-street parking, except upon driveways.
