GENERAL PROVISIONS

§ 27-101 Short Title.

This chapter shall be known as, and may be cited as, the "Jonestown Borough Zoning Ordinance."

§ 27-102 Purpose.

Specifically, this chapter is enacted to divide the Borough into districts, and within said districts regulate and restrict the structures, the size of yards, courts, and other open spaces, the density of population and the location and use of buildings, structures, and land for trade, industry, residence, and other purposes; establishing a Zoning Hearing Board and prescribing its powers and duties; providing penalties for the violation of this chapter and repealing all ordinances in conflict herewith, and in accord with Act 247, the "Pennsylvania Municipalities Planning Code."

§ 27-103 Community Development Objectives.

The zoning regulations and districts as herein established have been made in accordance with a comprehensive plan and goals and observations contained therein of the Borough for the purpose of promoting health, safety, morals, and the general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, and other dangers; to provide adequate light and air; to prevent overcrowding of the land; to avoid undue concentration of the population; to facilitate the adequate provision of transportation, water, sewerage, schools, parks, and other public requirements.

The regulations have been made with reasonable consideration, among other things, to the present and trending character of the district and its peculiar suitability for the particular uses with a view of conserving the value of existing structures and encouraging the most appropriate use of land throughout the community. These regulations do not in any way alter the present uses of the land but are specifically directed towards future developments and alterations for the purpose outlined in the previous subsection.

§ 27-104 Planned Unit Development.

The regulations of this chapter as hereinafter defined may be modified to include a planned unit development, in order that this act may be furthered in a time of growing demand for economics in building and utilities layout; to insure the uniform treatment of the improvement of land consistent with the objectives of sound zoning; to encourage innovation in design and layout of structures and land areas to conserve and more efficiently use open space; to provide flexibility of provisions governing land development.
